HomeMy WebLinkAboutO-517ORDINANCE N0. 517 AN ORDINANCE PROHIBITING ANY PERSON4 FIRM, PARTNERSHIP OR CORP- ORATION WHO SHALL APPLY TO THE CITY COUNCIL OF THE CITY OF FAIBHOPE TO REZONE ANY PROPERTY LOCATED WITHIN ITS JURISDICTION, OR WITHIN THE JURISDICTION OF THE CITY PALNNING AND ZONING COMMISSION, AND WHOSE APPLICATION SHALL BE DENIED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF FAIRHOPE SHALL BE PROHIBITED FROM REAPPLYING FOR RE- ZONING ON THE SAME PREMISES UNTIL AFTER THE EXPIRATION OF ONE (1) YEAR FROM DATE OF DENIAL. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMAt SECTION 1, Any person, firm, partnership or corporation, who shall apply to the Mayor and City Council of the City of Fairhope to rezone any properties located within the City Limits or within the jurisdiction of the City Planning and Zoning Commission, and whose application shall be denied after due publication as required by law to the Mayor and City Council of the City of Fairhope, shall be prohibited from re -applying for rezoning until after the expir- ation of one (1) year from the date of the actions denying the said application for rezoning by the Mayor and City Council of the City of Fairhope, after due publication, protest meeting and action by the said Mayor and Council of the City of Fairhope unless it is the unanimous opinion of the Planning and Zoning Commission that circumstances warrant another hearing within the year, SECTION 2, This Ordinance shall become effective upon its due adoption and publication as required by law, ADOPTED THIS THE 10th day of December, 1973-at a regular meeting held on the loth day of December, 1973- Approved SJ C-`S f D, d I'A Mayor Attest: S 016r-tf- / City Clerk
