Present were Council President Pro Tempore Jack Burrell, Councilmembers: Joshua Gammon, Jay Robinson, and Andrea Booth, City Attorney Marcus E. McDowell, and City Clerk Lisa A. Hanks. Council President Jimmy Conyers and Mayor Sherry Sullivan were absent. There being a quorum present, Council President Pro Tempore Burrell called the meeting to order at 6:06 p.m.; and introduced Mike Turner who is a member of the Unity on the Eastern Shore Church. He retired and moved to Fairhope in 2007 after 27 years as a Federal Law Enforcement Executive. He is internationally recognized as a poet and songwriter, was the Alabama Poet of the Year in 2025, is the President of the Pensters Writing Group here in Fairhope, and is President Elect of the Alabama Poetry Association. The invocation was given by Mike Turner of the Unity on the Eastern Shore Church, and the Pledge of Allegiance was recited. Councilmember Robinson moved to approve minutes of the May 26, 2026, regular meeting; and minutes of the May 26, 2026, work session. Seconded by Councilmember Booth, motion passed unanimously by voice vote. Council President Pro Tempore Burrell also recognized Pam Caudill, who accompanied Mr. Turner, and has given a lot of her time, efforts, and talents the City. Council President Pro Tempore Burrell said she served with him on the Airport Authority for many years; and appreciates her service to the City. Councilmember Gammon thanked City Treasurer Kim Creech for her report; and commented that revenues have increased by 60 % since 2018. Councilmember Gammon said he would like to meet with her and go over the numbers in more detail. He said there have been a lot changes the last few years; and look forward to my engagement with you. He said there may be some potential changes. Councilmember Robinson announced there are some Fairhope Baseball Teams playing for District Championship. He said 8U is playing in Fairhope; and 7U and 11U are playing as well. Council President Pro Tempore Burrell announced the Fairhope Airport Authority meeting on Tuesday at 5:00 p.m. Page 5 of 216 8 June 2026 Councilmember Robinson introduced in writing an ordinance to Approve an Application from Mary Lee Matzenger for a Franchise Agreement for Teaching Tennis Lessons at the Mike Ford Tennis Center. Due to lack of a motion for immediate consideration, this ordinance will layover until the June 22, 2026 City Council meeting. He asked for the City Council to meet with Mayor Sullivan and with Tennis Professional Tomas Catar to discuss this matter. Councilmember Robinson introduced in writing an ordinance amending Ordinance No. 953 and Ordinance No. 1658; and Repealing and Replacing Ordinance No. 1745; and Amending Chapter 21, Article III, Water, Replacing Section 21-32 Connection Fees and Expenses, Fairhope Code of Ordinances with an effective date of August 1, 2026. Councilmember Gammon said for all new or unpaid applications. Councilmember Robinson restated “with an effective date of August 1, 2026 for all new or unpaid applications.” Due to lack of a motion for immediate consideration, this ordinance will layover until the June 22, 2026 City Council meeting. Councilmember Gammon introduced in writing an ordinance amending Ordinance No. 953 and Ordinance No. 1657; and Repealing and Replacing Ordinance No. 1746; and Amending Chapter 21, Article IV, Sewer, Replacing Section 21-52 Connection Requirements and Connection Fees, Fairhope Code of Ordinances with an effective date of August 1, 2026 for all new or unpaid applications. Councilmember Gammon introduced in writing, and moved for the adoption of the following resolution, a resolution that the City of Fairhope gratefully accepts the Statutory Warranty Deed from Daniel Realty Company, LLC for the Water Tower Site property and a 30' Access and Utility Easement; and authorizes Mayor Sherry Sullivan to sign any documents necessary to complete the transfer. Page 12 of 216 8 June 2026 RESOLUTION NO. 5844-26 WHEREAS, the City of Fairhope is in the process of completing its “Fourth of July Fireworks Display” and is desirous to add an America’s 250th Anniversary Finale; and WHEREAS, the City of Fairhope is desirous to continue its partnership with the Baldwin Community and Economic Foundation the 501c3 arm of the Baldwin County Economic Development Alliance, the University of Alabama, and Coastal Alabama Community College to operate an Entrepreneurial Development Center (“Hatch”) in space soon to be located in the K-1 Center Building; and WHEREAS, there is funding available for said projects through Community Development Grants from Energy Southeast, Inc. f/k/a Alabama Municipal Electric Authority (AMEA) with a total grant amount of $30,000.00; and WHEREAS, the Energy Southeast grant does not require a match, but does require a letter requesting the grants with an outline of the purpose and intended community/economic development project, program, and/or initiative. NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the City of Fairhope authorizes the Mayor to submit a letter to Energy Southeast, Inc. requesting a total of $30,000.00 through Community Development Grants: $3,000.00 to be used for an America’s 250th Anniversary Fireworks Finale; $20,000.00 to be used for operating an Entrepreneurial Development