HomeMy WebLinkAbout02-10-2014 City Council Meeting MinutesSTATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 6:00p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 10 February 2014. 6416 Present were Council President Jack Burrell, Councilmembers: Rich Mueller, Diana Brewer, Michael A. Ford (arrived at 6:16 p.m.), and Kevin Boone, Mayor Timothy M. Kant, City Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks. There being a quorum present, Council President Burrell called the meeting to order. The invocation was given by Reverend Ryan Cramer, Pastor of St. Paul's Lutheran Church, and the Pledge of Allegiance was recited. Councilmember Brewer moved to approve minutes ofthe 23 January 2014, regular meeting; minutes ofthe 23 January 2014, work session; and minutes of the 23 January 2014, agenda meeting. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. Mayor Kant addressed the City Council regarding the following items: 1) All City employees were thanked for their dedication through the ice storm. 2) Holley MacKeller is his appointment for the Planning Commission. 3) AHEPA finally received the van today and residents said thank you. 4) Arbor Day is this Saturday and begins at 10:00 a.m. Jennifer Fidler, Public Works Director, said the poster contest winners and the treasured trees would be announced; and there will be a tree give away. 5) The Haven will have their dog parade on Sunday, February 23, 2014 at 2:30p.m. 6) Movie was shot in town and merchants were complaining. Staff will look at the pros and cons, then come back with an ordinance to set rules for these events. Colleen Martin and Jill Everson, co-chairs for the Spring Fever Chase, addressed the City Council regarding Agenda Item No.5, a resolution to authorizing Mayor Kant to execute a contract between the City of Fairhope and Thomas Hospital for use of the City facilities, including streets and parks, depending on availability and permission from the Rental Facilities Manager to help put on health related programs, meetings, and programs affiliated with Thomas Hospital. They both thanked the City for its support and stated this was the 36th annual spring fever chase. 6417 10 February 2014 Councilmember Brewer addressed the City Council regarding the Education Advisory Committee who just recently bumped up its membership from six to nine members. She said Wednesday the EAC will meet to review applications and hopefully make an appointment at the next City Council meeting. Council President Btirrell addressed the City Council and stated he was at the Alabama League of Municipalities last week and mentioned the intersection of Fairhope Avenue and Highway 181. He also mentioned the planters to be placed on Greeno Road. He stated we need to involve COPA in the public arts and we need to meet with Mr. Swanzy to look at the possibility of art in the round abouts. He said that Councilmember Brewer said that we need more marketing of the City of Fairhope. Council President Burrell also brought up the films in downtown and found out the City closed streets from citizens. Council President Burrell said he received a telephone call from the Fairhope Pirates Booster regarding "Pirate Nation" live. The provider for online broadcasting will be chosen by the Alabama High School Association. They will hire the people to film and then charge a fee for viewing. We need to alert our State representatives that this is wrong. Councilmember Brewer introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing Mayor Kant to execute a contract between the City of Fairhope and Thomas Hospital for use of the City facilities, including streets and parks, depending on availability and permission from the Rental Facilities Manager to help put on health related programs, meetings, and programs affiliated with Thomas Hospital, throughout the year in the Fairhope community, schools or at the hospital facilities. Seconded by Councilmember Boone, motion passed unanimously by voice vote. * * * 6418 10 February 2014 RESOLUTION NO. 2175-14 WHEREAS, Thomas Hospital serves a public purpose and the health education that the Thomas Hospital gives the City of Fairhope is a public service; and, WHEREAS, We, Thomas Hospital, agree to work with the Mayor, and /or his agent(s), to promote the City of Fairhope and to contribute time, employees, and other resources putting on health related programs, meetings and programs affiliated with Thomas Hospital, throughout the year in the Fairhope community, schools or at the hospital facilities. Many events, schools, and Fairhope programs are sponsored by Thomas Hospital. The Thomas Hospital Auxiliary provides hours of service to the hospital that benefit Fairhope citizens; and BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to execute contract between the City of Fairhope and Thomas Hospital for use of the City facilities (rental and cleaning fees), including streets and parks, depending on availability and permission from the Rental Facilities Manager; but they would be responsible for any incidentals, damages, or security if necessary. Seconded by Councilmember Brewer, motion passed unanimously by voice vote. 6419 10 February 2014 Councilmember Ford addressed the City Council and apologized for being late. RESOLUTION NO. 2176-14 WHEREAS , the City of Fairhope , Alabama, has certain items of personal property which are no longer needed for public or municipal purposes; and WHEREAS , Section 11-43-56 