HomeMy WebLinkAbout06-08-2015 City Council Meeting MinutesSTATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 6:00 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 8 June 2015. 6758 Present were Council President Jack Burrell, Councilmembers: Diana Brewer, Michael A. Ford, and Kevin Boone, City Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks. Councilmember Rich Mueller and Mayor Timothy M. Kant were absent. There being a quorum present, Council President Burrell called the meeting to order. The invocation was given by Pastor Ryan Cramer of St. Paul's Lutheran Church and the Pledge of Allegiance was recited. Councilmember Brewer moved to approve minutes of the 26 May 2015, regular meeting; minutes of the 26 May 2015, work session; and minutes of the 26 May 2015, agenda meeting. Seconded by Councilmember Boone, motion passed unanimously by voice vote. Council President Burrell addressed the City Council regarding the Orange Street Pier issue and stated this was not a sewage spill. Experts have stated it is not consistent with human waste; and think it is of animal origin. He said samples have been sent to a lab for testing. He also mentioned there was a jubilee last week; and regrets that matter is on our beach. Our Public Works Department has cleaned the beach; and the Red Alert was put in place for precautionary measures. Council President Burrell announced that the City will make the results public on our website. He commented we may have to deal with the geese if this continues to happen. Council President Burrell mentioned that Councilmember Mueller is not here tonight due to being ill; and asked everyone to keep him in our thoughts and prayers. Nancy Wilson, City Treasurer, addressed the City Council and introduced Deborah Smith who will take her place as City Treasurer beginning July 1, 2015. Ms. Wilson stated Ms. Smith's past job experience and education will make her a quick study for this position. She said Ms. Smith will do a great job and we are glad to have her. Council President Burrell announced he would be attending the Paris Air Show on behalf of the City of Fairhope and the Fairhope Airport Authority. He will be the only representative from the City attending along with five other representatives from Baldwin County. 6759 8 June 2015 A Public Hearing was held as advertised on a proposed ordinance to amend Ordinance No. 1253. Councilmember Brewer introduced in writing Ordinance No. 1540, an ordinance to amend the Planned Unit Development (PUD) for Stone Creek specifically Lots 79 -251 and Commercial Lot 1, to be known as Stone Creek, Phase 3, (Ordinance No. 1514); the property of Stone Creek, LLC. This property is located at the east of State Highway 181 just south of the intersection of County Road 44 (a/k/a Twin Beech Road) and Highway 181, Fairhope, Alabama. Parcel ID No. 46- 07-26-0-000-002.003. The Planning Commission gave a favorable recommendation of this ordinance. Council President Burrell read the proposed ordinance. Planning Director Jonathan Smith briefly explained the proposed ordinance. Council President Burrell opened the Public Hearing at 6:20 p.m. No one present opposed the proposed ordinance, the Public Hearing closed at 6:21 p.m. Council President Burrell questioned the concerns citizens had and if those were resolved. Mr. Smith replied those concerns have been resolved. In order to take immediate action, Councilmember Ford moved for immediate consideration. Seconded by Councilmember Boone, motion for immediate consideration passed unanimously by the following voice votes: AYE -Burrell, Brewer, Ford, and Boone. NAY -None. Councilmember Boone then moved for final adoption of Ordinance No. 1540. Seconded by Councilmember Ford, motion for final adoption passed by the following voice votes: AYE-Burrell, Brewer, Ford, and Boone. NAY -None. Councilmember Brewer introduced in writing, and moved for the adoption of the following resolution, a resolution to purchase Musco Sports Lighting Materials for the Electrical Department to be used at the Fairhope Soccer Complex; and authorizes procurement based on the option allowed by the Code of Alabama 1975, Section 41-16-51(b)(7). The total cost is $1,054,219.00. Seconded by Councilmember Boone, motion passed unanimously by voice vote. * * * 6760 8 June 2015 RESOLUTION NO. 2367-15 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope has voted to purchase Musco Sports Lighting Materials for the Electrical Department to be used at the Fairhope Soccer Complex; and authorizes procurement based on the option allowed by the Code of Alabama 1975, Section 41-16-51(b)(7). The total cost is $1,054,219.00. Adopted on this 8th day of June, 2015 Attest: ~ Lisa A. a s, MMC City Clerk Councilmember Boone introduced in writing, and moved for the adoption of the following resolution, a resolution to award Bid for the Disaster Debris Removal and Disposal Contract (Bid No. 020-15) to Pittman Tractor Company, Inc., as needed after disaster; and authorizes Mayor Timothy M. Kant to execute the contract for the City of Fairhope. The motion was seconded by Councilmember Ford. Council President Burrell mentioned a letter from the Ethics Commission to Trip Pittman stating as long as all bid requirements are met, he has the same opportunity as all other similarly situated businesses. Purchasing Manager Dan Ames explained the bid process and used Hurricane Ivan as the example for the bid. Council President Burrell also mentioned he was contacted by a bidder regarding the outcome; and went to Dan Ames' office unexpected to look at the bids. He stated he ran the numbers to