HomeMy WebLinkAboutO-1666ORDINANCE NO. 1666 AN ORDINANCE TO ESTABLISH THE FAIRHOPE PUBLIC SCHOOLS COMMISSION AND ITS BYLAWS ARTICLE I -NAME AND PURPOSE Section 1. The name of the organization shall be the Fairhope Public Schools Commission. Section 2. The purpose of the Commission is to make written recommendations to the Baldwin County Superintendent of Schools with respect to the use of funds from two sources, each for the exclusive benefit of Fairhope Public Schools. The first source of funding shall be from the proceeds of the 3 mill Special School Tax District for a term of thirty (30) years, with payments due beginning October 1, 2020 and ending October 1, 2049. These funds shall be used for resources necessary to advance academic achievement in the classrooms, with a primary focus on instruction and instructional support. The second funding source shall be from the City of Fairhope for five (5) annual $300,000 installments beginning June 30, 2020 and ending June 30, 2024. These funds shall be used for educational enrichment. ARTICLE 2 -MEMBERSHIP Section 1. Each member of the Commission must be a registered voter in the Special School Tax District. The membership shall fairly represent all communities within the District, including communities within both the incorporated and unincorporated areas within the District, and the economic, gender and racial diversity of the District. Any member of the governing body of the City of Fairhope may be a member. Section 2. The Commission shall consist of nine (9) members appointed by the Fairhope City Council. Section 3. Regular terms shall be three (3) years and members are eligible for re­ election, but no member may serve more than two (2) consecutive three (3) year terms. Section 4. The first Commission shall include three (3) members who serve for one (1)year; three (3) members who serve for two (2) years; three (3) members who serve for three (3) years to begin staggered terms. Section 5. Resignations shall be in writing and delivered to the Chairperson by mail or email. Vacancies shall be filled by nominations from the Commission and appointment by the Fairhope City Council for the remainder of the vacated term. Section 6. The members shall elect a Chairperson, Vice Chair and Secretary. These officers shall serve one ( 1) year terms unless re-elected or successors are elected. Ordinance No. 1666 Page -2-ARTICLE III -MEETINGSSection 1. The Commission shall meet on the first Wednesday of each month at 4:30 p.m. in the Fairhope Public Library. All meetings shall be open to the public.Section 2. Special meetings may be called by the Chairperson or any five (5) members with seven (7) days written notice. Section 3. Notice of each meeting shall be given to each member by email or text message not less than five (5) days before the meeting. ARTICLE IV -RULES OF PROCEDURE Section 1. A quorum of five ( 5) members shall be required in order to conduct business, make and pass motions. Section 2. The Chairperson shall set the agenda, convene and preside over regular and special meetings. The Vice Chair shall preside over meetings in the Chairperson's absence and preside over special committees that may be designated from time to time. The Secretary shall preside over meetings in the absence of both the Chairperson and the Vice Chair, record the minutes of each meeting and distribute to each member prior to or at the next meeting and send out meeting notices and announcements. ARTICLE V -AMENDMENTS Section 1. These bylaws may be amended by a two-thirds majority of the members. Proposed amendments must be submitted to the Secretary and included in regular Commission announcements. Severability. The sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by a court of competent jurisdiction, then such ruling shall not affect any other paragraphs and sections, since the same would have been enacted by the municipality council without the incorporation of any such unconstitutional phrase, clause, sentence, paragraph or section. Effective Date. This ordinance shall take effect upon its due adoption and publication as required by law. ADOPTED AND APPROVED THIS 25TH DAY OF NOVEMBER, 2019 ATTEST: City Clerk
