The City Council met in a Work Session at 4:30 p.m.,
Delchamps Room,161 North Section Street,
Fairhope,Alabama 36532,on Monday,23 November 2015.
Present were Council President Jack Burrell,Councilmembers:Rich Mueller,Diana
Brewer, Michael A. Ford, and Kevin Boone, Mayor Timothy M. Kant, City Attorney Marion
E.Wynne,and City Clerk Lisa A. Hanks.
Council President Burrell called the meeting to order at 4:30 p.m.
The following topics were discussed:
• Councilmember Brewer gave an update on the Education Advisory Committee and
said two proposals for the study were received and on December 9, 2015
presentations willbe made ata special called meeting.She mentioned the Recreation
Board's main discussion was tennis and tennis courts. A special-called meeting for
the Recreation Board will be held on December 2, 2015 regarding a franchise
agreement.
•Councilmember Ford commented that the Recreation Board discussed tennis courts,
tennis association,and a proposed franchise agreement for tennis lessons.He said
the Recycling Committee is waiting on case for single source recycling.Council
President Burrell replied we need a buyer notjust one company and if it goesout of
business where do we sell our recyclables.MayorKant commentedwe need to meet
with the company to see if they take glass.Councilmember Mueller said that we
need to get the best value we can;and no one expects us to make a profit.Council
President Burrell stated the breakeven point is supposedto be in one and a half years
perthe Committee;and the savings are in not have tipping fees.Mayor Kant stated
we need a Work Sessionjust on recycling and our options.Councilmember Ford
commented the Museum Advisory Board is doing well.
•President Burrell gave an update on the Airport Authority and mentioned they
awardedthe bid for the second hangar;andare lookingat parcelthey could lease.
•Community Affairs and Recreation Director Sherry Sullivan addressed the
City Council regarding the past weekend being busy and gave an update on
the events.
•Building Official Erik Cortinas addressed the City Council regarding the
demolition of a building on Northrop Street and a resolution for the cost to
come before the City Council.
•Planning Director Jonathan Smith addressed the City Council and gave an
update on the proposed amendment to the Fly Creek PUD.Mr.Smith stated
he thought the density would decrease with the change,but it actually
increased. He also stated there would be a detailed traffic study requested for
the new revision.

•Chief Joseph Petties addressed the City Council and mentioned there is an
increase with car burglaries in our area and wanted everyone to be aware.
•Councilmember Mueller brought up the noise ordinance and the proposal to
repeal the ordinance in our Code and replace with the ordinance we previously
codified.He said one main difference is the discretion would be up to the
Police Officer instead of using the decibel meters.Councilmember said he
was speaking louder than 50 decibels right now. If we keep decibel meters,
the noise level needs to be raised higher in certain areas.
Chief Petties stated that disorderly conduct is enforceable;and gave an
example of how on a clear night noise travels far. Councilmember Mueller
said we need to lighten up the one we have.
City Attorney Wynne said we could lessen decibels and still have an objective
standard that would hold up in Court. Mayor Kant explained the history of
the noise ordinance and how we came to using the decibel meters.
Councilmember Mueller and Council President Burrell both agreed we need
to complement the ordinance we have and not change it.
There being no further business to come before the City Council, the meeting was
duly adjourned at 5:34 p.m.
