The City Council, City of Fairhope, met in regular session at
6:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope , Alabama 36532 , on
Tuesday, 27 May 2014 .

Present were Council President Jack Burrell , Councilmembers: Rich Mueller,
Diana Brewer, Michael A. Ford, and Kevin Boone (arrived at 6:14 p.m.), Mayor
Timothy M. Kant , City Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks.
There being a quorum present, Council President Burrell called the meeting to
order. The invocation was given by Deacon George Y eend, of St. Lawrence Catholic
Church, and the Pledge of Allegiance was recited. Councilmember Brewer moved to
approve minutes of the 12 May 2014 , regular meeting ; minutes of the12 May 2014 ,
work session ; and minutes of the 12 May 2014 , agenda meeting. Seconded by
Councilmember Mueller, motion passed unanimously by voice vote.
Mayor Kant addressed the City Council and said the FEMA representatives ,
Jennifer Fidler, and John Saraceno are preparing a list of damages to the City of
Fairhope. He mentioned that they have already allocated $3.0 million for SBA loans;
and FEMA is looking at damages for vehicles and homes. Mayor Kant said the worse
damage for the City is near the Sewer Plant; and NRCS should fund at least 75% of
the repairs with a 25% match by the City.
Councilmember Ford addressed the City Council and announced the Knoll
Park Committee will be meeting within the next two weeks.
Council President Burrell addressed the City Council and stated a Special
Called City Council meeting may be held in the next few days. He requested
information on the pier restrooms. Ms . Fidler replied that Roberds has looked at the
restrooms and presented a budget which was well over the City's budgeted amount.
She requested for him to submit a new budget.
Councilmember Ford addressed the City Council and asked for the status of
paving in White Grove Subdivision. Mayor Kant replied the last Council approved
$1.2 million for paving and not any other streets would be paved. We should have a
list of streets by the end of this year.

A Public Hearing was held as advertised on a proposed ordinance to amend
Zoning Ordinance No. 1253. Councilmember Brewer introduced in writing
Ordinance No. 1514, an ordinance to amend the Planned Unit Development (PUD)
for Stone Creek (Ordinance No. 1238); the property of Chapel Farm, LLC. This
property is located on the east of State Highway 181 just south of the intersection of
County Road 44 (alk/a Twin Beech Road) and Highway 181, Fairhope, Alabama.
Parcel Contains 177.20 acres more or less. 46-07-26-0-000-002.003. The Planning
Commission gave a favorable recommendation of this ordinance.
Council President Burrell read the proposed ordinance. Planning Director Jonathan
Smith briefly explained the proposed ordinance.
Council President Burrell opened the Public Hearing at 6:15 p.m.
1) John Carrington, 210 Wentworth in Stone Creek, addressed the City Council
and requested that this ordinance be postponed until more information could be
obtained regarding the new site plan. He was not opposed to the zoning from
commercial property to residential, but wanted more information.
2) John Avent from Preble-Rish addressed the City Council on behalf of Chapel
Farm, LLC. He stated that the tract of property in question is commercial. The
owners received plans from ALDOT that would take an additional 20 feet of this
property making it no longer suitable as commercial. The concern with the
landscaping has been corrected with the new landscape design.
Council President Burrell questioned why Carrington was against the rezone
request. Mr. Carrington replied that he lives across the street from where this is
happening and wants to see more of what is being proposed.
3) Rance Reehl with Stone Creek, LLC addressed the City Council and stated he
had shared the plans with the Carringtons. He said we tried to layout something
that was compatible with the other homeowners. Mayor Kant questioned the last
lot and the landscape plan; and the size of the commercial lots . Mr. Reehl said the
four commercial lots are approximately 300' x 400'; and ALDOT's right-of-ways
would force egress and ingress on Wentworth.
4) Steve Brookshire, 240 Wentworth, who is President of Stone Creek
Homeowner's Association, addressed the City Council and stated they were told the
subdivision would be brought back 90 lots; assured aesthetics would be addressed.
He said this is a good thing for the neighborhood.
No one present opposed the proposed ordinance, the Public Hearing closed at 6:35
p.m.
In order to take immediate action, Councilmember Brewer moved for immediate
consideration. The motion was seconded by Councilmember Mueller.

Councilmember Ford questioned greenspace. Jonathan Smith said the original
Wentworth you would be seeing office space and parking spaces. Staff
recommended the change which keeps the village component still in place. After
further discussion, motion for immediate consideration passed unanimously by the
following voice votes: AYE -Burrell, Mueller, Brewer, Ford, and Boone. NAY -
None. Councilmember Brewer then moved for final adoption of Ordinance No. 1514.
Seconded by Councilmember Boone, motion for final adoption passed by the
following voice votes: AYE -Burrell, Mueller, Brewer, Ford, and Boone. NAY -
None.
Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution to Award bid for Pecan A venue Building
HV AC Renovations (Bid Number 006-14) with bid proposal in the amount of
$49,998.00. Seconded by Councilmember Mueller, motion passed unanimously by
voice vote.
RESOLUTION NO. 2221-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
[ 1] That the City of Fairhope did request, receive, and open bids for Pecan A venue Building
HV AC Renovations (Bid Number 006-14) at 555 South Section Street in the City of Fairhope
offices, Fairhope, Alabama.
[2] At the appointed time and place, the following bids were opened and tabulated as follows:

Pecan Avenue Building HV AC Renovations
[3] After evaluating the bid proposals with the required bid specifications, D & D Quality
Services, LLC, in the amount of $49,998.00, is now awarded the bid for Pecan Avenue
Building HV AC Renovations.

Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing Mayor Timothy M. Kant to execute a
Nonexclusive Underground Utility Easement between the City of Fairhope and Sam W. Irby
as Trustee of the Sam W. lrby Revocable Trust to construct, maintain, repair or replace
underground utility lines and utility services . Seconded by Councilmember Mueller,
motion passed unanimously by voice vote.
RESOLUTION NO. 2222-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, that Mayor Timothy M. Kant is hereby authorized to execute a
Nonexclusive Underground Utility Easement between the City of Fairhope and Sam
W. Irby as Trustee of the Sam W. Irby Revocable Trust to construct, maintain, repair
or replace underground utility lines and utility services, under the property described
in the easement.

D. Calhoun and Sally D. Megginson to construct, maintain, repair or replace
underground utility lines and utility services , on and under the property described in
the easement.

Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing Mayor Timothy M. Kant to execute
Agreement Number Two with the Baldwin County Board of Education regarding the
City's donation of $81,000.00 to the Board for use by Fairhope Public Schools; and
used strictly in conformance with the "Approved List" recommended by Fairhope
Education Advisory Committee . The motion was seconded by Councilmember
Mueller. Jim Kellen with the Education Advisory Committee addressed the City
Council and briefly explained the recommendations based on the requests from the
three schools for a total of $81 ,000.00 . Council President Burrell requested that the
details for the recommendations to be part of the record ; and questioned when reports
will be presented to the City Council. (The recommendation details are attached at
the end of the minutes) Mr. Kellen replied we have a new vision statement which
should improve all education providers in the City. Councilmember Brewer
questioned if Baldwin County Board of Education had approved the outdoor
classroom being built. Ms . Hall replied they did not have an issue when FEEF
presented a similar project. After further discussion, motion passed unanimously by
voice vote.

RESOLUTION NO. 2224-14
WHEREAS , tre Ci1y has earmarked $350 ,000.00 C'Contribution'') of its 2013-2014
General Operations Budget for the improvement of education in the five schools; and ,
WHEREAS , on March 24 , 2014 the Fairhope City Council accepted the
recommendations of Fairhope 's Education Advisory Committee for use of
$242 ,220.00 in the five schools with the remaining balance pending further review ;
and
WHEREAS , on May 27 , 2014 the Fairhope City Council has now accepted
additional recommendations of Fairhope's Education Advisory Committee for use of
$81 ,000.00 in three of the five schools with a balance of $26 ,780 .00 pending further
review; and
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to
execute Agreement Number Two with the Baldwin County Board of Education
regarding the City 's donation of $81 ,000.00 to the Board for use in the following
schools: Fairhope Elementary , Fairhope Middle , and J . Larry Newton. The donated
funds are to be used strictly in conformance with the Fairhope Education Advisory
Committee 's "Approved List" and the Agreement.

Council President Burrell announced that Agenda Item Number 11, a
resolution adopting the Baldwin County Comprehensive Solid Waste Management
Plan, was pulled; and will be revisited at a later date.
Councilmember Brewer moved to grant the request of Michael Graham ,
Executive Director of The Haven No-Kill Animal Shelter, requesting permission to
block streets for their Mystic Mutt 5K Race, Mutt Strut, and Pet Adoption (Oak,
Bancroft, and Summit Streets); on August 30, 2014 from 7:00 a.m. to 10:00 a.m.
Seconded by Councilmember Boone , motion passed unanimously by voice vote.
Councilmember Brewer moved to adjourn the meeting. Seconded by
Councilmember Boone , motion passed unanimously by voice vote.
There being no further business to come before the City Council, the meeting
was duly adjourned at 6:55 p.m.

1. iPad/MacBook Lock and Charge Carts [$41,000]
Justification

Baldwin County School System is providing iPads and Macs for every child in our
school. However, they are not providing a means for overnight charging, storage and
security. These carts will do all three.
2. Art and Music Programs [Visiting Artists, Materials, Instruments]
[$12,000]
Justification
Again, the research is clear regarding the connection between art/music and school
achievement. Our teachers can/will connect many general math/geometry/language skills
to their art/music programs. Additionally, our proposed programs will allow us to expose
the children to artists with expertise in specialized areas ... drums, strings, woodwinds,
brass, etc.; and water/oil paints , clay/pottery, sketching, etc.
3. Accelerated Reading Subscription [$11,000]
Justification
This computer program is designed to test and track students' comprehension and reading
levels. It allows the teacher to monitor each student's progress and to guide/assist as
needed.
4. Library Books [$6,000]
Justification
Maintaining our Media Center inventory is vital. However, we have not received State
Allocations for library books in 7 years! Previously, we received $225 per teacher unit
OR $8,100 per year. Today , using that same amount [$225], our allocation would be
$17,775; we get nothing!
