BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
SECTION 1. That the City of Fairhope does hereby create and
establish a public library to be known as Fairhope Public Library
SECTION 2. That the City of Fairhope does hereby reserve
and allocate that space in the City of Fairhope which they have
received from the Fairhope Single Tax Corporation, for the use
and occupation of said Library.
SECTION 3. That said library shall be under the management
and control of a Board of Trustees, which shall consist of five
members. The membership of said Board shall be constituted and
shall hold office until their respective terms expire as follows:
One member -- five years
One member -- four years
One member -- three years
One member -- two years
One member -- one year
said terms to run from the date of the passage of this ordinance,
and each of said members shall hold office until their successors
shall be elected as hereinafter provided. Upon the expiration
of the term of each member as hereinafter designated a successor
shall be elected for a period of five years from the date of ex-
piration of said member's present term, by the City Council of th
City of Fairhope, Alabama, and in the event of a members vacating
the Board prior to the expiration of said terms, such vacancy
shall be filled by the City Council of the City of Fairhope,
Alabama, for the remaining portion of said term by electing a
successor to fill said unexpired term. No trustee shall receive
any pay or emolument for services as trustee.
SECTION 4. The Library Board (Board of 'Trustees) shall keep
or cause to be kept, proper books and accurate accounts, showing
the receipts and disbursements of all funds belonging to the
Fairhope Public Library. The Library Board shall have full
authority, in behalf of the City, to take charge of, control, and
manage all securities and money. Such Board shall have full powe
to invest and reinvest such funds, and securities; provided, that
only such investments are made as are usual and customary for
trust funds of similar character and subject to the laws of the
State of Alabama governing same.
SECTION 5. All gifts, devises and bequests, or the proceeds
thereof, heretofore made, or which may in the future be made, to
the Fairhope Public Libury, unless otherwise designated by the
donor, shall be considered. a part of the principal of the trust
fund and the income therefrom only shall be expended by the
Library Board.
SECTION 6. The Library Board shall have authority to select
and employ a librarian for the Fairhope Public Library and all
other employees pertaining to the operation thereof and to fix
their compensation. The Librarian and all other employees
employed under the provisions of this section shall be subject to
the control of and replacement by the Library Board.
SECTION 7. The Library Board shall have at least four
regular meetings each year at the Fairhope Public Library. The
minutes of such meetings shall be duly and properly kept and
preserved.

SECTION 8. At least once a year an audit shall be made, by
an auditor designated by the City Council of the City of Fairhopi
Alabama, of all the records, books, accounts a.nI transactions of
the Library Board the preceding year. A certified copy of such
audit shall be filed with the City Clerk at the City Hall in
Fairhope, Alabama, and made a part of the permanent records of
the City of Fairhope, Alabama. In addition thereto, the Library
Board shall cause to be kept available for inspection by the
City Council, at all reasonable times, a full and accurate
statement of all assets and liabilities of the Fairhope Public
Library, including the receipts and expenditures, together with
vouchers for same and shall make, or cause to be made, an
accurate report to the City Clerk whenever the City Council may
so request.
