BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that Section 13, District Boundaries of Zoning Ordinance No. 295 be amended by rezoning from R-2 to M-1, Lots 1 through 4, Block 2, Hoyle -Worcester Addition and by rezoning from B.-1 to M-1, Lots 1 through 8, Block 1, Hoyle -Worcester Addition to the Town of Fairhope, as recommended by the Planning and Zoning Commission. Macon, Mayor ATTEST Marie Moore, City Clerk STATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the Adult and Tourist Recreation Building on Morphy Avenue, Tuesday, June 22, 1971 at 7:30 P.M. with the following members present: Mayor R. C. Macon, Councilmen: ]James P. Nix, John A. Robertson, Robert H. Cowen, H. G. Bishop and Sam E. Box. Minutes of the previous regular meeting were approved. This being date set for public hearing on rezoning -property of Ritz Instruments, Inc. located on West corner of Greeno Road and Nichols Avenue, there being no protests, the following Ordinance was introduced by Councilman Cowen: ORDINANCE NO. 448 AN ORDINANCE AMENDING SECTION 139 DISTRICT BOUNDARIES OF ZONING ORDINANCE NO. 295• BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that Section 13, District Boundaries, of Zoning Ordinance No. 295 be amended by rezoning from R-2 to M-1. Lots 1 through 4. Block 2, Hoyle -Worcester Addition and by rezoning from B-1 to M-1, Lots 1 through 8. Block 19 Hoyle -Worcester Addition to the Town of Fairhope, as recommended by the Planning and Zoning Comm- ission. Councilman Cowen moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption of the Ordinance at this meeting, be and the same are hereby sus- pended for the purpose*of permitting the said Ordinance tobtinally' passed and adopted at this meeting. The question was put before the Council and on roll call the vote was as follows: Yea: Mayor Macon, Councilmen: Nix, Robertson, Cowen, Bishop and Box. Nay: None. Motion adopted by unanimous vote. Councilman Cowen moved that Ordinance No. 448 be finally passed and adopted as introduced. Councilman Nix seconded the motion. The question of , final passage and adoption of said ordinance was put before the Council and on roll call the results were as follows: Xea: Mayor Macon, Councilmen: Nix Robertson, Cowen, Bishop and Box. Nay: None. Ordinance No. 448 finally passed and adopted as introduced. Motion by Councilman Box that the following Ordinance be introduced: ORDINANCE N0. �46 AN ORDINANCE AMENDING SCHEDULE OF RATES FOR GAS AND SERVIC FURNISHED FROM THE GAS DISTRIBUTION SYSTEM. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA THAT THE FOLLOWING SCHEDULE OF RATES FOR GAS AND SERVICES FURNISHED•FROM THE GAS DISTRIBUTION SYSTEM OF THE CITY OF FAIRHOPE ALABAMA, BE AND THE SAME IS HEREBY ADOPTED: Schedule of Gas Rates - City of Fairhope, Ala. 05 Domestic and Small Commercial within the City Limits of the City of Fairhope, Alabama. Mth. .06317 per 100 Cu Ft Minimum Monthly bill 7.90 BILLING DEMAND: The Billing Demand shall be the maximum daily demand established during any day of the twelve months ended with current billing. Such demand may be measured, or at the option of the Company be t,Yestimated at 1/30th of the maximum monthly delivery during such twelve months. LARGE INDUSTRIAL RATE: For large industrial users the rate shall be such as may be negotiated between the City and the User. DISCONNECT AND RECONNECT CHARGE:9 There shall be a charge of Five ($5.00) Dollars for disconnecting and then reconnecting of services. CONSUMER DEPOSIT: Each consumer shall keep on deposit with the City Five ($5.00) Dollars for the payment of bills rendered to such consumer; provided, that any consumer who uses in excess of 509000 C.F. of gas from the system each month shall not be required to main- tain such deposit but may be required to maintain a deposit sufficient to cover the average bills of such consumer. Such demand may be measured or at the option of the company be estimated at 1/30th of the maximum monthly delivery during such twelve months. CONSUMER DEPOSITS OUTSIDE THE CITY LIMITS OF FAIRHOPE, ALA. Each consumer shall keep on deposit with the City Ten($10.00) Dollars as security for payment of bills rendered to such consumer; provided, that any consumer who uses in excess of 50000 C. F. of gas from the system each month shall not be reauired to maintain such deposit buy may be required to maintain a deposit sufficient to cover the averaae bills of such consumer. DISCONNECT AND RECONNECT CHARGEt There shall be a charge of Five ($5.00) Dollars for disconnecting and then reconnecting of services. That all Ordinances and parts of Ordinances in conflict herewith be and the same are hereby repealed. This Ordinance shall be effective with the July 20th, 1971 billing.
