HomeMy WebLinkAboutO-445ORDINANCE NO. 445 AN ORDINANCE MODIFYING, AMENDING AND CONFIRMING, AS SO MODIFIED AND AMENDED, IMPROVEMENTDORDINANCE NO. 439, INTRODUCED AT THE REGULAR MEETING OF MAY 11, 1970, AND ADOPTED AT THE REGULAR MEETING OF MAY 26, 1970. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FA]RHOPE, ALABAMA, as follows: SECTION 1. That upon evidence presented to and considered by it, the City Council does hereby make a finding and determination of the following facts: (a) At a regular meeting of the City Council of the City of Fairhope, held on the 26th day of May, 1970, Improvement Ordinance No. 439 was adopted and notice of the adoption of said Ordinance was given by publication of said Ordinance in the Fairhope Courier, a newspaper published in and of general circulation in the City of Fairhope, in the issued of May 28th and June 4th, which Ordinance stated that the City Council of the City of Fairhope would meet on the 8th day of June, 1970 at 7:30 P.M., at the City Hall in the City of Fairhope to hear any objections, remonstrances or protests that might be made to said improvements or the character of the ma- terial or materials to be used, and the manner of making the same. (b) A copy of said Improvement Ordiance No. 439 was sent by registered mail, postage prepaid, to each of the persons last assessing for taxation the property proposed to be assessed for said improvments at their last known addresses; said not:ice:-having been mailed on the 28th day of May, 1970, more than ten days prior to the 8th day of June, 1970. (c) The protests and objections of persons owning property 3 on oswalt Street from the North boundary of Nichols Street to the South Boundary of White Avenue, 320 feet, more or less, namely, Otto Randell, Tom Van Iderstine and B. L. Singletary, were heard, consi- dered, sustained and granted, and Improvement Ordinance No. 439 amen- ded and modified by the elimination of the Improvement on Oswalt St., from the North boundary of Nichols Street to the South Boundary of White Avenue, 320 feet more or less. (d) The protests of Mrs. R. Hoffman and written protest of C. Szymbroski to the improvement of Kumquat Street have been heard, considered and disallowed. (e) No other protest, objections or remonsrances against said improvements or the character of materials to be used and the manner of making said improvements have been filed in writing with the City Clerk or in her office, or have been made at this meeting. SECTION 2. That the improvements of Oswalt Street from the north boundary of Nichols Street to the South Boundary of White Ave., 320 feet more or less, as described in Section (q) of Improvement Ordinance No. 439 is hereby removed, eliminated and deleted from Ordinance No. 439 is hereby modified and amended by the removal, el- imination and deletion of that portion of Section (g) of said Or- dinance. SECTION 3. That Section 1 of Improvement Ordinance No. 439 is amended to read as follows: SECTION 1. Tha,t the following described streets in the City of Fairhope, Alabama shall be improved as hereinafter provided between the respective terminal points hereinafter set forth. (a) SIMON STREET: From the North edge of existing pave- ment on Edwards Avenue to the South boundary of Central Boulevard. 585 linear feet, more or less. (b) PATLYNN DRIVE: From the North end of existing pave- ment which is the South boundary of Gates F irmont Subdivision No. 1 to the North boundary of Gates Fairmont Subdivision No. 1 3?0 Linear feet, more or less. (c) WOODLAND COURT: From the West edge of proposed pave- ment on Patlynn Drive in Gates Fairmont Subdivision No. 1 to the end of the cul-de-sac, 230 Linear feet, more or less. (d) EVERGREEN STREET: From the East edge of pavement, on North Ingleside Avenue east and nor th to the end of the cul-de-sac in the third addition to Deep Tree Forest Subdivision, 800 linear feet, more or less. (e) NORTH INGLESIDE AVENUE: From the North end of existing pavement on North Ingleside Avenue to the North boundary of the third addition to Deep Tree Forest Subdivision, 125 linear feet, more or less. (f) FORSTER AVENUE: From the east edge of pavement on Sec- tion Street, (U.S. Route 98) to the west boundary of Bon Secour Ave., 835 linear feet, more or less. (g) OSWALT STREET: From be North boundary of White Ave., to the South boundary of Fels Avenue 600 feet, more or less. (h) COLE COURT: From the east edge of the proposed pave- ment on Oswalt Street to the east end of Cole Court, 225 linear feet more or less. (i) KUMQUAT STREET: From the north edge of existing pave- ment on Pecan Street to the South edge of existing pavement on Pier Street, 380 linear feet, more or less. (k) MAPLE AVENUE: From the North edge of existing pavement on Gayfer Street to the South edge of proposed pavement on Live Oak Street 630 linear feet, more or less. (1) LIVE OAK STREET: From the east edge of proposed pavement on Maple Avenue to the west edge of existing pavement on Greeno Road, 320 linear feet, more or less. (m) MARCAI BANE; From the west edge of existing pavement on Blue Island Avenue to the end of the cul-de-sac, 475 Linear feet, more or less. (n) MYRTLE AVENUE: From the north edge of existing pavement on Myrtle Avenue in Park Terrace Subdivision, Unit 1, to the north boundary of Park Teerace Subdivision, Unit 4, 750 linear feet, more or less. (a) HOLLEY DRIVE: From the South edge of proposed pavement Olive Drive in Park Terr?ce Subdivision, Unit 4 to the west edge of existing pavement on Nor th Ingleside Avenue, 1,200 linear feet, more or less. (p) OLIVE DRIVE: From the east edge of proposed pavement on Myrtle Avenue in Park Terrace Subdivision, Unit 4 to the west edge of existing pavement on North Ingleside Avenue, 1,000 linear feet more or less. Improvements to the hereinabove described streets shall be as follows: Both edges of a 25 foot roadway, the centerline of which shall be be approximately in the center of the dedicated right of way shall be curbed and guttered with Portland cement concrete combined curb and gutter 6 inches thick and 2.5 feet wide; the curb lines of said gutters shall be connected with the curb lines of all intersecting streets, with Portland cement concrete combined curb and gutter as above described , of suitable radius and the surface between the gutters to be constructed shall be improved by paving with Bituminus plant mix 1 1/2 inches thick on a 6 inch compacted sand clay founda- tion; said improvement shall include grading and all necessary drain- age structures, including concrete culverts, concrete pipe, valley gutters and drop inlets; manholes of brick with cast iron covers shal be constructed or reconstructed cohere needed. SECTION 4. As hereinabove modified and amended, Improvement Ordinance No. 439 entitled "AN ORDINANCE TO PROVIDE FOR -CERTAIN IMPROVEMENTS ON SIMON STREET, PAT11Y.NN DRIVE, WOODLAND COURT, EVER- GREEN STREET, NORTH INGLESIDE AVENUE, FORSTER AVENUE, OSWALT STREET, COLE COURT, KUMQUAT STREET, LAUREL STREET, MAPLE AVENUE, LIVE OAK STREET, MARCA LANE, MYRTLE AVENUE, HOLLY DRIVE, is hereby in all things ratified and confirmed.
