The City Council, City of Fairhope, met in regular session at
6:00p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 12 May 2014.

Present were Council President Jack Burrell, Councilmembers: Rich Mueller,
Diana Brewer, Michael A. Ford, and Kevin Boone, Mayor Timothy M. Kant, City
Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks.
Council President Burrell stated there was a need to add an agenda item after
Agenda Item Number 11; a resolution authorizing Mayor Timothy M. Kant to
execute a Contract for Engineering Services for Emergency Repairs from N. Section
Street westward beyond Treatment Plant with Hutchinson, Moore & Rauch, LLC for
RFQ No. PS010-14 with a cost not to exceed $37,000.00.
Councilmember Boone moved to add on the above mentioned item not on the
printed agenda. Seconded by Councilmember Brewer, motion passed unanimously by
voice vote.
There being a quorum present, Council President Burrell called the meeting to
order. The invocation was given by Dr. Jerry Henry, Pastor of First Baptist Church,
and the Pledge of Allegiance was recited. Councilmember Brewer moved to approve
minutes of the 28 April 2014, regular meeting; minutes of the 28 April 2014, work
session; and minutes of the 28 April 2014, agenda meeting. Seconded by
Councilmember Boone, motion passed by the following voice votes: AYE-Mueller,
Brewer, Ford, and Boone. NAY-None. ABSTAIN-Burrell.
Scott Sligh, Electric Superintendent, addressed the City Council and
announced the Fairhope recipients for the AMEA scholarships: Mattie Simmons,
Ashley Jones, and Philip Street. He said that AMEA partners with high schools in
Alabama to award these scholarships and AMEA received 134 applications. Mattie
Simmons was the only recipient in attendance tonight along with her parents Troy
and Lisa Simmons. Mr. Sligh said that Mattie is a senior at Fairhope High School
and plans to attend the University of Alabama to major in Biology/Environmental
Services. She is captain of the Color Guard/Winter Guard; president of Project
Outreach; a member of the National Honor Society; and a member of the Key Club.
In her spare time, she tutors and volunteers with multi-disabled children.
Jennifer Fidler, Public Works Director, addressed the City Council and
announced Public Works Week which is from May 18, 2014 through May 24, 2014.
She stated on May 22, 2014 there will be a tour of the greenhouses, a storm drain
project, and a cookout for Public Works employees.

Mayor Kant stated the Supreme Court recently ruled that prayers are allowed
at the beginning of meetings. He also mentioned FEMA has not declared whether or
not it is going to help for Fairhope and/or the State of Alabama. The President has to
sign for FEMA to help. He said the City has almost $2.0 million in damages. Mayor
Kant also mentioned the possibility of moving the pipe that was damage at
Woodlands to running it down the right of way down the side of the road; and Spring
Lake acceptance of the streets is on the agenda for your consideration since we have
been maintaining. He thanked City Crews for their work during and after the storms
making it safe for our citizens.
The following individuals addressed the City Council during Public
Participation for Agenda Items:
1) Ed Colvin, 121 Cypress Lane, addressed the City Council regarding Agenda
Item Number 10; a resolution that the City of Fairhope accepts the streets in Spring
Lake Subdivision for maintenance. Mr. Colvin said there are 89 homes in the
Spring Lake Subdivision and has been working with Mayor Kant since March. He
requested that the City Council accepts the streets into the City.
Councilmember Brewer addressed the City Council and thanked
Councilmember Ford for the great job filling in at the Mayor's Prayer Breakfast.
Councilmember Ford addressed the City Council and thanked Councilmember
Brewer for the kind remarks.
Councilmember Boone addressed the City Council and announced he was a
proud granddaddy.
Councilmember Burrell addressed the City Council and said he agreed with
Councilmember Mueller on the need for a long term plan for stormwater issues. He
said we may need a civil engineer on staff and will look at this during our budget
cycle. Councilmember Burrell also stated he was concerned with small holes causing
a pipe or road to collapse. The City needs a Comprehensive Stormwater Management
Plan.
Pastor Ricardo Johnson with Contagious Faith Church addressed the City
Council and stated he wanted to make this presentation on the same day as the
National Day of Prayer, but several of the individuals were out of town. He
mentioned that his church was new to Fairhope. Pastor Johnson presented the Mayor,
the Councilmembers, the Chief of Police, and the Fire Chief a specialized gift from
Contagious Faith Church. He said they wanted to bathe the City in prayer; and
nothing but good could come from prayer.

