HomeMy WebLinkAboutO-279ORD I NANCE # 27,9 BE IT ORDAI NED BY THE C I TY COUNC IL OF THE C ITY OF FA IRHOPE., ALABAMA: SECTION I. That a1.1 fines imposed by the Recorder shall be paid in lawful money of the United Statesof America. SECTION 2. That all fines„ penalties, forfeitures and recoveries for violation of any law or ordinance of the City shall be for the use and benefit of the City unless otherwise expressly provided. SECTION 3. That upon each conviction in the Recorded e. Court of the City for a violation of any ordinance of the City there shall be taxed against defendant as court costs the sum of Six Dollars -and Seventy-five cents.($6.75); provided that in any case where the fine imposed by the court does not exceed: Six Doi Lars and Seventy-five C ents.($6.75), the cost taxed shallbe equal to but not greater than the fine imposed; provided further that in all cases which are not-prossed before conviction, the court may,, in the discretion of the Judge, tax no cost,. or any sum not Fn excess of $6.75.. SECTION 4. That no part of the costs nor any of the fees due any officer in any case or proceeding for a violation of, the City laws shall be taxed against or be paid by the City. SECTION 5. That,, whenever any person is triedorn the complainyt of another and is acquitted:,. the Recorder may, if he is satisfied; that the complaint is frivolous or mailici,ous, tax the party making the same with a I' l,, or any part of the costs, at his discretion, and -the same sha li I. be collected as other costs. All: laws or ordinances in conflict herein are hereby repealed, and this ordinance shall g o into effect 15 days after its publication. Adopted this the 12th day of June, 1,961.
