Public Participation agenda item request (Fairhope Courier): Aug. 13 meeting
Please add me to the agenda for the 5 p.m. Monday, Aug. 13 public participation meeting that precedes the
work session and council meeting that night. I am requesting to be put on the agenda ahead of any others,
such as city staff, committees, officials, etc., not representing the "public" or media, per the resolution passed
by the council regarding the purpose of and procedure for public participation sessions . I make this request
because it was unclear to me from the public meeting notice whether the items noted on the combined Public
Participation meeting/Work Session notice were for the public participation session or the work session. I
also make the request because in the past some public participation agenda items by city staff, committees,
officials and others not representing the public as identified in the resolution have come first during the
meeting, leaving the public's agenda item requests for last, for which there has not always been time giving
the length of some of the city's presentations . I appreciate Council President Lonnie Mixon's granting of a
fiimilar request of mine earlier this year and trust the same will occur Monday night.
My agenda item concerns the recent removal of geese from the city's beach-front park. In the past the
council, mayor and staff have been helpful in responding to The Courier's request at public participation
sessions when I included the information I was seeking in advance. Some of the information and questions
below I requested last week of City Administrator Gregg Mims, who said he would be obtaining it. I am listing
those items and others as follows in the event that doing so can help expedite my agenda item, as well the
related public records request to be filed prior to the meeting:
1. When did the geese removal take place, from where specifically and at what time of day or night, and for
how long?
2. When was the request made of USDA to do so, and specifically for what action to be taken, by whom and in
what form-that is, what kind of communication, written or oral by which official and city staff member-and
when did USDA confirm that they would do so, by whom at the agency, and in what form?
3. Were there any permits or other city procedures with which USDA had to obtain or comply regarding the
action? Was there a written contract with USDA for the action? Was it approved by the council?
4. How much, if anything, did USDA say the removal action would cost, have they billed the city yet, and for
how much? Has the city paid? What part of the city's budget will these funds come from? How much did the
overall removal cost, including extra city staff time and/or other costs, in addition to that billed by USDA
and/or related federal or state agencies?
5. How many geese were removed and by what methods? How many vehicles and staff of USDA were involved
· n the action? Which city employees were involved during the removal-that is, were police or others involved
to cordon off the beach-front park or otherwise assist or observe?
6. Was the beach-front park closed to the public and by what means during the removal?

' 7. Were the geese relocated, and, if so, to where? Or were the geese killed by USDA or are there plans to do
so? If the geese were killed or there plans are to do so, by what method?
8. Will the next removal take place in October as Mr. Mims told The Courier last week? Are there any future
expected removals scheduled?
9. Was the Fairhope Environmental Advisory Board, which has been studying the issue and had planned to
make a recommendation to the council and mayor regarding the matter, consulted or its advice sought prior
to the removal? If not, why not?
10. Were any other waterfowl or animals harmed during the relocation?

FAIRHOPE, Alabama-Despite widespread media accounts that a public meeting would occur
Aug. 8 to discuss the fate of water fowl at Fairhope's beach-front par~ a large number of Canada
geese had been relocated a week earlier but that information never made it into newspaper and
television reports.
After digging into the issue this week, The Fairhope Courier reported in its Aug. 10 print edition
that some 40 Canada geese had already been moved by the U.S. Department of Agriculture on
instructions from city leaders.

Responses to Mike Odom 's questions perta ining to removal of geese
1. When did the geese removal take place, from where specifically and at what time of day
or night, and for how long? Tuesday, July 31, 5:30 a.m., Fairhope Municipal Beach
Duck Pond, taking approximately 2 hours.
2. When was the request made of USDA to do so, and specifically for what action to
be take n, by whom and in what form-that is, what kind of communication,
w r itten or oral by w hich officia l and city staff member-a nd when did US DA
co nfirm that they would do so, by w hom at the age n cy, and in what form? USDA
agreement obtained 7 /S/12 by James Gillespie and signed by Gregg Mims on
7/9/12.
3. Were there any permits or other city procedures with which USDA had to obtain
or comply regarding the action? Was there a written cont ract with USDA for the
action? Was it approved by the co u ncil? Cooperative Service Agreement with
USDA, was not approved by Council
4. How much, if anything, did USDA say the removal action w ould cost, have they
billed the city yet, and for how much? Has the city pa id ? Wh at part of the city's
budget will these fun ds come from? How much did the over all removal cost,

du ri ng the removal-that is, were police or others involved to cordon off the
beach-front park or otherwise assist or observe? Approximately, 41 geese were
removed, USDA provided 4 staff and 4 trucks, some of the USDA personnel
involved were being trained, and three city staff members.
6. Was the beach-front park closed to the pub l ic and by what means during the
removal? Yes
7. Were the geese relocated, and, if so, to where? Or were the geese killed by USDA