A Public Hearing was held as advertised on the request for a Lounge Liquor
License by Noell Broughton, Plow Ventures, LLC, d/b/a Plow, located at 96
Plantation Pointe, Fairhope, Alabama. The public hearing was opened at 6:30 p.m.
No one present opposed the proposed Lounge Liquor License the Public Hearing
closed at 6:30 p.m. Councilmember Boone moved to approve the issuance of the
license. Seconded by Councilmember Brewer, motion passed unanimously by voice
vote.
Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution to Award RFQ No. 002-14 for Weathered Steel
Poles for the Electric Department for a total cost of $89,305.54. Seconded by
Councilmember Mueller, motion passed unanimously by voice vote.
RESOLUTION NO. 2216-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
[I] That the City of Fairhope did request and receive RFQs for Weathered Steel Poles for the
Electric Department (RFQ No. 002-14) at 555 South Section Street in the City of Fairhope
offices, Fairhope, Alabama; and procurement is authorized based on the option allowed by
the Code of Alabama 1975, Section 41-16-5l(b)(7) to obtain informal quotes.
[2] At the appointed time and place, the following RFQs were received and tabulated as
follows:

Weathered Steel Poles for the Electric Department
[3] At the appointed time and place; after evaluating the RFQ proposal with the required
specifications, HD Supply-Powers Solutions is now awarded the RFQ for Weathered Steel
Poles for the Electric Department; for a total cost of $89 ,305.54.

Councilmember Brewer introduced in writing , and moved for the adoption of
the following resolution, a resolution authorizing Mayor Timothy M. Kant to sign the
Municipal Water Pollution Prevention Program (MWPP) Report for 2013 . The
motion was seconded by Councilmember Mueller. Dan McCrory, Water and Sewer
Superintendent, mentioned there were 80 points this year and after corrections are
made it will reduce 50 of those points. Councilmember Mueller questioned if the
redundancy would affect the points. Mr. McCrory said it affected other parts of the
report, but not the points. After further discussion, motion passed unanimously by
voice vote .

RESOLUTION NO. 2217-14
MUNICIPAL WATER POLLUTION PREVENTION (MWPP) PROGRAM
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, that Mayor Timothy M. Kant is hereby authorized to inform the
Department of Environmental Management that the following actions were taken by
the City Council ofthe City of Fairhope, Alabama.
1. Reviewed the MWPP Annual Report which is attached to the resolution.
2. Set forth the following actions and schedule necessary to maintain effluent
requirement contained in the NPDES Permit, and to prevent the bypass and
overflow of raw sewage within the collection system or at the treatment
plant:
Attest:
(a) Complete the current wastewater treatment plant upgrades needed
for regulatory compliance and to accommodate future growth.
(b) Continue to perform 0 & M requirements to the treatment and
collection system and complete repairs when discovered .
(c) Continue to provide training opportunities for the operations staff
to assist them with maintaining certification and knowledge of current
methods and technologies.

Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution to Reject all Bids for Phosphate Chemical
Supply and Corrosion Testing Re-Bid (Bid No. 016-14); and to Authorize
Procurement through an RFQ process. Seconded by Councilmember Ford, motion
passed unanimously by voice vote.
RESOLUTION NO. 2218-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
[1] That the City of Fairhope did request, receive, and open bids for Phosphate
Chemical Supply and Corrosion Testing Re-Bid for the Water Department (Bid
Number 016-14) at 555 South Section Street in the City of Fairhope offices, Fairhope,
Alabama.
[2] At the appointed time and place, the following bids were opened and tabulated as
follows:

Phosphate Chemical Supply and Corrosion Testing Re-Bid
[3] After evaluating the bid proposal with the required bid specifications, it was
determined that specifications different from those posted would be utilized by the
City in acquiring the chemicals. Therefore, we request that all bids be rejected for
Phosphate Chemical Supply and Corrosion Testing Re-Bid (Bid No. 016-14); and to
authorize procurement through an RFQ process.

Councilmember Ford introduced in writing, and moved for the adoption of the
following resolution, a resolution that the streets in Spring Lake Subdivision as
identified per Plat recorded February 9, 1999 at Slide 0001871A in Instrument No.
478195 are hereby accepted for maintenance by the City of Fairhope. The motion
was seconded by Councilmember Brewer. Council President Burrell questioned
Jennifer Fidler, Public Works Director, regarding the reason this request for
acceptance is just now coming up. Ms. Fidler explained a realtor who was selling a
home was told these were private streets and wanted to verify. Ms. Fidler stated we
have been taking care of the streets for years. After further discussion, motion passed
unanimously by voice vote.

RESOLUTION NO. 2219-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that the streets in Spring Lake Subdivision as identified
per Plat recorded February 9, 1999 at Slide 0001871A in Instrument No. 478195 are
hereby accepted for maintenance by the City of Fairhope.

Councilmember Boone moved to grant the request of Eastern Shore Chamber
of Commerce requesting permission to block streets for their Annual Arts and Crafts
Festival on March 20, 21, and 22, 2015; "No Parking After 5:00p.m." signs be placed
on Thursday morning on March 19th; and adequate City personnel to provide for a
successful Festival. Seconded by Councilmember Brewer, motion passed
unanimously by voice vote.
