COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session at
6:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 28 October 2019.
Present were Council President Jack Burrell, Councilmembers: Jay Robinson,
Jimmy Conyers, Robert Brown, and Kevin Boone, City Attorney Marcus E.
McDowell, and City Clerk Lisa A. Hanks. Mayor Karin Wilson was absent.
There being a quorum present, Council President Burrell called the meeting to
order at 6:08 p.m. The invocation was given by Jason Garcia, Media Pastor of
Celebration Church, and the Pledge of Allegiance was recited.
Council President Burrell stated there was a need to add on an agenda item
after Agenda Item Number 23: a resolution that the City Council of Fairhope desires
to follow the State of Alabama requirements regarding the State Bid Law, and in
particular, the advertising requirements for the estimated value of the desired project
to be bid. The bids received for the Side Stream Wastewater Storage Vessels were
well above the anticipated estimate for the project and in excess of the advertising
protocols that require statewide advertising notification of the bid, which could have
attracted other bidders for this work; and the City Council, therefore, rejects the bids
received for this work and directs staff to solicit new, properly advertised bids for the
desired Side Stream Storage project; and to amend Agenda Item Number 19 by
adding the following after for a Total amount of $2,650,000.00: "and hereby
authorizes the Council President, on behalf of the City of Fairhope, to purchase the
property listed above; and to execute all documents necessary to complete the closing
and to acquire title to the property."
Councilmember Conyers moved to add on the above-mentioned item not on
the printed agenda. Seconded by Councilmember Boone, motion passed unanimously
by voice vote.
Councilmember Conyers moved to approve minutes of the 7 October 2019
special budget work session; minutes of the 9 October 2019, regular meeting;
minutes of the 9 October 2019, work session; and minutes of the 9 October 2019,
agenda meeting. Seconded by Councilmember Robinson, motion passed unanimously
by voice vote.
