The City Council , City of Fairhope , met in regular session at
6:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope , Alabama 36532 , on
Thursday, 5 March 2015.

Present were Council President Jack Burrell , Councilmembers: Rich Mueller,
Diana Brewer, Michael A. Ford , and Ke vin Boone, Mayor Timothy M. Kant (arrived
at 6:06p.m.), City Attorney Marion E. Wynne , and City Clerk Lisa A. Hanks .
There being a quorum present, Council President Burrell called the meeting to
order. The invocation was given by Father Donald M. Smith, from St. James
Episcopal Church, and the Pledge of Allegiance was recited. Councilmember Brewer
moved to approve minutes of the 23 February 2015 , regular meeting ; minutes of the
23 February 2015 , work session ; and minutes of the 23 February 2015 , agenda
meeting. Seconded by Councilmember Mueller, motion passed unanimously by
voice vote.
Councilmember Boone stated there was a need to add on two agenda items
after Agenda Item Number 18 : a Resolution that the City Council approves the
selection of Hutchinson, Moore & Rauch , LLC for Professional Services for the
Woodlands EWP Project through the United States Department of Agriculture
National Resources Conservation Service ("NRCS ") for Project No. FAI-14-002 ; and
hereby authorizes Mayor Timothy M. Kant to negotiate the fee schedule; and a
Resolution to rescind Bid No. 001-15 from Formsystems , Inc.; d/b/a FSI Group , and
award Bid to the second lowest responsi ve and responsible bidder, Bay Graphics ,
Inc., d/b/a Nail Printing, in the amount $.995 per copy .
Councilmember Boone mo ved to add on the above mentioned items not on
the printed agenda. Seconded by Councilmember Brewer, motion passed
unanimously by voice vote.
Mayor Kant addressed the City Council and announced that he and several
Councilmembers will be at the National League of Cities in Washington , C.D. next
week. He mentioned meeting with our Congressman and Senators last month in
Washington and requested funds for our NRCS projects .
The following individual addressed the City Council during Public
Participation for Agenda Items :
1) Ken Moore, resident living in The Woodlands , addre ssed the City Council regarding
the Agenda Item being added tonight for the Woodlands EWP Project through the
United States Department of Agriculture National Resources Conservation Service .
He requested that the City Council fix the drainage problem in the Woodlands .

Councilmember Brewer questioned when this problem began. Mr. Moore replied
the volume has increased and caused issues mainly in the past two years.
A Public Hearing was held as advertised on a proposed ordinance to amend
Zoning Ordinance No . 1253 , adopted 27 June 2005. Councilmember Brewer
introduced in writing an ordinance to zone the property of Robert S. Berglin, Jr. and
Loree B. May to PUD (Planned Unit Development) concurrent with annexation. This
property is generally located on east of Sandy Ford , at the end of South Drive,
Fairhope, Alabama. Parcel contains 80.40 acres more or less; 05-43-08-33-0-000-
00 1.0002; Firefly Subdivision. The Planning Commission gave a favorable
recommendation of this ordinance. Council President Burrell read the proposed
ordinance. Planning Director Jonathan Smith briefly explained the proposed
ordinance.
Council President Burrell opened the Public Hearing at 6:16p.m. Steve Pumphrey,
Senior Planner, with Preble-Rish addressed the City Council on behalf of the owner.
He was present to answer any questions from the City Council. No one present
opposed the proposed ordinance , the Public Hearing closed at 6:17 p.m.
Due to lack of a motion for immediate consideration , this ordinance will layover until
the April 13 , 2015 City Council meeting at the request of the owners.
Councilmember Brewer introduced in writing Ordinance No. 1534, an
ordinance to amend Ordinance No. 920 , Section 1, to reflect the following change;
the removal of the Library Board will correct the number of members which is Five
(5) Members pursuant to the Code of Alabama, Section 11-90-2. In order to take
immediate action, Councilmember Brewer moved for immediate consideration.
Seconded by Councilmember Mueller , motion for immediate consideration passed
unanimously by the following voice votes: AYE-Burrell , Mueller, Brewer, Ford,
and Boone. NAY -None. Councilmember Brewer then moved for final adoption of
Ordinance No. 1534 . Seconded by Councilmember Mueller , motion for final
adoption passed by the following voice votes: AYE-Burrell, Mueller, Brewer, Ford,
and Boone. NAY -None.
Councilmember Brewer introduced in writing , and moved for the adoption of
the following resolution, a resolution that Mayor Timothy M. Kant is hereby
authorized to execute a Contract between the City of Fairhope and Gulf South
Pipeline Company, Inc. for the NNS and NNS-SCO No-Notice Agreement.
Seconded by Councilmember Ford, motion passed unanimously by voice vote.

