AN ORDINANCE DIRECTING THE LEASE OF CERTAIN
REAL PROPERTY AND DECLARING SAID PROPERTY TO
BE TEMPORARILY SURPLUS AND NOT CURRENTLY
NEEDED FOR PUBLIC OR MUNICIPAL PURPOSES
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA AS FOLLOWS:
Section 1. The location of the real estate that is the subject matter of this Ordinance is in
Baldwin County, Alabama and located at 451 Pecan Avenue, Fairhope, Alabama.
Section 2. The CITY COUNCIL OF THE CITY OF FAIRHOPE, has deteraiined that the
above described property is temporarily surplus and is not currently needed for public or
municipal purposes and pursuant to the authority granted by Section 11-47-21 of the Code
of Alabama of 1975, the Mayor is authorized to execute a lease of said property to TINY
PERFECT PRODUCTIONS, INC. for payment of $500.00 per month to the general fund.
Section 3. The terms of the lease shall be as follows:
1. The monthly rent shall be $500.00 payable per month in full on the
first day of the lease term or in a lump sum total.
2. Tiny Perfect Productions, Inc. shall also be required to deposit $500.00
as a refundable security deposit,
3. Tiny Perfect Productions, Inc. shall return the premises to the City in
the same or better condition as provided at the start of the term,
4. The lease term shall run from January 20, 2020 to March 20, 2020,
5. Monthly extensions to the lease may be provide given a five-day
written notice to the City,
6. Tiny Perfect Productions, Inc. has been given the opportunity to
inspect the premises and no warranties or representations are made as
to the functionality of the property.
Section 4. The sections, paragraphs, sentences, clauses and phrases of this ordinance are
severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall
be declared unconstitutional by a court of competent jurisdiction, then such ruling shall not
affect any other paragraphs and sections, since the same would have been enacted by the
municipality council without the incorporation of any such unconstitutional phrase, clause,
sentence, paragraph or section.
Section 5. This ordinance shall take effect immediately upon due adoption and publication
as required by law.
