COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30, p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 10 February 1986.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Trisha (Nelson) Lo Porto, David E. Bishop, Michael A. Ford, and
Barney L. Shull; City Attorney James Reid and City Clerk Phillips.
No one was absent.
Councilman Roy C. White introduced the new minister of the
Fairhope Christian Church. The Reverend Warren Newman gave an
invocation.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 27 January 1986 regular session were
duly approved.
A fisherman, George Dana, requested permission to dock his
small 16-foot boat at the pier immediately north of the Municipal
Pier and to sell his catch to the public. Council asked about
advertising, Mr. Dana said only a sign on his boat or on his
pickup truck. Mr. Dana said he would only sell what he caught.
Councilman White moved that water be made available on the pier,
that fishermen may sell only their catch and must obtain a daily
permit at a charge of $5.00, to be issued on a day-to-day basis,
and this permission will be withdrawn if congestion or interference
with swimmers and boaters or sanitary problems arise. Seconded
by Councilman Shull, motion carried by the following vote: AYE -
White, Bishop, Ford, Shull. NAY - Lo Porto.
Council reviewed an application for a Restaurant Liquor License
by William Burgess IV, dba J JAYES DELI RESTAURANT, at 77 South
Section Street. There was police approval and no one present was
opposed to the license. Councilman Ford moved for approval.
Seconded by Councilman Shull, motion passed unanimously.
Councilman Bishop moved in favor of proclaiming February 26th
as Arbor Day in the City of Fairhope. A special program will be
held at 10:00, a.m., at the Municipal Complex, and free seedlings
will be distributed to Fairhope residents. Seconded by Council-
woman Lo Porto, motion passed unanimously.
Mayor Nix advised that seven people had expressed interest in
being appointed to the Fairhope Redevelopment Authority. They are
Dr. James R. Brylsky, Paul Raine, William Richmond, Garry Moore,
Terry Klein, Marsha Wolfe, and Rick Boone. Councilwoman Lo Porto
moved to say the Council would be favorable toward receiving an
application from these people. Seconded by Councilman Ford,
motion passed unanimously.

Councilman Shull introduced., and moved for the adoption of,
the following Resolution. Seconded by Councilwoman Lo Porto,
motion passed unanimously:
WHEREAS, the City of Fairhope did collect S38,828
for Business Licenses from concerns located in -
the Police Jurisdiction of the City; and
WHEREAS, the Fairhope Police Department did expend
the sum of $110,707 for police protection; and
the Volunteer Fire Department did expend the sum
of $4,089 for fire protection; in the Police
Jurisdiction of the City; THEN, THEREFORE
BE IT RESOLVED
That the expense of Fire and Police protection in
the Police Jurisdiction of the City of Fairhope,
Alabama, did exceed the revenue from Business Li-
censes issued to locations in said Jurisdiction.

Councilman Bishop moved to accept the low bid, provided all
specifications are met. Seconded by Councilman Shull, motion
passed unanimously.
Mayor Nix asked Council confirmation of his appointment of
Jack Lucy to the Planning & Zoning Commission to fill the unexpired
term of resignee Robert Mason, to May, 1988. Councilman White
moved to confirm. Seconded by Councilman Ford, motion passed
unanimously.
Councilwoman Lo Porto moved to hear the following business
not on the Agenda. Seconded by Councilman White, motion
passed unanimously:
Councilman Shull moved to void the contract award el to
Fathom Undersea Research & Engineering International Of Mobil
under Resolution No. 175-85 on 16 December 1985 for dredge
rental due to the contractor's inability to meet requirements
and to reoffer this rental contract for bids. Seconded by
Councilman Ford, motion passed unanimously I
Councilman Shull moved to pay bills as presented. Seconded
by Councilman Ford, motion passed unanimously.
