SET OUT IN ORDINANCE NO. 467 WHICH SAID ORDINANCE WAS'ADOPTED JULY 12, 191 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, FAIRHOPE, ALA- BAMA AS FOLLOWS: ORDINANCE NO. 467 SHALL BE, AND THE SAME IS HEREBY AMENDED TO READ AS FOLLO Secti6n,1: DOMESTIC AND SMALL COMMERCIAL NATURAL GAS USERS WITHIN THE CITY IMITS OF FAIRHOPE, ALABAMA: 1. For the first 300 cu. Ft. each, month Minimum $ 2.00 2. For the next 1000 cu. Ft. each month per 100 cu. ft. 0.18829 3. All over- 50000." per TOO cu. ft. 0.06949 Section 2: GAS COMMERCIAL RATE There is herebyestablished for the Commercial Rate of the use of natural i;n the City, of Fairhope: 50,000 cu. ft. or over each month per 100 cu. ft. 0.06949 Minimum Monthly Bi11 $ '.7.90 . Section 3: BILLING DEMAND The Billing Demand shall be the maximum daily demand established during any of the twelve months ended with current billing. Such demand shall be measured, or at the option of the Company be estimated t 1/30th of the maximum delivery during such twelve months. Secti6h :, LARGE INDUSTRIAL RATE For large industrial users, the rate shall be such as may be negotiated be - the City and the individual User. Sectton 5: DISCONNECT AND RECONNECT CHARGE Theta Is hereby established a charge of Fifteen ($15.00) Dollars for dis- nnecting and then reconnecting of services, except where services are disconnec for nonpayment, in which case reconnecting.charge will be Fifteen ($15.00) liars. Secttdh '9: LARGE INDUSTRIAL USERS WITHOUT THE CITY LIMITS OF FAIRHOPE For large Industrial users without the City Limits of the City of Fairhope, he rate shall be such as maybe negotiated between the City and the User. Section 10:' CHARGES There shall be a charge,of Fifteen ($1,5.00) Dollars for disconnecting and reconnecting of services for any individual user. Section ll INCREASE There Is hereby established an automatic_ rate Increase or decrease whenever e supplier of natural. gas to the City,of Falrhope increases or decreases its tes, and the increase and decrease shall be based on a formula based upon the rcentage paid by the City of Faifrhope for its wholesale rate in comparison with .s retail rate to its users in.accordance with all prior sections set out. There shall be no further action by the Council either for a rate increase decrease, but shall be automatic when'the supplier of natural gas to the City Fairhope either increases or decreases its wholesale rate. Secti6n'12: SEVERABILITY CLAUSE If any Sectton of this Ordinance shall be declared unconstitutional by a urt of competent jurisdiction, all other Sections herein shall remain in full rce and effect. S'ection,13: EFFECTIVE This Ordiaence'shall become effective January 1, 1974, after its due adoptioi end publication. 4- 6