Center (“Hatch”); and the remaining $7,000.00 to be determined. Hanks, MMC City Clerk Page 14 of 216 STATE OF ALABAMA ) ( : COUNTY OF BALDWIN ) ( The City Council met in a Work Session at 4:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 8 June 2026. Present were Council President Pro Tempore Jack Burrell, Councilmembers: Joshua Gammon, Jay Robinson, and Andrea Booth, City Attorney Marcus E. McDowell, and City Clerk Lisa A. Hanks. Council President Jimmy Conyers and Mayor Sherry Sullivan were absent. Council President Conyers called the meeting to order at 4:00 p.m. The following topics were discussed: • The first item on the Agenda was First Tee Gulf Coast presentation by Golf Pro Bobby Hall and Marty Stanovich, President and CEO of First Tee . This program is to promote junior golfers. Mr. Stanovich said they are a non-profit organization who uses the First Tee Nine Core Values: honesty, integrity, sportsmanship, respect, confidence, responsibility, perseverance, courtesy, and judgment. He said Judge Snedeker called him about First Tee; and mentioned they look at safety first and risk management. Council President Pro Tempore Burrell questioned what is required of the City of Fairhope and the Quail Creek Golf Course. Mr. Stanovich replied we will work with staff and the Golf Pro. Coaches were questioned regarding pay; and the answer was some are paid and some are volunteers. • The Presentation of the FY26 Mid-Year Financial Review was presented by City Treasurer Kim Creech; and she answered any questions if needed. (See attached Power Point Presentation titled “Financial Reports Six Months ended March 31, 2026”) • The next Agenda Item was the Discussion of the Proposed Ordinance to Establish the Service Territory for New Connections to the City of Fairhope ’s Sanitary Sewer Wastewater System and to repeal Resolutions No. 4950-23 and 4986-24. Utility Engineer Noel Berry and Attorney Chris Williams explained the Ordinance with inside and outside territory. Council President Pro Tempore Burrell said we can undo what we have adopted if we need to. Councilmember Robinson said we should lock in and not have any exceptions. Planning Director Hunter Simmons commented we are not changing density or territory at this time. Mr. Williams said it define s what is inside and outside the City Limits. Mr. Berry explained what would be allowed; and said we will put the Territory Map on the website and mark “proposed.” The consensus of the City Council was to move forward with the Territory Ordinance and Map. • Councilmember Gammon said he missed the Tree Committee and has no other meeting updates. Page 15 of 216 Monday, 8 June 2026 Page -2- • Councilmember Robinson stated the Fairhope Historic Preservation Commission received notice that the City of Fairhope now is a Certified Local Government after resubmission of our application and newly amended ordinance. • Councilmember Booth gave a shout out to Public Works Director John Thomas and his Staff for their cleanup after the storm. • Councilmember Burrell said the Fairhope Airport Authority meeting is tomorrow night. • Utility Engineer Noel Berry addressed the City Council regarding Agenda Items No. 6, No. 7, No. 8, and No. 9; and answered any questions if needed. The consensus of the City Council was to make the effective date August 1, 2026 for all new or unpaid applications. • Councilmember Robinson addressed the City Council regarding Agenda Item No. 5; and answered any questions if needed. He commented that a Recreation Board member applied for a Franchise Agreement to teach tennis lessons. He said that the Recreation Board was not comfortable making a recommendation to the City C ouncil for a couple of reasons: 1) conflict of interest and 2) not enough information and did not know the content of Tennis Professional Tomas Catar’s agreement with the City. Councilmember Robinson said Mr. Catar does teach tennis lessons to that age group. Councilmember Robinson commented that one other person has a Franchise Agreement at the request of Mr. Catar. He said nothing is preventing us to grant the Franchise Agreement for teaching lessons and training. SITE HISTORY To the best of Staff’s knowledge, there are no previous Planning Commission, BOA, or City Council cases attributed to this site. STAFF COMMENTS The current application is a request for zoning change from R-4 to R-1, and as such a development plan was not submitted nor required. Article III of the City of Fairhope Zoning Ordinance defines R-1 and R-4 Districts and allowed Uses as follows: R-1 Low Density Single-Family Residential District: This district is intended to provide choices of low- density suburban residential environment consisting of single -family homes on large parcels of land. It is sub- classified into four categories (R-1, R-1a, R-1b, and R-1c) based on lot sizes. R-4 Low Density Multi-Family Residential District: This district is intended to provide a medium high density single-family structure and two to four family units to a building structure. Since this is a request for re-zoning a development plan was not submitted nor required. Nonetheless, a lower density zoning district is appropriate for this area due to the fact that the subject property is surrounded by city zoned, lower density