The City Council met in a Work Session at 4:30 p.m.,
Delchamps Room, 161 North Section Street,
Fairhope, Alabama 36532, on Monday, 25 April 2016.
Present were Council President Jack Burrell, Councilmembers: Rich Mueller, Diana
Brewer, Michael A. Ford (arrived at 4:47 p.m.), and Kevin Boone, Mayor Timothy M. Kant,
and City Clerk Lisa A. Hanks. City Attorney Marion E. Wynne was absent.
Council President Burrell called the meeting to order at 4:30 p.m.
The following topics were discussed:
• Sherry Sullivan, Community Affairs and Recreation Director, addressed the City
Council regarding the proposed amendments to the Park Usage Ordinance and the
Sidewalk/Street Usage Ordinance. Ms. Sullivan commented that the changes will
make the policies and procedures for one ordinance the same as the other ordinance;
i.e. permits fees, clean-up deposit, and security fees.
Council President Burrell said that he tweaked the clean-up deposit section by the
following verbiage: "A refundable clean-up deposit of $500.00 is required for events
with less than 50 participants. For events with 50 or more participants, the clean-up
deposit will be $1,000.00. Deposits and all permits fees must be paid in advance.
The refundable clean-up deposit will be held until after the event. At the conclusion
of the event, the area will be inspected by a representative of the City. If the user has
not cleaned up the park (sidewalk/street) and restored it to its original condition, the
City will clean up the park (sidewalk/street) and charge the user for the services. The
clean-up deposit will be refunded less the charges for these City services as assessed
by the appropriate City staff. Volanta stadium was briefly discussed.
• Councilmember Brewer mentioned The Akribos Consulting Group will be at the next
Education Advisory Committee meeting to answer questions. They will soon present
the Academic Audit results to the City Council. Councilmember Brewer read a letter
from a Fairhope parent who would like to combine the elementary and middle
schools into two "K thru 6 grade" schools. She requested a letter of support or a
resolution in support of this idea. The consensus of the City Council was to get a
letter from the Task Force and have a possible presentation at a Work Session.
Mayor Kant said that combining the schools into two "K thru 6th grade" schools
would drop from 32 students to 18 students in the "4th thru 6th grade" students
• Councilmember Mueller stated that at the next Work Session he would have the
proposed Historic Preservation Ordinance for review.
