Motion by Councilman Boone, seconded by Councilman Nelson
that Ordinance #315 be introduced and request unanimous consent
for immediate adoption.
II:PROVEI,IENT ORDINANCE NO. 315
An ORDINANCE TO PROVIDE FOR CERTAIN IMPROVEMENTS
ON PENSACOLA AVE.IN THE CITY OF FAIRHOPE, ALABAAIA.
BE IT OADAII'ED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
Alabama, as follows:
Section 1. That the following described street in the City
of Fairhope, Alabama, shall be improved as hereinafter provided
between the respective terminal points hereinafter set forth:
(a) PEISACOLA AVEIJUE shall be improved from the east edge
of the proposed pavement on Ten--aw Avenue to the north edge of
proposed pavement on Seminole Avenue, a distance of 450 linear
f`ca�;y as follows: Both edges of a 20 foot roadway, the center
I.-i'l 3 of 7?Thl ct-). shall be approximately 16.5 feet southwest of the
centerline of the above described portion of said street, shall
be graded, paved, drained and concrete curb and gutter constructed
along each edge of the pavement; that the pavement shall be one
and one-half iriah compacted Plant Mix Bituminous Wearing Course
composed of mineral aggregate and asphalt oemcnt on a six inch
sand clay base; that the curb and gutter shall be constructed of

on file in the office of the City Clerk where property owners
who may be affected by such improvements may see and examine the
same.
Section 3. That the improvements hereinabove described shall
be made in accordance with the grades shown in the plans and
specifications heretofore established and now on file in the City
Hall.
Section 4. That the cost of constructing said improvements
shall be assessed against the property abutting on the portions
of the streets so improved, provided:
(a) That the cost of improving any intersection or any
part thereof shall be assessed against the lots or parcels of
land abutting on each of the streets, avenues, alleys or other
highways so intersecting for a half block in each direction there-
from; provided that for the purpose of computing assessments, no
block shall be considered as extending more than 1,000 feet from
any intersection so improved.'
(b) That no assessment shall exceed the cost of the im-
provements or the increased value of such property by reason of
the special benefits derived from such improvements.
Section 5. That the City Council shall meet on the 28th
day of October, 1963, at 7:30 o'clock, P. M. at the City Hall in
the City of Fairhope, Alabama, to hear any objections, remon-
strances or protests that may be made against said improvements,
the manner of making the same or the character of materials to
be used.
Section 6. This ordinance shall be published once a week
for two consecutive weeks in the Fairhope Courier, a newspaper
published and of general.circulation in the City of Fairhope,
Alabama, the date of the first publication to be not less than
two weeks before the 28th day of October, 1963.
Section 2. A copy of this ordinance shall be sent by regis-
tered mail, postage prepaid, to the persons last assessing for
City taxation the property which may be assessed for said improve-
ments, at their Z�xst known addresses, said notices to be so mailed
by the City Clerk not less than ten days prior to the 28th day of
October, 1963.
Upon being put to a vote the following vote was recorded: For:
Mayor Joe Schneider Councilman Boons. Gaston, Nelson, Poser, and
$pader. Against: done. Motion carried.
