POSTED 6-28-12 STATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council met in a Public Participation/Work Session at 4:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 9 July 2012. Present were Council President Lonnie L. Mixon , Councilmembers: Debbie W. Quinn, Daniel Stankoski, Michael A. Ford , and Rick Kingrea, and City Clerk Lisa A . Hanks . Mayor Timothy M. Kant and City Attorney Marion E. Wynne were absent. Council President Mixon called the meeting to order at 4:30 p .m . The following topics were discussed: • Karen Mullins , Chairman for the Education Advisory Committee ("EAC "), addressed the City Council and introduced the members of the committee. A Power Point Presentation titled "Enhancing Education Together" was given by the committee along with other reports by members of the EAC. The overall consensus was we need to step up and do what is necessary for our children; our schools need our community 's help; and it was mentioned that a letter from the EAC was sent to Mayor Kant requesting to ear mark $750,000 for 10 teacher units (2 units per school). Councilmember Stankoski commented this is an awesome group. He said we take our most precious commodity and drop off at the schools . We trust them with this precious commodity. He thanked the committee for all of their work. Council President Mixon read a statement from Councilmember Kingrea . He also thanked the committee and explained the process for their request. The goal was to have the best schools that could be. He said the problems have been identified and we now need to decide how we could help . The funds left over in the Budget would be decided by the City Council how they wish to spend excess funds . Councilmember Quinn said there will be approximately 200 kids in the band this year with one teacher. Eighty two percent of our kids graduated from Fairhope High School compared to eighty eight percent graduating from Daphne High School and Spanish Fort High School. She said it is worse than what she thought ; and thanked the committee for their work . Councilmember Ford thanked the committee and said we need to put more thought into this and possibly rearrange priorities. .. Work Session Monday, 9 July 2012 Page-2- Mayor Kant stated that the major concern is technology and the committee came up with teachers ; and questioned could it be both. Several citizens spoke in support of the request and requested the $750,000 be allocated up front for the budget process. • The tattoo parlor was mentioned by Council President Mixon and asked Mayor Kant to explain the proposed ordinance. Mayor Kant stated that Rick Kingrea called a meeting with staff and some of the residents to discuss this issue. Mayor Kant said the issue is not allowing a tattoo parlor, but the land use . He said it is prudent to make hours of operation, where these businesses should be located; and a moratorium would allow rules to be in place. Council President Mixon stated this is a Planning Commission item regarding zoning and should come from them. City Attorney Wynne said this ordinance refers to business licenses and to siting of business which is part of the Zoning Ordinance . He said amendments to the Zoning Ordinance come through the Planning Commission. Kevin Black, owner of the business , addressed the City Council and said "first and foremost , I am an artist." He said tattoo art is his chosen medium. It is a legitimate form of expression. Mr. Black explained the process he went through and then declined the business license . He has already been the Board of Adjustments & Appeals and the decision was put on hold. He asked the City Council to grandfather his business in if they decided to go forward with the ordinance . There being no further business to come before the City Council , the meeting was duly adjourned at 5:54 p.m. ~~ City Clerk
