Box 300900 Montgomery, AL 36130-0900 Subject:NT SUBMISSION PACKET--FCC FORM 620 Downtown Fairhope SC 1 / 17636541 5 N Church St, Fairhope, Baldwin County, Alabama 36532 EBI Project No.: 260061232PR In accordance with the Federal Communication Commission (FCC) National Environmental Policy Act (NEPA) rules and Section 106 of the National Historic Preservation Act (NHPA), the above-referenced telecommunications project is being evaluated by EBI for its potential effects to districts, sites, buildings, structures, or objects significant in American history, architecture, archeology, engineering, or culture that are listed, or potentially eligible for listing in the National Register of Historic Places (NRHP). Based on EBI’s review of the characteristics and location of the proposed project, the project does not meet the exclusions stated in the “Nationwide Programmatic Agreement for Review of Effects on Historic Properties for Certain Undertakings Approved by the Federal Communications Commission,” dated September 2004 (“Nationwide Agreement”); therefore, the project is required to undergo Section 106 review with the State Historic Preservation Office. The proposed undertaking includes the installation of a new 38-foot light pole telecommunications facility. Per the FCC’s rules, the APE for Direct Effects is limited to the lease area, the underground utility easement, and the proposed access route and the APE-VE is a radius of 1/2 mile. In accordance with the Nationwide Agreement, please find the attached NT SUBMISSION PACKET--FCC FORM 620, which presents the details on the proposed project as well as efforts that have been taken to identify, assess, and make determinations of effect on the impacts of the proposed project on Historic Properties. The finding of effect is “No Adverse Effect on Historic Properties in the Area of Potential Effects-Direct Effects” and “No Adverse Effect on Historic Properties in the Area of Potential Effects-Visual Effects” with archaeological monitoring not recommended. Please refer to the FCC Form and associated attachments for complete details. We request your concurrence with this determination. Use this attachment to provide additional details needed to present a full and accurate description of any construction activities that will take place to complete the installation. The Subject Property, located near 5 N Church St, Fairhope, Baldwin County, Alabama, is situated within a mixed residential and commercial urban area. Development dates from the late 19th century and early 20th century and consists primarily of one and two-story retail buildings, office space, and residential homes. Surrounding improvements consist of paved roads, concrete and brick sidewalks, curbs and gutters, streetlight poles, landscaping, buried utility handholes, utility vaults, utility pedestals, storm drain inlets, and below ground utilities, including power, water, and sewer lines. Vegetation is comprised of modest landscaped and ornamental street plantings. Topography is relatively flat to hilly. The Subject Property consists of a portion of the right-of-way on the west side of N Church Street. It includes a 100 square foot lease area, the underground utility easement, and the proposed access route. Cellco Partnership and its controlled affiliates doing business as Verizon Wireless (Verizon Wireless) proposes to install a 38-foot streetlight-style telecommunications pole and support equipment within a 100 square foot lease area. Antennas will be top-mounted with an overall height of 38 feet, and a streetlight luminaire and associated equipment will be attached lower on the pole. Power will be routed underground from an existing utility pole south to the proposed pole. Fiber will be routed underground from a proposed handhole, which will be installed within the lease area. Access will be via the existing rights-of-way.Notethatestablishingtheaccessroutewillnotrequirenewgrounddisturbance.Thetotalarea of ground to be disturbed is approximately 871 square feet. On February 23, 2026, EBI Consulting completed a review of the available records as required per Section VI.D.2 of the Federal Communications Commission’s 2004 Nationwide Programmatic Agreement to identify historic properties in the APE for Direct Effects. I, Christopher Grant, M.A., RPA, Archaeologist II, with EBI Consulting (EBI), am providing an assessment of the archaeological potential of the Project Area. Drawings provided by the Applicant, historical and topographic maps, aerial and recent photographs of the Project Area, and other available data were reviewed to complete this assessment. Archaeology Sensitivity Assessment EBI Project #260061232PR Downtown Fairhope SC 1 5 N Church St Fairhope, Alabama 36532 1 2.0 The Project and