of the Code of Alabama of 1975 authorizes the municipal governing body to dispose of unneeded personal property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FAIRHOPE, ALABAMA, AS FOLLOWS: SECTION 1. That the following personal property owned by the City of Fairhope, Alabama, is not needed for public or municipal purposes, and hereby declared surplus : [SEE ATTACHED LIST OF EQUIPMENT] SECTION 2. That the Mayor and City Treasurer are hereby authorized and directed to dispose of the personal property owned by the City of Fairhope , Alabama, described in Section 1, above , by receiving bids for such property. All such property shall be sold to the highest bidder, provided , however, that the City Council shall have the authority to reject all bids when , in its opinion , it deems the bids to be less than adequate consideration for the personal property. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. 6421 10 February 2014 RESOLUTION NO. 2177-14 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope did request, receive, and open bids for Sludge Removal Services for the Waste Water Treatment Plant (Bid Number 005-14) at 555 South Section Street in the City of Fairhope offices, Fairhope, Alabama. [2] At the appointed time and place, the following bids were opened and tabulated as follows: Please see attached Bid Tabulation for Sludge Removal Services for the Waste Water Treatment Plant [3] After evaluating the bid proposals with the required bid specifications, Green South Solutions LLC, with the total bid proposal of $85.00 per cubic yard, is now awarded the bid for Sludge Removal Services for the Waste Water Treatment Plant. Seconded by Councilmember Ford, motion passed unanimously by voice vote. 6423 10 February 2014 RESOLUTION NO. 2178-14 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope has voted to purchase Cell Phone Devices and Service for the Police Department and the type of equipment needed is on the Alabama State Department of Purchasing bid list and therefore does not have to be let out for bid; and [2] The following 1s the Alabama State Department of Purchasing contract information: Bid Number: T-301 Annual Cost for Equipment/Service (3 Smartphones and 35 Mifi Devices) Contract Number: 40111 01 $ 19,063.80 Adopted on this lOth day ofFebruary, 2014 Attest: ~:.~ City Clerk Councilmember Brewer introduced in writing, and moved for the adoption of the following resolution, a resolution to purchase annual servicing and NFPA 1911 Inspections of Fire Trucks from Sunbelt Fire, Inc., as Sole Source Distributor and Service Provider for E-One products and Hale Pumps for our region, with a cost of $21,964.76. Seconded by Councilmember Boone, motion passed unanimously by voice vote. 6424 10 February 2014 RESOLUTION NO. 2179-14 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope has voted to purchase Annual Servicing and NFPA 1911 Inspections of Fire Trucks for the City Fire Stations from Sunbelt Fire, Inc., as Sole Source Distributor and Service Provider for E-One products and Hale Pumps for our region; and authorizes procurement based on the option allowed by the Code of Alabama 197 5, Section 41-16-51 ( 13): "Contractual services and purchases of commodities for which there is only one vendor or supplier and contractual services and purchases of personal property which by their very nature are impossible to award by competitive bidding." The cost will be $21,964.76 which includes $11,294.76 for Servicing and $10,670.00 for Inspections. Adopted on this lOth day of February, 2014 Attest: City Council reviewed an application for a Non-Profit Tax Exempt License (Alcoholic Beverage License) by Teddy J. Faust, Jr. for Fairhope Sunset Rotary Club Charity, Inc., for the Fairhope Barbecue and Brew located on the North West comer of Greeno Road and Volanta Avenue, Fairhope, Alabama on March 8, 2014 from 10:00 a.m. to 5:00p.m. Councilmember Brewer moved to approve the issuance of the license. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. 6425 10 February 2014 Councilmember Mueller moved to appoint Colonel Scherry Douglas to the Personnel Board for a 5 year term. The term will expire in February 2019. Seconded by Councilmember Brewer, motion passed unanimously by voice vote. Paul Ripp, 22985 High Ridge Road, addressed the City Council regarding his handout and questioned transparency. He mentioned a piece of property will take away an opportunity for the City. He also questioned accountability, BP issues, and once again brought up a letter and the Mayor's signature. Mayor Kant replied yes that is my signature and this was already answered in a Power Point Presentation previously presented to the City Council. Councilmember Ford asked Mr. Ripp, "Do you have anything good to say! You are the only one who said our purchase of the Dyas property was not good and against the purchase." Councilmember Boone said "you are the only one who sees that; and you said we are going to be indicted." Council President Burrell said the merit raises were included in the salary totals; the Utility Fund being reduced by $3.0 million was not accurate and the money used was from an account with several accounts; paying off the GOW 2009 saved the City $315 ,000; and we will pay back the $5.7 million plus another $2.5 or $2.6 million back in our Treasury. Councilmember Boone moved to adjourn the meeting. Seconded by Councilmember Brewer, motion passed unanimously by voice vote.