verify the company was not the lowest bidder and find out the reasons for not being the bid winner. He said everything was done to the letter of the law. After further discussion, motion passed unanimously by voice vote. 6761 8June2015 RESOLUTION NO. 2368-15 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [I] That the City of Fairhope did request, receive, and open bids for the Disaster Debris Removal and Disposal Contract (Bid Number 020-15) at 555 South Section Street in the City of Fairhope offices, Fairhope, Alabama. [2] At the appointed time and place, the following bids were opened and tabulated as follows (the complete bid tabulation is on file in the City Clerk's Office): Pittman Tractor Co., Inc. Asplundh Environmental Services, Inc. Crowder Gulf DRC Emergency Services, LLC Phillips & Jordan, Inc. Greenco Services, LLC TAG Grinding Services, Inc. Burford's Tree, Inc. $1,244,160.00 $1,364,987.09 $1 ,404,000.00 $1,686,960.00 $1 '728,000.00 Non-Responsive Non-Responsive Non-Responsive [3] After evaluating the bid proposals with the required bid specifications, Pittman Tractor Company, Inc., is now awarded the bid for the Disaster Debris Removal and Disposal Contract, as needed after disaster, based on per unit cost as specified in Bid Tabulation. [4] That Mayor Timothy M. Kant is hereby authorized to execute the Disaster Debris Removal and Disposal Contract with Pittman Tractor Company, Inc. for the City of Fairhope. Adopted on this 8th day of June, 2015 Attest: ~~ City Cl rk 6762 8 June 2015 Councilmember Brewer introduced in writing, and moved for the adoption of the following resolution, a resolution that the City of Fairhope request the Eastern Shore Metropolitan Planning Organization to fund the Downtown Fairhope Transit Shelter and commits to provide the local match for said project amounting to twenty percent (20%) of the total project cost which is estimated between $40,000.00 and $60,000.00. Public Works Director Jennifer Fidler explained the design of the transit hub and the need for the resolution. Council President Burrell commented that this resolution is a requirement to be put on the grant list. Seconded by Councilmember Boone, motion passed unanimously by voice vote. RESOLUTION NO. 2369-15 WHEREAS, the City of Fairhope ("City") is a member of the Eastern Shore Metropolitan Planning Organization (MPO), and WHEREAS, federal funding is available through the MPO for transit projects; and WHEREAS, federal law requires a twenty percent (20%) local match for projects utilizing said federal funds; and WHEREAS, City desires to construct a transit shelter in downtown Fairhope (hereinafter "Project"); and WHEREAS, the estimated total Project cost is between $200,000 and $300,000; and WHEREAS, the estimated local match for the Project is between $40,000 and $60,000; and WHEREAS, the MPO requires a resolution from a sponsoring local government committing the sponsoring government to providing the 20% local match for project funds; NOW, THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, that the City Council request the Eastern Shore Metropolitan Planning Organization to fund the Downtown Fairhope Transit Shelter and commits to provide the local match for said project amounting to twenty percent (20%) of the total project cost. ADOPTED THIS 8TH DAY OF JUNE, 2015 ATTEST: 6763 8 June 2015 Councilmember Brewer introduced in writing, and moved for the adoption of the following resolution, a resolution that Deborah A. Smith is hereby appointed as Interim City Treasurer until the retirement of City Treasurer Nancy Wilson; and appointed City Treasurer beginning on July 1, 2015. Seconded by Councilmember Ford, motion passed unanimously by voice vote. RESOLUTION NO. 2370-15 WHEREAS, City Treasurer Nancy K. Wilson will be retiring on July 1, 2015 from the City of Fairhope; and WHEREAS, the City Council desires to appoint an interim City Treasurer until Nancy Wilson retires; and the interim City Treasurer will then be the appointed City Treasurer; BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Deborah A. Smith is hereby appointed as Interim City Treasurer until the retirement of City Treasurer Nancy K. Wilson; and appointed City Treasurer beginning on July 1, 2015. ADOPTED 8TH DAY OF JUNE, 2015 ATTEST: Councilmember Boone moved to approve the request to hire a Full Time Building Inspector for the Building Department with a Pay Grade of 21; and to be considered for permanent employment must be fully certified within 6 months from date of hire. Seconded by Councilmember Ford, motion passed unanimously by voice vote. 6764 8 June 2015 Councilmember Ford moved to approve the request of the Fairhope Film Festival requesting permission to use the Welcome Center as their Box Office from Wednesday, November 11, 2015 through Saturday, November 15, 2015; to use the City public area near the Fairhope Clock which is adjacent to the flowerbed and near the NE corner of Fairhope A venue and Section Street; and to hang a minimum of 6 pole banners 10 days prior to and during the Festival from November 2, 2015 until November 15, 2015. The motion was seconded by Councilmember Boone. Community Affairs and Recreation Director Sherry Sullivan explained the request and asked the City Council to stick to the number of banners with permit. Councilmember Brewer commended that the request was for eight banners. After further discussion, motion passed by the following voice votes: AYE-Burrell, Ford, and Boone. NAY -Brewer. Councilmember Brewer moved to adjourn the meeting. Seconded by Councilmember Boone, motion passed unanimously by voice vote.