Project Area The Project Area is located at 5 N Church St in Fairhope, Baldwin County, Alabama. Verizon Wireless proposes to install a 38' (11.6 meter [m]) Pole and support equipment within a 10' by 10' (3.05m by 3.05m) lease area. Power will be routed underground from an existing utility pole approximately 257' (78.3m) south to the proposed pole. Trenching for power is not anticipated to exceed 3' (0.9m) in width. Fiber will be routed underground from a proposed handhole, which will be installed within the lease area. Access will be via the existing rights-of-way (Site Plans, Figures 1-3). Per the FCC’s definition, the Area of Potential Effect-Direct Effects (APE-DE) consists of the 10' by 10' (3.05m by 3.05m) lease area, the underground utility easement, and the proposed access route. Note that establishing the access route will not require new ground disturbance. The total area of ground to be disturbed is approximately 871 square feet (80.9 square meters) (see Site Plans, Figures 1-3). Improvements to the Subject Property include a paved road, concrete and brick sidewalk, curbs and gutters, streetlight poles, landscaping, buried utility handholes, utility vaults, utility pedestals, storm drain inlets, and below ground utilities, including power, water, and sewer lines. The surrounding area is comprised of mixed urban residential and commercial development (see Site Plans, see Figure 3). Archaeology Sensitivity Assessment EBI Project #260061232PR Downtown Fairhope SC 1 5 N Church St Fairhope, Alabama 36532 6 4.0 Environmental Setting The Project Area location was evaluated for its potential for precontact and early historic use and settlement based on several environmental factors. These factors included, but were not limited to, proximity to existing or relict rivers or streams, particularly first order water resources and water confluences, distance to wetlands, location in relation to elevated landforms or other special environmental features, as well as recorded soil survey type and potential for disturbed soils based on modern development. The Subject Property is located on the Daphne, AL 1983 United States Geological Survey (USGS) 7.5’ Topographic Quadrangle. According to the Site Plans, the Subject Property is located at an elevation of 112.1' (34.2m) above mean sea level (msl). The topography of the Subject Property is relatively flat. The vicinity of the Project Area is characterized by a hilly urban environment (see Figure 1). Historical topographic quadrangles depict the Project Area as approximately 0.2 mile (0.3 kilometer [km]) northwest of the seasonally intermittent Stack Gully. In general, this distance to water resources would not have been attractive to precontact and early historic groups for long-term use or settlement. The Project Area is in the Southern Coastal Plain ecoregion (ecoregion 75) and falls specifically into the Gulf Coast Flatwoods subregion (ecoregion 75a). Along the coasts of Louisiana, Mississippi, and Alabama, the Gulf Coast Flatwoods form a slim belt of almost flat terraces and delta sediments made up of Quaternary-age sands and clays. Moist, sandy lowlands and wide, sometimes swampy depressions are typically covered with forests,whereasportionsofthemorewell-drainedterrainhavebeenconvertedtopasturelandoragriculture (EPA 2026). Information concerning the geology of the Subject Property was obtained from the USGS Ground Water Atlas of the United States, Alabama region (1990). The Subject Property is located within the Coastal Plain physiographic province, which is characterized by areas of low relief and consists of alternating and inter-fingering beds of clay, silt, sand, and gravel. The sequence is generally wedge-shaped and dips and thickens toward the Gulf of Mexico. The purpose of discussing soils within the context of an archaeological assessment is to identify the type of deposition that has occurred within the APE-DE and, therefore, how deep cultural resources may be anticipated. According to the Natural Resources Conservation Service's Web Soil Survey (NRCS), the dominant soil composition in the vicinity of the Project Area is classified as Malbis fine sandy loam, 0 to 2 percent slopes. Malbis soils occur on coastal plains and are derived from a parent material of loamy fluviomarine deposits over loamy to clayey fluviomarine deposits. The dominant soil composition within the northern portion of the utility route is classified as lakeland fine sand, 0 to 5 percent slopes. Lakeland soils occur on hillslopes and are derived from a parent material of sandy marine deposits derived from sedimentary rock (NRCS 2026). Typical profiles for these soil series are presented in the table below (NRCS 2026, OSD 2026). E horizons consist of an intermediate eluviated