AN ORDINANCE TO AMEND ORDINANCE NO. 1537
KNOWN AS THE SIGN ORDINANCE; CHAPTER 18.5 SIGNS; SECTION 18.5-3
SIGN PERMITS AND EXCEPTIONS; SPECIFICALLY (b) (10).
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
Section 1. The Code ofOrdinancc, City of Fairhopc, Alabama, Chapter 18.5 Signs;
Section 18.5-3 Signs Pennits and Exccplions; Specifically (b) (1), is hereby
amended to rcficct the following:
(b) The following activities and signs shall not require a sign permit:
(10) Temporary Off-Site Directional Signs arc allowed on the city right-of-way with these
limitations:
1. Only 2 temporary off-site directional signs may be placed per residential or
nonprofit activity, for the purj^osc of directing the public (e.g. real estate open
house, garage/yard sale, estate sale)
2. Placement of temporary off-site directional signs is only allowed between 5:00
p.m. Friday to 5:00 p.m. Sunday.
3. Temporary otT-sitc directional signs may not exceed 3 square feet and must be
constructed of sufficient weight and durability to withstand wind gusts, storms,
and other weather elements.
4. Temporary off-site directional signs must be placed in such a manner that they do
not interfere with the line of sight of the traveling public. Any sign that interferes
with the line of sight of the traveling public is subject to removal and disposal by
the City.
5. Temporary off-site directional signs shall not be attached to any trees, fences,
utility poles, light poles, street signs, or any other public facility located within the
City right-of-way
6. Temporary off-site directional signs shall not be placed in any City flower beds or
beautification areas, as defined.
a. Beautification Areas are the Ibllowing:
1) City maintained ilowcr beds
2) Central Business District
3) City parks/roads abutting City parks
4) Fairhopc Avenue at U. S. Highway 98
5) Fairhopc Avenue at State Highway 181
6) Morphy Avenue at U. S. Highway 98
7) Roundabouts/Medians
7. The City may at its discretion remove and discard signs not in compliance.
The balance of Section 18.5-3 Signs Permits and Exceptions remains as written and
codified.
Severability Clause - if any part, section or subdivision of this ordinance shall be held
unconstitutional or invalid for any reason, such holding shall not be construed to invalidate or
impair the remainder of this ordinance, which shall continue in full force and effect
notwithstanding such holding.
Effective Date - This ordinance shall take effect immediately upon its due adoption and
publication as required by law.