residential districts. Across Morphy Avenue is a bevy of RA (3 acre) zoned parcels as well. Subject property is 131,551.2± SF or 3.02± acres. R-1 lots are required to be at least 15,000 SF. The proposed R-1 zoning district will, at most, yield eight (8) dwelling units. The Applicants’ intent with the request is to subdivide the parcel into four (4) lots to be utilized for four (4) single-family residences. In contrast, R-4 allows up to 7 units/acre. Three (3) acres in R-4 could yield up to 21 dwelling units. Wetlands The Applicant did not submit a wetland delineation with the application . Baldwin County GIS does show a small area of “potential wetlands” (see exhibits) along the eastern boundary of the parcel that will need to be addressed with any proposed development. The total connection fee is a combination of costs that include a System Development Charge (SDC) and an Installation Fee (Tap Fee). The SDCs, for each new service, is to recover costs relating to the capital investment required to provide the source water (groundwater wells), treatment facilities and ground or elevated storage tanks and capital funding necessary to expand said facilities. The fee will also provide capital funding for capacity improvement projects where growth or hydraulic capacity requirements to support needed fire flows are recommended. 1. The owner of the property requesting service shall be responsible for providing Water connection to the property. The City of Fairhope may connect the property to Water service at the fees shown in the Connection (Tap) Fees Schedule if Water is immediately available, may provide a cost estimate of labor, materials, and any repair of concrete or asphalt to the owner for the work if Water is not currently available, or based upon capacity or location limitations, may state that Water is unavailable for the property. All taps into Water mains shall be performed by a vendor approved by the City of Fairhope Utilities Water/Wastewater Superintendent. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: Section 1. Fairhope Resolutions No. 4950-23 and 4986-24 are hereby rescinded. Section 2. The Code of Ordinances, City of Fairhope, Alabama, Chapter 21, Article IV. Sewers is hereby amended to reflect the following changes and additions: ARTICLE IV. SEWERS The City of Fairhope hereby defines its sanitary sewer wastewater territory (herein “Sewer Territory”) as set forth in the map attached as Exhibit “A” to this Ordinance which is incorporated herein. The map showing the Sewer Territory will also be published and maintained on the City’s website. Notwithstanding other requirements set forth and codified in the Fairhope Code of Ordinances and except as set forth herein, no new availability letters will be issued for land outside of the Sewer Territory and no new connections to Fairhope’s Sewer System will be permitted outside of the Sewer Territory. In addition to other requirements set forth and codified in the Fairhope Code of Ordinances, property located outside of the City of Fairhope Corporate Limits, but contiguous to the Corporate Limits, must be annexed into the City of Fairhope to be eligible to connect to Fairhope’s Sewer System. The duration of this Ordinance shall be from the effective date of this Ordinance through March 19, 2026. B.For the duration of this Ordinance, the Director of Planning and the Planning Commission may not accept or consider any new MOP application that contains three (3) or more residential dwelling units or any new subdivision application that contains three (3) or more residential lots smaller than 10,500 square feet per lot. The Client will hold harmless and indemnify JADE Consulting, LLC for any design changes, construction changes, and/or damages resulting from the use of a topographic survey or other information prepared by others and provided by the Client. 8. JADE Consulting, LLC may subcontract consultants in the performance of any services described in this agreement. The project includes key resiliency components, including construction of shoreline stabilization structures at the north end of Magnolia Beach Park. This work consists of an offshore segmented breakwater system integrated with a major beach nourishment project. The primary objective is to provide long-term stabilization of the highly visible sandy shoreline while enhancing infrastructure protection. Vegetative plantings at appropriate elevations (generally above +4 to +5 feet MLLW), in conjunction with the minimum beach template, will help reduce wind-blown sand. Salt-tolerant species such as sea oats may not be necessary at these elevations along the bay. The project also includes the implementation of a formal, periodic beach profile monitoring program. This program will incorporate survey profiles established during the design phase (circa 2024) and at the start of construction (June 2026). The purpose is to better quantify the beach sand resource, including measuring sand loss following storm events. Post-construction monitoring is expected to be required by permitting agencies and may include a minimum of 26 months of data collection and reporting. Updated Survey Findings and Cost Implications Due to the extended permitting process, a significant time gap occurred between the design