layer and also have the potential to bear cultural resource deposits. B horizons are the subsoil deposits, usually formed through illuviation. In archaeological terms, the subsoil usually predates most human occupations and dates to the latter part of the Pleistocene epoch, or approximately 12,000 years ago. Cultural resources could be anticipated to depths of 3 to 13 inches (7.6 to 33 centimeters) in the respective A horizons. However, given the extent of modern development, intact, significant archaeological materials are not anticipated at the Project Area. Archaeology Sensitivity Assessment EBI Project #260061232PR Downtown Fairhope SC 1 5 N Church St Fairhope, Alabama 36532 8 5.0 Known Archaeological Sites A review of files was requested from the Alabama State Site File Coordinator by Christopher Grant, MA, RPA,Archaeologist II,. The results were received on February 23, 2026 indicating that there are two registered archaeological sites within 1 mile (1.6km) of the APE-DE. Of these two sites, neither meet the FCC’s definition of a Historic Property for the purposes of this undertaking. The site location and a brief description are presented in the table below. Archaeology Sensitivity Assessment EBI Project #260061232PR Downtown Fairhope SC 1 5 N Church St Fairhope, Alabama 36532 9 Known Archaeological Sites Identified by Class I Research Site Number Site Name Description NRHP Status Distance from APE-DE 1Ba732 Locus 1 Historic trash feature; This site represents the location of a historic sample collection and a late nineteenth to mid twentieth century trash pit feature. This site is located 52 meters north if the intersection of Rairhope Ave and Church Street, and about 4 meters east of the sidewalk. This site fikely represents disregarded trash from the historic period. At the time of the site’s discovery, the area was partially covered by manicured grasses and partially covered by asphalt, with a large live oak tree to the northeast of the site. No Determination 50' (15.24m) east 1Ba733 Locus 2 Historic artifact scatter No Determination 400' (121.9m) east There are zero precontact sites and two historic-period sites recorded within the 1 mile (1.6km) search radius. The two historic-period sites consist of trash pits or artifact scatters uncovered during construction projects in downtown Fairhope. Both sites have been significantly disturbed by construction and modern development. Although site 1Ba732 is located 50' (15.24m) to the east of the APE-DE, the site has been significantly disturbed and its boundaries clearly delineated. At its closest point, the site is located across the N Church Street road right-of-way approximately 50' (15.24m) from the APE-DE. At this point, the APE-DE consists of a narrow utility trench. As a result, given the limited footprint of the APE-DE, this known site will not be affected by the proposed undertaking. Archaeology Sensitivity Assessment EBI Project #260061232PR Downtown Fairhope SC 1 5 N Church St Fairhope, Alabama 36532 11 6.0 Prior Cultural Resource Surveys This same review of files maintained by the Alabama State Site File Coordinator indicated that zero prior cultural resource surveys have been conducted within 1 mile (1.6km) of the APE-DE. Archaeology Sensitivity Assessment EBI Project #260061232PR Downtown Fairhope SC 1 5 N Church St Fairhope, Alabama 36532 12 7.0 Historical Map and Aerial Image Review A review of historical maps, topographic quadrangles, and aerial images was conducted in order to identify potential historic occupation and use of the Project Area. The earliest available topographic quadrangle from the early to mid-20th century depicts the Project Area as improved with the road right-of-way of N Church Street. The Project Area is situated within a developing urban environment (USGS 1939; Figure 4). In 1953, the Subject Property is again depicted as improved with the right-of-way of N Church Street and the vicinity of the Project Area is shaded to indicate an urbanized environment (USGS 1953; Figure 5). In the late 20th century, the Subject Property is again depicted as improved with the road right-of-way of N Church Street (USGS 1983; see Figure 1). A similar review of aerial images from 1940 through 2025 supports the observations above. In the earliest available aerial image from 1940, the Subject Property was shown improved with the road right-of-way of N Church Street. The surrounding street grid and urban development were in place by that time (NETR 2026; Figure 6). An aerial image from the present day (see Figure 3) shows the continued maintenance and improvement of the roadway and infrastructure, with the Project Area itself developed with cement sidewalks and asphalt paved roadways, and adjacent to utility poles and other