The plJlllose of this agreement is to cooperate in a wildlife damage management project, as described in the Work Plan on the next page.
ARTICLE2
APHIS WS has statutory authority under the Act of March 2, 1931 {46 Stat. 1468; 7 U.S .C.426-426b) as amended, and the Act of December
22, 1987 (IOI Stat. 1329-331, 7 U.S.C. 426c), to cooperate with States, local jurisdictions, individuals, public and private agencies,
organizations, and institutions while conducting a program of wildlife services involving mammal and bird species that are reservoirs for
zoonotic diseases, or animal species that are injurious and/or a nuisance to, among other things, agriculture, horticulture, forestry, animal
husbandly, wildlife, and human health and safety .
ARTICLE3
APHTS-WS and the cooperator agree:
I . APHlS-WS will provide the requested wildlife damage management services.
2. The cooperator · will provide the U.S. Department of Agriculrure the sum of$ __ to cover the costs as outlined in the
Financial Plan. Payment will be made by check payable to "U.S. Department of Agricult11re" by a mutually agreed upon date .
3 . The cooperator ensures and certifies that it is not currently debarred or suspended and is free of delinquent Federal debt.
4. The monies received by APHIS-WS will be used for wildlife damage management activities and upon t.ennination of the agreement any
unexpended fund! will be retained by APHIS-WS and used on similar program activities.
S. Nothing in this agreement shaJI prevent APHIS-WS from entering into separate agreements with any other organization or individual
for the purpose of providing wildlife damage management services exclusive of those provided for under this agreement .
6. Cooperator certifies that A PHIS WS has advised the <Cooperator> that there may be private sector service providers available
to provide wildlife management services that the <Cooperator> is seeking from APHIS WS .
The performance of wildlife damage management actions by APHIS-WS under this agreement is contingent upon a determination by
APHIS-WS that such actions are in compliance with the National Environmental Policy Act, Endangered Species Act, and any other
applicable environmental statutes. APIDS-WS will not make a finaJ decision to conduct requested wildlife damage management
actions untiJ it has made the detennination of such compliance.
ARTICLE4
Pursuant to Section 22, Title 41, United States Code, no member of or delegate to Congress shall be admltted to any slum or part of this
Agreement or to any benefit to arise therefrom.
ARTICLE5
APHIS assumes no liability for any actions or activities conducted under this Cooperative Service Agreement except to the extent that
recourse or remedies are provided by Congress under the Federal Tort Claims Act (Fl'CA), (28 U.S.C . 1346(b), 240J(b), and 2671-2680).
ARTICLE6
The Agreement shall become effective 7/5 , 20.12_ and shall continue in effect tmtil the completion or tennination of the project
This Agreement may be amended or terminated at any time by mutual agreement of the parties In writing. Further, in the event the
cooperator does not provide necessary ftmds, APHIS-WS is relieved of the obligation to provide services under this agreement.