RESOLUTION NO: 2330-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that Mayor Timothy M. Kant is hereby authorized to execute a Contract
between the City of Fairhope and Gulf South Pipeline Company, Inc ., for the NNS and NNS-
SCO No-Notice Agreement.

Councilmember Brewer introduced in writing , and moved for the adoption of
the following resolution, a resolution To purchase Components for WiFi Rollout
Project per the request of the IT Department for the City of Fairhope and the
requested components are available for direct procurement through the U. S.
Communities Contract; and therefore do not have to be let out for bid. The total cost
is $26,136.97. Seconded by Councilmember Mueller, motion passed unanimously by
voice vote.
RESOLUTION NO. 2331-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
[1] That the City of Fairhope has voted to purchase Components for WiFi Rollout Project per
the request of the IT Department for the City of Fairhope and the requested components are
available for direct procurement through the U . S. Communities Contract; and therefore do
not have to be let out for bid. The total cost is $26,136.97 .

RESOLUTION NO. 2332-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
[1] That the City of Fairhope has voted to purchase a 2015 Ford F150 Super Cab for
the Gas Department and requested item is available for direct procurement through
the Houston-Galveston Area Council ("H-GAC ") Contract. The total cost is
$21,685.00.

RESOLUTION NO. 2333-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follows :
[I] That the City of Fairhope has voted to purchase a 2015 Ford Fl50 Super Cab for the
Electric Department and requested item is available for direct procurement through the
Houston-Galveston Area Council ("H-GAC ") Contract. The total cost is $24 ,562.00.

Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution to Award Bid (Bid No. 008-15) for the Quail
Creek Golf Course Irrigation System 2015 to Pro Rain Environmental Construction,
Inc., for Bid Option No. 1 (complete irrigation system with owner providing listed
materials), with the total bid proposal of $356,928.00. Seconded by Councilmember
Mueller, motion passed unanimously by voice vote. Councilmember Brewer
questioned the time line for the project. Bobby Hall, Golf Director, replied we should
begin around the first week of April.
RESOLUTION NO. 2335-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA , as follows:
[1] That the City of Fairhope did request , receive, and open bids for the Quail Creek
Golf Course Irrigation System 2015 (Bid Number 008-15) at 555 South Section Street
in the City of Fairhope offices , Fairhope , Alabama.
[2] At the appointed time and place , the following bids were opened and tabulated as
follows:

[3] After evaluating the bid proposals with the required bid specifications, Pro Rain
Environmental Construction, Inc., for Bid Option No. 1 (complete irrigation system
with owner providing listed materials), with the total bid proposal of $356 ,928.00, is
now awarded the bid for the Quail Creek Golf Course Irrigation System 2015.

Councilmember Brewer introduced in writing , and moved for the adoption of
the following resolution , a resolution to Award Bid (Bid No. 0 11-15) for Class 200
SDR PVC Pipe to Southern Pipe and Supply Company, with the total bid proposal of
$77 ,443.00. Seconded by Councilmember Mueller, motion passed unanimously by
voice vote.
RESOLUTION NO. 2336-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follows :
[1] That the City of Fairhope did request , receive , and open bids for Class 200 SDR
PVC Pipe (Bid Number 0 11-15) at 555 South Section Street in the City of Fairhope
offices, Fairhope , Alabama.
[2] At the appointed time and place , the following bids were opened and tabulated as
follows:

[3] After evaluating the bid proposals with the required bid specifications, Southern
Pipe and Supply Company, with the total bid proposal of$77,443.00 is now awarded

Councilmember Ford introduced in writing , and moved for the adoption of the
following resolution , a resolution to purchase Toro Irrigation System Materials for
Project No. GOLF001-15 , Quail Creek Golf Course Irrigation System 2015 for the
Golf Department and the type of Materials needed are on The Cooperative Purchasing
Network (TCPN) and therefore do not have to be let out for bid with an approximate
cost of $209,600.40; and the Flowtronex Pump System needed for the project, which
is a sole source item that is needed to interface with the Toro system, with an
approximate cost of$98,690 .00 ; and the Wet Well , Intake Pipe, and Incidental related
items needed for the project with an approximate cost of$10,732.22 . Jerry Pate Turf
Irrigation, Inc. is the vendor for all of these items including the items on the TCPN.
Approximate Total Costs $319 ,022.62 to allow for freight cost variations at ship time.
Seconded by Councilmember Boone, motion passed unanimously by voice vote.