modern infrastructure. Archaeology Sensitivity Assessment EBI Project #260061232PR Downtown Fairhope SC 1 5 N Church St Fairhope, Alabama 36532 13 8.0 Archaeological Sensitivity of the APE-DE The precontact sensitivity of the APE-DE is low and the historic sensitivity of the APE-DE is low. The Project Area is not located in a favorable environment for long-term use due to the distance from perennial water sources. This suggests that use of the area in the precontact period, if any, was likely transitory in nature. The Subject Property has been developed as part of downtown Fairhope since at least the early to mid-20th century, when the surrounding street grid was established and the vicinity developed for urban commercial and residential purposes. The Subject Property was developed with the road right-of-way of N Church Street by 1939. Further urbanization of the vicinity of the Project Area was apparent in the following decades. Although there are known historic-period archaeological sites recorded within close proximity to the APE-DE, these sites consist of trash pits or sparse artifact scatters that have been significantly disturbed and destroyedbyconstructionandmoderndevelopmentefforts.Thedevelopmentandsubsequentimprovement of the road, landscaping, and utility infrastructure would have impacted soils within the APE-DE beyond a depth of culturally sterile subsoil. Consequently, the probability of encountering intact,significant archaeological resources within the APE-DE is low. Archaeology Sensitivity Assessment EBI Project #260061232PR Downtown Fairhope SC 1 5 N Church St Fairhope, Alabama 36532 17 9.0 Pedestrian Survey No site visit was undertaken by an archaeologist per the 2004 FCC NPA Section V1.D.2.c, which states “the Applicant need not undertake a Field Survey for archaeological resources where: i. The depth of previous disturbance exceeds the proposed construction depth (excluding footings and other anchoring mechanisms) by at least 2 feet as documented in the Applicant’s sitting analysis; or ii. Geomorphological evidence indicates that cultural resource-bearing soils do not occur within the project area or may occur but at depths that exceed 2 feet below the proposed construction depth.” Based on a review of the soil data (please see Environmental Context above for details), coupled with the limited footprint of the undertaking, it was determined that the proposed undertaking meets the conditions of the 2004 FCC NPA Section V1.D.2.c. due to documented prior disturbance and recorded soil data for the APE-DE. Archaeology Sensitivity Assessment EBI Project #260061232PR Downtown Fairhope SC 1 5 N Church St Fairhope, Alabama 36532 18 10.0 Conclusion and Recommendations In light of available information, it is my professional opinion that there is little likelihood of encountering significant archaeological resources in association with this project. The precontact and historic archaeological sensitivities are low and the APE-DE has been extensively disturbed by construction, landscaping, and utilities placement (See Attachment 2 Photos; Figure 3). In addition, the limited proposed disturbance at the site and the minimal footprint of the project mitigate any archaeological sensitivity. This finding is supported by the extensive nature of the development at the Project Area. EBI's review of similar sites has found that the subsurface profile of the area is likely to be characterized by a non-homogeneous distribution of soil and fill types. Excavation, backfilling, and grading for the existing road, right-of-way, landscaping, and utilities placement would typically result in a varied subsurface profile that would have disrupted the setting and character of in situ cultural materials (See Attachment 2 Photos; Figure 3). Based on the review above, no Historic Properties have been identified within the APE-DE. In addition, no further archaeologicalworkisrecommendedforthisinstallationduetothelimitedproposedgrounddisturbanceand thepreviouslydisturbednatureoftheAPE-DEatgrade(supportedbySection106oftheNHPA36C.F.R.Part 800.4 (b) (1) and the 2004 FCC NPA Section V1.D.2.c). In the event that a concentration of artifacts or culturally modified soil deposits (including trash pits older than 50 years) should be encountered at any time during ground disturbing activities, all work must stop until a qualified archaeologist views the finds and makes a preliminary evaluation. If warranted, further archaeological work in the discovery area should be performed. Although unlikely, if unmarked burials or human skeletal remains are encountered as a result of construction, said activity shall cease immediately upon discovery until the Medical Examiner/County Coroner and a qualified archaeologist evaluate the remains.
