HomeMy WebLinkAboutO-1676ORDINANCE NO. 1676 AN ORDINANCE AMENDING ORDINANCE NO. 1253 KNOWN AS THE ZONING ORDINANCE The ordinance known as the Zoning Ordinance (No. 1253), adopted 27 June 2005, is changed and altered as described below; WHEREAS, the City of Fairhope Planning Commission directed the Planning Department to prepare amendments to our Zoning Ordinance; and, WHEREAS, the proposed amendments relate to Director of Planning, Lot Coverage, Driveways, Fencing, PUD (Planned Unit Development), and Non-Conforming Structures; and, WHEREAS, after the appropriate public notice and hearing of ZC 19.17, the Planning Commission of the City of Fairhope, Alabama has forwarded a favorable recommendation; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA; 1. THAT, Article II, Section A.3. Director of Planning and Building be amended to read as follows: 3.Director of Planning The Director of Planning shall be the municipal zoning officer, or the zoning officer's representative whose duties shall be as follows: a. The Director of Planning is authorized and empowered on behalf and in the name of the council to administer and enforce the provisions of this ordinance including: (1) Receive applications; (2) Inspect premises, and issue certificates of zoning compliance, and certificates ofoccupancy for uses and structures which are in conformance with the provisions ofthis ordinance; (3) Interpret the meaning of the ordinance in the course of enforcement; (4) Propose zoning amendments as provided in this ordinance; and, (5) Advise the Planning Commission and City Council on implementation of the Comprehensive Plan. b. The Director of Planning shall keep records ofcertificates of occupancy issued, maps, plats and other documents with notations of all special conditions involved. He shall file and safely keep copies ofall sketches and plans submitted, and the same shallform a part ofthe records of his office and shall be public record. 2. THAT, Article III, Section C. 1 Table 3-2: Dimension Table - Lots and Principle Structure regarding lot coverage be amended to read as follows: Max. total lot coverage by all structures. 3. THAT, Article III, Section C.I., Table 3-2; Dimension Table - Lots and Principle Structure, b. regarding side setbacks and driveways be amended to read as follows: b. Where a driveway is in the side, and extends past the front ofthe principle structure, the side setback shall be 15Driveways shall not be within 3 feet of the side lot line. The area between the side lot line and driveway shall be vegetated and remain pervious. 4. THAT, Article III, Section C.2., Table 3-3: Dimension Table - Residential Accessory Structures be amended to add a column regarding separation between structures to read as follows:
