HomeMy WebLinkAbout10-12-2015 City Council Meeting MinutesSTATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council , City of Fairhope , met in regular session at 6:00p.m., Fairhope Municipal Comple x Council Chamber, 161 North Section Street, Fairhope , Alabama 36532 , on Monday, 12 October 2015. 6845 Present were Council President Jack Burrell , Counci1members : Rich Mueller, Diana Brewer, Michael A . Ford , and Ke vin Boone , Mayor Timothy M. Kant, City Attorney Marion E. Wynne , and City Clerk Lisa A. Hanks. There being a quorum present, Council Pre sident Burrell called the meeting to order. The invocation was given by Re verend William Parsons, Pastor of Redeemer Lutheran Church , and the Pledge of Allegiance was recited. Councilmember Brewer moved to approve minutes of the 28 September 2015 , regular meeting ; minutes of the 28 September 2015 , work session ; minutes of the 28 September 2015 , agenda meeting; and minutes of the 28 September 2015 , budget meeting . Seconded by Councilmember Boone , motion passed unanimously by voice vote . Approve Minutes of 28 September 2015 Regular City Council Meeting , minutes of 28 September 2015 Work Session, minutes of 28 September 2015 Agenda Meeting , and 28 September 2015 Budget Meetin g. Mayor Kant addressed the City Council and thanked them for their hard work on the budget. He mentioned the Emplo yee Appreciation Luncheon scheduled for tomorrow; last Friday night Fairhope High School football team came back to win ; and that one of the players , Hayden Merchant , broke his leg during the game . Councilmember Mueller addressed the City Council and said it was a pleasure working with the Council and Mayor ; and we have made some accomplishment over the years. Councilmember Ford addres sed the City Council and displayed a picture of him and Mayor Haygood of Daphne with Fairhope getting back the Jubilee Cup after Fairhope High School football team beat Daphne . Council President Burrell addressed the City Council and thanked them for their hard work on the budget. He thanked Mayor Kant and the City staff also for their hard work. A Public Hearing was held as ad vertised on the request for a Lounge Liquor License by Doug 0 . Kerr for Dragonfl y Productions , LLC , d/b /a Fly Bar, located at 7 South Church Street, Suite A, Fairhope , Alabama. 6846 12 October 2015 The public hearing was opened at 6:06 p.m. No one present opposed the proposed Lounge Liquor License ; the Public Hearing closed at 6:06 p.m. Councilmember Brewer moved to approve the issuance of the license. Seconded by Councilmember Boone , motion passed unanimousl y by voice vote . Councilmember Brewer moved for final adoption of Ordinance No . 1550, an ordinance to amend Zoning Ordinance No . 1253 ; Article IV. Site Design Standards , Section E . Parking: by adding provisions for compact car parking requirements, low impact development ("LID ") strategies , and definitions for LID strategies . (Introduced at the September 28 , 2015 City Council Meeting) The motion was seconded by Councilmember Mueller. Councilmember Boone questioned the compact cars parking. Jonathan Smith , Planning Director, replied the developers will be required to use permeable pavement and begin using the LID techniques. This is a progressive move for Fairhope and the first in the State. After further discussion, motion for final adoption passed by the following voice votes: AYE -Burrell, Mueller, Brewer, Ford , and Boone . NAY-None. Councilmember Brewer moved for final adoption of Ordinance No. 1551 , an ordinance to establish the Bylaws of the Fairhope Historic Preservation Committee. (Introduced at the September 28 , 2015 City Council Meeting) The motion was seconded by Councilmember Mueller. Councilmember Ford commented he was against the rules of procedures. Council President Burrell questioned the number of members in the bylaws. After further discussion , motion for final adoption passed by the following voice votes: AYE -Burrell , Mueller , Brewer, and Boone. NAY-Ford. Councilmember Brewer introduced in writing , and moved for the adoption of the following resolution , a resolution to adopt the Holidays for the 2015 -2016 fiscal year. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. * * * 6847 12 October 2015 RESOLUTION NO. 2410-15 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE , ALABAMA, THAT THE FOLLOWING 2015 -2016 HOLIDAYS WILL BE OBSERVED BY ALL CITY PERSONNEL EXCEPT EMERGENCY EMPLOYEES: Veterans Day VVednesday,~ove~ber11,2015 Thanksgiving Thursday & Friday, ~ ove~ber 26 & 27, 2015 1/2 Day Chris~as Eve Thursday, Dece~ber 24, 2015 Christ~as Friday, Dece~ber 25, 2015 ~ew Year's Day Friday, January 1, 2016 Martin Luther King, Jr. Monday, January 18, 2016 Me~orial Day Monday, May 30, 2016 Independence Day Monday, July 4, 2016 Labor Day Monday, Septe~ber 5, 2016 DULY ADOPTED THIS 12TH DAY OF OCTOBER, 2015 Attest ~H~ City Clerk Jill Cabaniss , Finance Director, addressed the City Council and presented the proposed 2015 -2016 Budget via a Power Point Presentation. It was noted that the $350,000 used for the Fairhope schools was reduced to $345 ,000; and the $5,000 reduction would be given to Care House , Inc . who provide curriculum for grades K through 12 on sexual abuse prevention. 6848 12 October 2015 Council President Burrell asked City Clerk Lisa Hanks and Ms. Cabaniss if the date for employees' eligibility needs to be added to the resolution for the cost of living raise. Both Ms. Hanks and Ms. Cabaniss agreed this should be added for clarity. Councilmember Brewer moved to amend the resolution that the proposed Budget for FY 2015-2016 presented and reviewed the 12th day of October 2015, by adding the verbiage the paragraph three "also cost of living raises will be eligible for employees hired on or before April 30 , 20 15 " after November 1, 2015. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. Councilmember Boone introduced in writing, and moved for the adoption of the following resolution, a resolution that the proposed Budget presented and reviewed the 12th day of October 2015, be hereby approved and adopted for the FY 2015 -2016 as amended. Seconded by Councilmember Ford, motion passed unanimously by voice vote. RESOLUTION NO. 2411-15 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the proposed Budget presented and reviewed the 12th day of October 2015, be hereby approved and adopted for the FY 2015-20 16 ; and BE IT FURTHER RESOLVED that the Annual Salaries of City Personnel shall be as shown on a list entitled Annual Salaries of All City Personnel and said list filed in the Office of the City Treasurer; and BE IT FURTHER RESOLVED that cost of living and merit raises adopted in the Budget will become effective on November I, 2015; also cost of living raises will be eligible for employees hired on or before April 30 , 20 15; and BE IT FURTHER RESOLVED that Mayor Timothy M. Kant is hereby authorized to fill all positions that have been approved and budgeted as needed; BE IT FURTHER RESOLVED that the City Council hereby authorizes additional debt principal payments for the GOW 2007 in the amount totaling $2 ,000 ,000.00 in June 2016; and to refinance the remaining balance of the GOW 2007; and BE IT FURTHER RESOLVED that each Full Time employee shall receive a One Time Pay Increase for the period I December 2014 through 30 November 2015; each qualifying employee shall receive $20.00 per month of employment during said period. To qualify, an employee must be a Full-Time Employee during this period. An employee hired on or before the fifteenth (15th) day of a month will be given credit for the full month; an employee hired on or after the sixteenth (16th) day of a month will not be given credit for that month. In order to receive this One Time Pay Increase, an employee must be employed on the 30th of November. Employees who have reached the maximum of their pay grade will receive a One Time Pay Increase that also includes the across the board cost of living ; and 6849 12 October 2015 For the same time period, and hiring rule each qualifying Part-time employee shall receive the following: First year -$ 25.00; Second year -$ 50.00; Third year - $ 75.00; and Fourth year - $100.00 The maximum amount for Part-time employees is $100.00. This One-Time Pay Increase will be awarded on Friday, 4 December 2015. ADOPTED THIS 12TH DA ~ ~tiL~ City Clerk Councilmember Brewer introduced in writing, and moved for the adoption of the following resolution , a resolution to purchase some of the equipment under a lease/purchase contract associated with