The City Council , City of Fairhope, met in regular session at
6:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope , Alabama 36532, on
Monday, 14 April2014.

Present were Council President Jack Burrell, Councilmembers: Rich Mueller,
Diana Brewer, Michael A. Ford, and Kevin Boone, Mayor Timothy M. Kant, City
Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks.
There being a quorum present, Council President Burrell called the meeting to
order. The invocation was given by Councilmember Boone and the Pledge of
Allegiance was recited.
Council President Burrell stated there was a need to add an agenda item after
Agenda Item Number 23; a motion for Mayor Kant to send a Letter of Support from
the City of Fairhope to the Alabama Department of Transportation endorsing an
important project to greatly improve transportation mobility, safety, security, and
efficiency along the I-10 and I-65 corridor through Mobile and Baldwin Counties in
Southwest Alabama.
Councilmember Brewer moved to add on the above mentioned item not on
the printed agenda. Seconded by Councilmember Ford , motion passed unanimously
by voice vote .
Council President Burrell stated there was another item needing to be added to
the agenda; a resolution authorizing Mayor Kant to negotiate and execute an
agreement for Professional Services with Scott Douglass , a Civil Engineer with South
Coast Engineers, LLC to investigate and propose solutions to the Mobile Bay beach
erosion from the boat ramp at Pier Street south to Pecan Street.
Councilmember Brewer moved to add on the above mentioned item not on
the printed agenda. Seconded by Councilmember Boone, motion passed unanimously
by voice vote.
Councilmember Brewer moved to approve minutes of the 24 March 2014,
regular meeting; minutes of the 24 March 2014, work session; and minutes of the 24
March 2014, agenda meeting. Seconded by Councilmember Mueller, motion passed
unanimously by voice vote.

Mayor Kant addressed the City Council and requested Sherry Sullivan,
Community Affairs and Recreation Director, to make some announcements. Ms.
Sullivan announced that the City of Fairhope's employees participated in Scale Back
Alabama which is a State-wide campaign (weight loss program). There were
approximately 10 to 12 teams from the City; and the winning team consisted of
Johnny Bozeman, Rickey Ward, Austin Waldrop, and Chris Smith who lost a total of
67 pounds; and a total of 422 pounds City-wide. She announced Earth Day on April
19, 2014 from 10:00 a.m. until 7:00p.m.; and there will be a Sunrise Service Sunday
morning at the Rose Garden hosted by the Optimist Club.
Councilmember Ford addressed the City Council and announced the Satsuma
Blossom Festival will be held on April 26, 2014 from 9:00 a.m. to 5:00 p.m. at the
Fairhope Museum of History.
Chief Petties addressed the City Council and recognized the Fairhope
Dispatchers and announced National Public Service Telecommunicators Week is
Sunday, April13, 2014 through Saturday, April19, 2014.
Rod Platt, Fairhope Airport Authority, addressed the City Council and
announced the Advantage Site Designation for the Airport. Lee Lawson with the
Baldwin County Economic Development Alliance stated the Airport met the initial
Criteria for this designation. The Economic Development Partnership of Alabama
administers the Advantage Site Program. City staff and the Fairhope Airport
Authority went through the process to obtain this designation. The guarantee as a
body is due diligence for this site to be at the utmost prepared level. He thanked the
City for their support. Sean Lytle with the Economic Development Partnership of
Alabama presented the Fairhope Airport Authority the designation of the Fairhope
Industrial Park as an Advantage Site in the State of Alabama. Mr. Lytle said there are
over 400 sites in Alabama with Fairhope's site being the 48th Advantage Site
Designation; and the 5th Advantage Site in Baldwin County. Five organizations
work hard to promote this program and designation in Alabama.
Rod Platt addressed the City Council regarding the March 8, 2014 plane crash
at the H. L. "Sonny" Callahan Airport. Mr. Roger "Shad" James was the pilot in the
crash who survived with the help of four first responders and the Fairhope Volunteer
Fire Department. Mr. James was in attendance for this special event. Certificates of
Appreciation were presented to Tim Pettis, Michael Munday, Richard Snarr, and
Robert Tremble who were the first people on the scene of the accident. Chief Ellis of
the Fairhope Volunteer Fire Department introduced the firemen who also responded
to the accident. Mayor Kant mentioned Mr. James and asked for everyone to keep
him in their prayers. He also thanked the Fairhope Airport Authority.