Memorandum
To : City Council & City Residents
Re : Status of the Volanta Gulley Watershed Project
Date : August 9, 2012
From : Public Works Department
The City of Fairhope received a grant from the Mobile Bay National Estuary Program last summer to
study the Volanta Gulley watershed. This project was to be conducted in two phases.
Phase I of the project included contracting with a local engineer to develop a watershed management
plan for the Volanta Gulley watershed. The City contracted with Engineer, Trey Jinwright of Jade
Consulting. This portion of the plan also included the design of a minimum of five construction-ready
projects within the watershed. One of the projects was to be designed to alleviate drainage problems
just West of Greeno Road/ Highway 98 and one at Jasmine Park . There was to be a detailed scope of
work, schedule, and budget for (at least) two of the five construction projects. Phase I of our contract
with the Mobile Bay National Estuary Program was completed in Spring of 2012 and we are currently
installing Phase II.
Phase II of this grant project is to use the city's own labor and equipment to construct a minimum of
two of the designed projects. Grant funds were to be utilized to purchase the supplies required for
projects. The construction plans proposed and management plan can be found on the ci ty's website
under Deportments, Public Works, Vo/onto Gulley Management plan.
The City of Fairhope, along with Engineer Trey Jinwright of Jade Consultfng, held two public meetings to
gather input. The result from the last public meeting on January 17th and the directives from the city
council included:
1) Contact Arbor Gates and recommend that they make their holding pond hold more water during
storm events. There were several simple solutions suggested by Jade Consulting.
Status: Completed 7 /2012 . Public Works Director met with Managers of Arbor Gates discussing
the problem with their stormwater. This meeting was followed up with a letter. Arbor Gates
prom ised to look Into the issues and expressed their willingness to do what they could to
address the problem .
2) Contact the Alabama Department of Transportation and request that the ditches along Greeno
Road (aka Highway 98) be designed in such a way that they would hold, retain and fi ltrate the
water leaving t he road w ay . The re was an exampl e shown of what could work.
Status : Completed 8/2012. Public Works Director, ALDOT officials, and Jade Consulting met and
discussed methodology and options of watershed management on the right of way. This effort
was followed up by a letter to ALDOT officials. ALDOT expressed willingness to address issues,
but questioned whether the city could fund the effort.
3) Design a larger retention facility at Volanta Ball fields.
Status : In progress July-August 2012 .
4) Design a retention facility at Jasmine Park with the water holding no more than two days after a
rain event. Jasmine Park shall be kept as a playing field for recreation activities and maintain the
swing sets and playground equipment that exists currently.
Status : Public Works has not started this project. The estimated project start date is late
August 2012 .
5) If money allows, design a bio-retention pond at Jasmine/ Yupon and secondly at Westley and
Central.
Status : Westley and Central projects were completed in May 2012 . These projects were
bumped up to be implemented as part of a public works demonstration during Pu blic Works
week in May and did not require a permit from ADEM . The Jasmine/ Yupon w i ll be considered
as we install the Jasmine Park improvements.
6) Consider placing blocks on the storm drain inlet along Westley to reenact the Old Grady pond
that historically existed in the area.
Status: This was completed in May of 2012 as part of the Public Works demonstration.
However, the blocks multiplied a perched water table issue that the residence had historically
experienced. In late May and June, we experienced heavy rains which worsened the problem.
The blocks where thus removed to alleviate the homeowners problem in July.
Also included in the initial plans were to construct projects similar to Westley /Central
intersection at the Patlynn/ Leslie, Patlynn/ Allison and Audubon/ North Ingleside intersections.
Public Works would have moved ahead with these projects if it was consensual with adjoining
property owners and if funding allowed after the large construction projects were completed.
We have discussed these projects with the adjacent landowners at Patlynn/Leslie and at
Patlynn/ Allison. While some of the property owners were consensual, some of the adjoining
landowners were not consensual as of May, 2012 .

The City Council met in a Public Participation/Work Session
at 5:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 13 August 2012.
Present were Council President Lonnie L. Mixon, Councilmembers: Debbie
W. Quinn, Daniel Stankoski, Michael A. Ford, and Rick Kingrea, and City Clerk Lisa
A. Hanlcs. Mayor Timothy M. Kant and City Attorney Marion E. Wynne were
absent.
Council President Mixon called the meeting to order at 5:00 p.m.
The following topics were discussed:
• Mike Odom, The F a irhope Courier, addressed the City Council and thanked
them for allowing public participation. He asked about the removal of the geese
on July 31, 2012. James Gillespie briefly responded to the questions Mr. Odom
sent previously to the City. A copy of the questions and answers are on file in
the office of the City Clerk.
• Bobby Green, 415 Maples, addressed the City Council regarding the erosion of
the Volanta Watershed Project. He mentioned the six projects to be implemented
and three of these projects still need to be addressed: the retention pond at Arbor
Gates, the grading pond behind Arbor Gates, and the Alabama Department of
Transportation was to be contacted to set up a meeting. Ms. Fidler and Mr.
Jinright were to let the Greens and anyone else who asked to attend the meeting.
• Debra Green, 415 Maples, addressed the City Council regarding the Volanta
Watershed Project. Ms. Green said 'that filth was coming out of the pond down
on their property and on other property owners. She also reiterated what Bobby
Green stated to the City Council.
• City Administrator Gregg Mims addressed the City Council regarding the three
draft ordinances being presented. Mr. Mims thanked City Clerk Lisa Hanks,
City Attorney Tut Wynne, and Chief Bill Press who were a big help on all of
these. The Solicitation Ordinance was discussed first, then the Adult
Entertainment Ordinance, and finally the Parking Ordinance. Mr. Mims asked
the City Council to review and to send any suggestions back to him before the
September 10, 2012 City Council meeting.

• Arthur Bosarge, Assistant Public Works Director, addressed the City Council
regarding the Volan.ta Gulley Watershed Project. Mr. Bosarge read a
memorandum from Jennifer Fidler, Public Works Director, which gave the status
of the projects. A copy of the memorandum is on file in the office of the City
Clerk.
There being no further business to come before the City Council , the meeting
was duly adjourned at 5:55 p.m .
