BE IT ORDAINED BY THE CITY COUNC I L OF THE CITY OF FAI RHOFE, ALABAMA, AS FOLLOWS::
SECTION I. As used in this ordinancit the term CiviI Defense shaII include
measures for the mobilization, organization and direction of the civilian
population and mecessary support agencies to prevent, or minimize, the effects
of fire, flood, earthquake and epidemic, as well as the effects of a neclear
war, or any subversive activities against the populace, communities, industrial
plants, fac i I i;t i es and other i nstal, l at i cn s.
SECTION 2. POWERS AND DUTIES. It shall be the duty of the Fairhope Civil
Defense Organizat on, and it is hereby empoweredr
a. To develop a Municipal Civil Defense Operational Survival Plan.
This plan shall provide for the effective mobilization of all
.resources of the municipality, both private and public.
tr. To prepare and recommend for consideration by the Council ordinances
necessary to implement the Civil. Defense Operational Survival Plan.
c. To consider and recommend to the Council for approval, all Mutual
Aid Plans and Agreements.
d. Other (as may be determined locally)
SECTION 3. C IV I'L DEFENSE DIRECTOR. There is hereby created the Office of
the Fairhope C i v i I Defense Director. Such off icerr shad I be nominated
by the Mayor, and approved by the:C ouncil. The Civil Defense Director
is hereby charged:
a. To represent the Mayor on all matters pertaining to Civil Defense.
b. During periods of emergency to direct the services of all
Mun tc i pal Civil Defense Forces.
c, To obtain and utilize cooperation of Fairhope officials in
the preparation and implementation of all Civil Defense Oper—
ational, Survival Plans.
d. During periods of emergency to obtain vital supplies and equipr
ment needed, for the protection of life and property of people.
SECTION 4. CIVIL DEFENSE ORGANIZATION
GENERAL. Officers and employees of the municipality of Fairhope, with
volunteer forces entolled, to aid them during an emergency, arld all groups,
organizations: and persons who make the agreements on operation of law, be
charged with duties necessary for the protection of life and property in the
City of Fairhope during an emergency.
SECTION 5. VOLUNTEERS
All persons, other than officers and employees of the municipality, volunteering
in service pursuant to complA eance with this ordinance, shall serve with, or
without compensation. While engaged in such service they shall have the same
immunities as persons and employees of the municipality performing similar
duties,
SECTION 6. This ordinance is hereby declared to be an emergency measure,
necessary for the immediate preservation of public business, health and safety,
and Tt shall take effect immediatley. A complete and adequate Civil Defense
Operational Survival Plan will be formulated at once. This plan will be based
upon plans formulated by and in the Alabama Operational. Survival PVan.
SEC TI'ON 7. Where provisions of this ordinance are in conflict with existing,
local laws, the provisions of this ordinance will govern, and such provision
of existing laws., with which provisions of this ordinance are in conflict, are
hereby rescinded.