Council President Burrell stated on behalf of the City Council we thank you . He also
announced that Joseph Tarabella, with Troop 47 , is in the audience tonight working
on a merit badge .
A Public Hearing was held as advertised on a proposed ordinance to amend
the Zoning Ordinance No . 1253. Councilmember Ford introduced in writing an
ordinance to amend Article III Zoning Districts , Section B. Allowed Uses; Table 3-1:
Use Table to show Hotel/Motel as an allowed use permitted only on appeal and
subject to special conditions in the B-2 General Business zoning district. The
Planning Commission gave a favorable recommendation of this ordinance.
Council President Burrell read the proposed ordinance. Planning Director Jonathan
Smith briefly explained the proposed ordinance .
Council President Burrell opened the Public Hearing at 6:29 p.m. No one present
opposed the proposed ordinance , the Public Hearing closed at 6:29p.m.
Due to lack of a motion for immediate consideration, this ordinance will layover until
the April 28 , 2014 City Council meeting.
Councilmember Boone moved for final adoption of Ordinance No. 1509, an
ordinance to Amend Zoning Ordinance No. 1253 , Article III Zoning Districts, Section
B. Allowed Uses; Table 3-1: Use Table to show Multiple-Family/Apartment as an
allowed use permitted only on appeal and subject to special conditions in the B-3a
Tourist Resort Lodging and B-3b Tourist Resort Commercial Service zoning district.
(Introduced at the March 24 , 2014 City Council meeting) Seconded by
Councilmember Brewer, motion for final adoption passed by the following voice
votes: AYE-Burrell, Mueller, Brewer, Ford , and Boone. NAY-None.
Council President Burrell asked Paul Myrick, attorney with The Kullman
Firm who helps with personnel issues , to explain the ordinance. He said that Mr.
Myrick, Lisa Hanks , Pandora Heathcoe along with the Mayor, City Council , and
Personnel Board have been working on this handbook for months.
Mr. Myrick addressed the City Council and explained the main changes to the
proposed Personnel Handbook. He said that there have been changes at the Federal
and State level ; and there also have been resolutions and ordinances adopted that
supersede this handbook which have been incorporated into the new handbook. Mr.
Myrick said that City Clerk Lisa Hanks and Human Resources Director Pandora have
done yeoman work as well as the Personnel Board.

Councilmember Brewer introduced in wntmg Ordinance No . 1510, an
ordinance to Provide _Personnel Rules stating the City 's Employment Rules, Policies
and Procedures , and Generally Describe Employment Benefits, for the City of
Fairhope by Repealing Ordinance No . 1255 adopted June 27 , 2005. In order to take
immediate action, Councilmember Boone moved for immediate consideration.
Seconded by Councilmember Brewer, motion for immediate consideration passed
unanimously by the following voice votes: AYE -Burrell , Mueller, Brewer, Ford ,
and Boone. NAY -None. Councilmember Boone then moved for final adoption of
Ordinance No. 1510. Seconded by Councilmember Brewer, motion for final adoption
passed by the following voice votes: AYE -Burrell , Mueller, Brewer, Ford , and
Boone . NAY -None.
Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing Mayor Kant to execute the
Agreement with the Baldwin County Board of Education regarding the City 's
donation of $242 ,200 .00 to the Board for use by Fairhope Public Schools; and used
strictly in conformance with the "Approved List" recommended by the Fairhope
Advisory Committee. Seconded by Councilmember Boone, motion passed
unanimously by voice vote.
RESOLUTION NO. 2204-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to
execute the Agreement with the Baldwin County Board of Education regarding the
City 's donation of $242 ,220.00 to the Board for use in the following schools:
Fairhope Elementary, Fairhope Intermediate , Fairhope Middle , Fairhope High and J.
Larry Newton. The donated funds are to be used strictly in conformance with the
Fairhope Education Advisory Committee 's "Approved List" and the Agreement.

Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution that certain items are declared surplus and the
Mayor and City Treasurer are hereby authorized and directed to dispose of personal
property owned by the City of Fairhope by receiving bids and being sold to the
highest bidder. Seconded by Councilmember Boone, motion passed unanimously by
voice vote.
RESOLUTION NO. 2205-14
WHEREAS , the City of Fairhope , Alabama, has certain items of personal property
which are no longer needed for public or municipal purposes ; and
WHEREAS, Section 11-43-56 of the Code of Alabama of 1975 authorizes the
municipal governing body to dispose of unneeded personal property;
NOW , THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
FAIRHOPE , ALABAMA , AS FOLLOWS:
SECTION 1. That the following personal property owned by the City of Fairhope,
Alabama, is not needed for public or municipal purposes , and hereby declared
surplus:
[SEE ATTACHED LIST OF EQUIPMENT]
SECTION 2. That the Mayor and City Treasurer are hereby authorized and directed
to dispose of the personal property owned by the City of Fairhope , Alabama,
described in Section 1, above , by receiving bids for such property. All such property
shall be sold to the highest bidder, provided , however, that the City Council shall
have the authority to reject all bids when , in its opinion , it deems the bids to be less
than adequate consideration for the personal property.

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows :
[1] That the City o f Fairhope did request, receive , and open bids for
Hydrofluorosilicic Acid for the Water Department (Bid Number 014-14) at 555 South
Section Street in the City of Fairhope offices, Fairhope, Alabama.
[2] At the appointed time and place, the following bids were opened and tabulated as
follows:

Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution to Purchase One 1000 KV A 3 PH Pad Mount
Transformer for the Waste Water Treatment Plant off the Alabama State Department
Purchasing Bid list and therefore does not have to be let out for bid with a cost of
$18,493.00. Seconded by Councilmember Boone , motion passed unanimously by
voice vote .
RESOLUTION NO. 2207-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
[1] That the City of Fairhope has voted to purchase one 1000 KV A 3 PH Pad Mount
Transformer for the Waste Water Treatment Plant ; and must be compatible with our
existing system and authorizes procurement without formal bid based on the option
allowed by the Code of Alabama 1975 , Section 41-16-5l(b)(7)) to obtain informal
quotes and purchase the Pad Mount Transformer. The cost will be $18 ,493.00.

the following resolution, a resolution to Purchase Components for the Server System

RESOLUTION NO. 2208-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
[1] That the City of Fairhope has voted to purchase Components for the Server
System Upgrade 2014 Project for the Information Technology Department and the
requested items are available for direct procurement through the National
Intergovernmental Purchasing Alliance ("National IPA") Technology Solution
Contract No. 130733; the State of Alabama Contract No. T600; and the U. S.
Communities Master Agreement No. MA-IS-104022. Therefore, these do not have to
be let out for bid. The cost of the server equipment is $15,540.30.

RESOLUTION NO. 2209-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
That the City of Fairhope has voted to purchase a Fixed Permanent Backup Power
Generator, an Automatic Transfer Switch and associated Equipment for the Electric
Department to be used at the City Services/Public Utilities Building; and the
requested items are available for direct procurement through the National
Intergovernmental Purchasing Alliance. The cost will be approximately $71,057.70.

RESOLUTION NO. 2210-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
[1] That the City of Fairhope did request, receive, and open bids for Police SUVs
2014 for the Police Department (Bid Number 017-14) at 555 South Section Street in
the City of Fairhope offices, Fairhope, Alabama.
[2] At the appointed time and place, the following bids were opened and tabulated as
follows:

Montgomery CH, LLC d/b/a Capitol Chevrolet and Imports, with the total bid

the following resolution, a resolution that the City Council hereby amends Resolution
No. 2183-14 to increase the membership of the Knoll Park Committee from nine
members to a total of ten members. Seconded by Councilmember Ford, motion

RESOLUTION NO. 2211-14
Pursuant to Resolution No. 2183-14, adopted by the City Council on February 24, 2014, the
Knoll Park Committee was established as a sub-committee of the Fairhope Environmental
Advisory Board consisting of nine members; and
WHEREAS, the City Council is desirous to amend Resolution No. 2183-14 by increasing the
Knoll Park Committee membership from nine members to a total of ten members.
NOW THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE
CITY OF FAIRHOPE, ALABAMA, that the City Council hereby amends Resolution No.
2183-14 to increase the membership of the Knoll Park Committee from nine members to a
total of ten members.