survey and the contractor’s pre-construction survey. Among other things, GOMESA provides for enhanced sharing of leasing revenues with Gulf producing states and the Land & Water Conservation Fund for Coastal Restoration projects. GOMESA authorizes uses of the proceeds for the following purposes: a. Projects and activities for the purposes of coastal protection, including conservation, coastal restoration, hurricane protection, and infrastructure directly affected by coastal wetland losses; b. Mitigation of damage to fish, wildlife, or natural resources; c. Implementation of a federally approved marine, coastal, or comprehensive conservation management plan; d. Mitigation of the impact of outer Continental Shelf activities through the funding of onshore infrastructure projects; and e. Planning assistance and the administrative costs of complying with GOMESA. Project Description: City of Fairhope Magnolia Beach Renourishment The City of Fairhope is located in Baldwin County on the eastern shore of Mobile Bay, encompassing 12 square miles of land. The 2020 U.S. Census Bureau estimated a population of 22,477, up from 15,326 in 2010, showing a population increase of over 30%, making Fairhope one of Alabama's fastest growing cities. There is an urgent need to preserve the city's natural resources, especially the pristine beach areas, while accommodating growth and increased tourism. Tourism to the City of Fairhope has increased substantially, now representing a major component of the city's economy. Held each March since 1952, Fairhope's Arts and Crafts Festival brings in about 275,000 visitors and an $8 million-dollar economic impact annually. Thousands of pedestrians also enjoy the Alabama Coastal Bird Fest held each October and First Friday Art Walks are held monthly. Amendment No. 2 - Exhibit No. 2 Page 1 of 6 Page 185 of 216 GOMESA GRANT AGREEMENT G-CFMB/23/CF Page 2 of 6 Rev. 11/1/2023 In 2016, the City of Fairhope conducted a study and prepared a conceptual plan to restore and permanently stabilize the beach at Magnolia Beach Park. The Magnolia Beach Park is located half a mile south of the Fairhope Municipal Pier and consists of half a mile of shoreline (Figure 1). Erosion along the Magnolia Beach Park has been an on-going concern for many years. In the past 15 to 20 years, beach erosion has threatened some of the city's infrastructure at the north end of Magnolia Beach Park and the city has performed regular and costly beach nourishments in lieu of building a bulkhead to maintain the beach. See Figure 2 for images of the erosion, which shows the undercutting to the existing bluff. The City of Fairhope will utilize these funds to restore and stabilize Magnolia Beach Park. The project will encompass several tasks, including coastal engineering, design, and permitting, as well as the construction of a shoreline stabilization project at the north end of Magnolia Beach Park that includes an offshore segmented breakwater system in conjunction with a major beach nourishment project. The purpose is to stabilize the highly visible sandy beach shoreline while providing more permanent infrastructure protection (Figure 3). The project will also include a vegetative component at the appropriate locations, essentially above +4 to +5 feet mean lower low water. Plantings will be in conjunction with the minimum beach template to emulate some of the existing areas, to reduce wind-blown sand issues. The configuration of the proposed plan as shown in Figure 3, includes the installation of two shore parallel, rock breakwaters, with the intention of slowing erosion and retaining the newly placed sand. The primary purpose of the rock breakwaters will help stabilize a new sand fill to protect the small upland bluff in a more permanent configuration, one which will provide a wider beach in the form of small pocket beaches and stable slope up to the bluff elevations which can be vegetated to reduce wind-blown sand. A total of 9,259 cubic yards of clean, compatible, beach sand will be placed within the northernmost 400-500 feet at Magnolia Beach Park. The rock material and configuration for the breakwaters will be selected based on a coastal engineering analysis of the site conditions and using headland pocket beach principles. There will be significant public outreach needs concerning the aesthetics of the project as well as significant coordination with resource agencies in the permit application and evaluation process. The City of Fairhope will be contributing its own funds to the project to provide for post-completion monitoring to track project performance. The Comprehensive Conservation & Management Plan (CCMP) for Alabama’s Estuaries & Coast 2019-2023 seeks to improve ecosystem resilience through protection, restoration, and conservation of beaches, bays, and backwaters. The sand nourishment, addition of shoreline structures, and vegetation will also help reduce maintenance and reinforce a beach susceptible to erosion. In addition, Section 309(a)(3) of the Alabama Coastal Area Management Program (ACAMP) seeks to attain increased opportunities for public access to coastal areas of recreational, historical, aesthetic, ecological, or cultural value. Project Costs: Funding will be provided to the Grantee as two (2) installments.