Bid No. 023-11 , Golf Course Mower and Equipment (2 Fairway Mowers and 3 Turf Utility Vehicles) at a cost of $26,053.00; and to authorize Mayor Kant to execute the buyout provision of the contract. Seconded by Councilmember Boone, motion passed unanimously by voice vote. Council President Burrell questioned the buyout and equipment. Mayor Kant replied that other Departments will have access and we will need at the soccer field. RESOLUTION NO. 2412-15 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope has voted to purchase some of the equipment under a lease/purchase contract associated with Bid No. 023-11 , Golf Course Mower and Equipment Lease/Purchase at a cost of $26 ,053 .00; and to authorize Mayo r Kant to execute the buyout provision of the contract. 2 Each , John Deere Model 7700 Fairway Mower 3 Each, John Deere Gator TX Turf Utility Vehicles Grand Total for all Items Adopted on this 12th da ~~L 1Sa:Hk5,M City Cler $19 ,990.00 Total $ 6,063.00 Total $26,053.00 6850 12 October 2015 Councilmember Brewer introduced in writing , and moved for the adoption of the following resolution , a resolution to purchase a Backhoe under a lease/purchase contract associated with Bid No . 025-11 , Backhoe (CAT 420EST Backhoe Loader DJL02607) for Gas Department Lease/Purchase at a cost of $38 ,733.45 ; and to authorize the Mayor to execute the buyout provision of the contract. Seconded by Councilmember Boone, motion passed unanimously by voice vote. RESOLUTION NO. 2413-15 BE IT RES OLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA , as follows: [1] That the City of Fairhope has voted to purchase a Backhoe under a lease /purchase contract associated with Bid No. 024-11 , Backhoe (CAT 420EST Backhoe Loader DJL02607) for Gas Department Lease /Purchase at a cost of $38,733.45; and to authorize the Mayor to execute the buyout provision of the contract. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. * * 6851 12 October 2015 RESOLUTION NO. 2414-15 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [ 1] That the City of Fairhope has voted to purchase a Backhoe under a lease/purchase contract associated with Bid No. 025-11 , Backhoe (CAT 420EST Backhoe Loader DJL02602) for Water Department Lease /Purchase at a cost of $38,733.45; and to authorize the Mayor to execute the buyout provision of the contract. Adopted on this 12th day of October, 2015 Attest: ~1!1J.~ City Clerk Councilmember Boone introduced in writing , and moved for the adoption of the following resolution, a resolution to purchase Telecom Local Services for the IT Department for the City Phone System and the type of equipment and services needed are on the Alabama State Department of Purchasing bid list and therefore does not have to be let out for bid; and the total cost for three years is $46 ,066 .32 . Seconded by Councilmember Brewer, motion passed unanimously by voice vote . RESOLUTION NO. 2415-15 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA , as follows: [I] That the City of Fairhope has voted to purchase Telecom Local Services for the IT Department for the City Phone System and the type of equipment and services needed are on the Alabama State Department of Purchasing bid li st and therefore does not have to be let out for bid ; and 12 October 2015 [2] The following is the Alabama State Department of Purchasing contract information: Bid Number: T410 Telecom Local Services 3-Year Contract Contract Number: 4013110 Total Cost is $46,066.32 Adopted on this 12th day Attest: ~--~~ ~nkS: C City Clerk 6852 City Council reviewed an application for a Non-Profit Tax Exempt License (Alcoholic Beverage License) by Nancy Robertson , The Baldwin County Humane Society, for 2015 Christmas by the Bay located at 161 North Section Street, Fairhope, Alabama on November 19 , 2015 from 6:00 p.m. to 9:00 p.m. Councilmember Brewer moved to approve the issuance of the license. Seconded by Councilmember Boone, motion passed unanimously by voice vote. Councilmember Mueller recognized the members of the Fairhope Historic Preservation Committee who were in attendance. Councilmember Brewer moved to adjourn the meeting. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. There being no further business to come before the City Council, the meeting was duly adjourned at 6:41 p.m.