Councilmember Boone moved to appoint John Pate, David Dyson, Connie
Flowers, Sarah Tees, and John Nelson to the Fairhope Environmental Advisory
Board's sub-committee called the "Knoll Park Committee" for a two-year term.
Seconded by Councilmember Ford, motion passed unanimously by voice vote.
Councilmember Mueller moved to approve the recommendation of the Street
and Traffic Control Committee for the following item:
•!• Requesting from the City Council authorization to upgrade the signage along the Eastern
Shore Trail in the City of Fairhope; and that The Baldwin County Trailblazers along with
City staff will place approximately 18 signs to adequately mark the trail.
Seconded by Councilmember Brewer, motion passed unanimously by voice vote.
Councilmember Brewer moved to grant the request Erin Hendricks, Fairhope
Public Library Foundation, requesting permission to hold the Annual "Hoot Scoot"
5K Race and 1-mile Fun Run on April 25, 2014 from 6:30p.m. to 8:00p.m.; use of
streets; use of library perimeter and green space lawn behind library; and approval to
allow alcohol on City property. Seconded by Councilmember Boone, motion passed
unanimously by voice vote.

Councilmember Brewer moved to grant the request Brian Moore, Juvenile
Diabetes Research Foundation, requesting permission to close Beach Drive and North
Beach Road on Saturday, May 17, 2014 from 8:45a.m. to 10:00 a.m. for a Charity
Walk; and use of South End Park, Duck Pond, and North Beach Road. Seconded by
Councilmember Mueller, motion passed unanimously by voice vote.
Councilmember Brewer moved to grant the request Marcus Bowman, Good
Life Foundation, requesting permission to hold the 4th Annual Kids Triathlon on
Sunday, June 1, 2014 and use of South Beach Park, Bay BluffHill, S. Mobile Street,
N. Beach Road to Duck Pond (approximately one hour) as well as use of barricades
and cones. Seconded by Councilmember Ford, motion passed unanimously by voice
vote.
Councilmember Brewer moved to grant the request Will Carlton, Fairhope
Rotary Club Foundation, approval of Tenth Annual Steak Cook Off on May 9, 2014
for street closure at 5:00p.m. on South Bancroft from Fairhope Avenue to Morphy;
and approval to allow alcohol on City streets. Also, approval of closing one half of
Bancroft Street (the east lane) at 3:00 p.m. Seconded by Councilmember Mueller,
motion passed by the following voice votes: AYE -Burrell, Mueller, Brewer, and
Boone. NAY-None. ABSTAIN-Ford.
City Council reviewed an application for a Non-Profit Tax Exempt
License by The Fairhope Rotary Club Foundation, by Will D. Carlton, for the Tenth
Annual Steak Cook-Off on May 9, 2014 on South Bancroft from Fairhope Avenue to
Morphy; and at 161 North Section in case of a rain out. Councilmember Mueller
moved to approve the issuance of the license. Seconded by Councilmember Brewer,
motion passed by the following voice votes: AYE -Burrell, Mueller, Brewer, and
Boone. NAY-None. ABSTAIN-Ford.
Councilmember Brewer moved for Mayor Timothy M. Kant to send a Letter
of Support from the City of Fairhope to the Alabama Department of Transportation
(ALDOT) endorsing an important project to greatly improve transportation mobility,
safety, security, and efficiency along the I-10 and I-65 corridor through Mobile and
Baldwin Counties in Southwest Alabama. Seconded by Councilmember Boone,
motion passed unanimously by voice vote.

Councilmember Boone introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing Mayor Timothy M. Kant to
negotiate and execute an Agreement for Professional Engineering Services with Scott
Douglass, a Civil Engineer with South Coast Engineers, LLC to investigate and
propose solutions to the Mobile Bay beach erosion from the boat ramp at Pier Street
south to Pecan Street. Seconded by Councilmember Brewer, motion passed
unanimously by voice vote .
RESOLUTION NO. 2212-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to
negotiate and execute an Agreement for Professional Engineering Services with Scott
Douglass, a Civil Engineer with South Coast Engineers , LLC to investigate and
propose solutions to the Mobile Bay beach erosion from the boat ramp at Pier Street
south to Pecan Street.

Edward Wolf, 303 Perdido Avenue, addressed the City Council regarding the
proposals for Pier Street. He questioned the work to be done and the engineer to be
used. Mr. Wolf said issues need to be addressed and there are ways to correct without
a permit.
Jamal Finkley addressed the City Council and introduced himself as the new
Pastor for Twin Beech AME Zion Church.

Councilmember Brewer moved to adjourn the meeting. Seconded by
Councilmember Mueller, motion passed unanimously by voice vote .
Councilmember Brewer congratulated Mayor Kant and Councilmember Ford
for being on the winning team for the Mayor 's Golf Tournament.
There being no further business to come before the City Council , the meeting
was duly adjourned at 7:02p.m.