RESOLUTION NO. 2337-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE
' ALABAMA, as follows:
[1] That the City of Fairhope has voted to purchase Toro Irrigation System Materials for
Project No. GOLF001-15, Quail Creek Golf Course Irrigation System 2015 for the Golf
Department and the type of Materials needed are on The Cooperative Purchasing Network
(TCPN) and therefore do not have to be let out for bid. The cost is approximately
$209,600.40 to allow for freight cost variations at ship time; and
[2] That the City of Fairhope has voted to purchase The Flowtronex Pump System needed for
the project, which is a sole source item that is needed to interface with the Toro system
mentioned above, with an approximate cost of $98,690.00 to allow for freight cost variations
at ship time; and
[3] That the City of Fairhope has voted to purchase the Wet Well, Intake Pipe, and Incidental
related items needed for the project with an approximate cost of $10,732 .22 to allow for
freight cost variations at ship time. Jerry Pate Turf Irrigation, Inc. is the vendor for all of
these items including the items on the TCPN.

Planning Director Jonathan Smith addressed the City Council to explain the
Site Plan Review of property owned by S. E. Civil Engineering, LLC -406 Oak
A venue located on the southwest comer of the intersection of Oak A venue and
Bancroft Street, Fairhope, Alabama for a proposed Mixed Use Structure.
Councilmember Brewer moved to approve the Site Plan property owned by S.
E. Civil Engineering, LLC listed above. Seconded by Councilmember Boone, motion
passed by the following votes: AYE -Burrell, Mueller, Brewer, Ford, and Boone.
NAY-None.
Councilmember Ford moved to approve the Job Title of Mechanic Supervisor
with a Pay Grade 26 and a salary of $55,000.00 for the Administration Department.
Seconded by Councilmember Boone , motion passed unanimously by voice vote.

City Council reviewed an application for a Non-Profit Tax Exempt License
(Alcoholic Beverage License) by John Matus for Point Clear Rotary Club , Inc., for
the 2015 Taste of Rotary located at 161 North Section Street, Fairhope, Alabama on
April 14 , 2015 from 6:00 p.m . to 10:00 p.m. Councilmember Brewer moved to
approve the issuance of the license. Seconded by Councilmember Boone, motion
passed unanimously by voice vote.
City Council reviewed an application for a Non-Profit Tax Exempt License
(Alcoholic Beverage License) by Will Carlton for The Fairhope Rotary Club
Foundation, for the Eleventh Annual Steak Cook Off located on Bancroft Street at
Fairhope Avenue to Morphy Street, Fairhope, Alabama on May 8, 2015 from 5:00
p.m. to 11 :30 p.m. Councilmember Boone moved to approve the issuance of the
license. The motion was seconded by Councilmember Brewer. Councilmember Ford
stated that due to being a member of the Rotary , he would be abstaining from the
vote. After further discussion, motion passed by the following votes : AYE -Burrell ,
Mueller , Brewer, and Boone. NAY-None . ABSTAIN -Ford.
Councilmember Boone introduced in writing , and moved for the adoption of
the following resolution, a resolution that the City Council approves the selection of

RESOLUTION NO . 2339-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows :
[1] That on January 12 , 201 the City of Fairhope did award Formsystems , Inc ., d/b /a
FSI Group , Bid Number 001-15 , with the total bid proposal of $.95 per copy, up to
9,000 copies , for the Printing of City Sketche s 2015.
[2] A Notice of Award and contract documents were presented to Formsystems, Inc.,
d/b/a FSI Group ; and the vendor has not submitted all required documentation.
[3] After evaluating the bid proposals w ith the required bid specifications, the City of
Fairhope now rescinds Bid No. 001-15 from Formsystems, Inc., d/b /a FSI Group , and
awards the bid to the second lowest responsive and responsible bidder, Bay Graphics ,
Inc. d/b /a Nail Printing, in the amount of $.995 per copy .

Councilmember Brewer moved to adjourn the meeting. Seconded by
Councilmember Boone, motion passed unanimously by voice vote.
