HomeMy WebLinkAboutO-251ORDINANCE NO. 251, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA: SECTION ONES Whereas, the harbor at Fly Creek within the corporate limits and police jurisdiction of the City of Fairhope has been improved by the United States Government at the instance of the City of Fairhope, and the City of Fairhope owns lands butting on such harbor, and as a con— dition for the improvement of such harbor the United States Government requires a municipal authority to provide and maintain without cost to the United States Government, mooring facilities and utilities, including a public landing, suitable supply facilities, open to all on equal terms, provide parking area and z-n all—weather access road to the public harbor facilities, maintain the existing timber jetty, and establish a competent and properly constituted public bddy empowered to regulate the use, growth, and free development of the harbor facilities with the understanding that the harbor facilities will be open to all on equal terms;: NOVI THEREFORE, the City of Fairhope being thereunto duly authorized and empowered under the laws of the State of Alabama, does hereby take and assume full jurisdiction, power and authority over the harbor at Fly Creek and will operate'and maintain such harbor and will provide and maintain, without cost to the United States, necessary mooring facilities and utilities, including a public landing with suitable supply facilities open to all on equal terms; provide a parking area and an all—weather access road to the public harbor facilities;: maintain the existing timber jetty; and will regulate the use, growth, and free development of the harbor facilities with the purpose and to the end that said facilities will be open to all on equal terms,
