HomeMy WebLinkAbout01-13-1986 Regular Meeting717 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in -regular session at S:30, p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street., Fairhope, Alabama 36532, on Nlonday, 13 aTanuary 1986. Present i,weye Mayor James 1). Nix; Councilmembers Roy C. White, Trisha Nelson, David E. Bishop, Michael A. Ford, and Barney 1— Shull; City Attorney James Reid and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 23 December 1985 regular session were duly approved. A public hearing was hold as advertised an the rezoning re- quest by Fritz Crane. NIT. Crane's property is located on the west side of Greeno Road, north of The Busy Bec, at the Fair - hope Avenue intersection. The request is to change from R5 Heavy Density Multi -Family Residential to B4 Business and Pro- fessional Offices. No one present was opposed to the change. The Planning & Zoning Commission recommends approval. After some discussion, Councilman Wh.1to introduced an ordinance to change the Zoning. Councilman Bishop moved to suspend the rules so as to take immediate action on the adoption of this ordinance. Seconded by Councilman Shull-, motion to suspend passed unanimously by the following vote: AYE -Bishop, Shull, White, Nelson, Ford, and Nix. NAY -none. Councilman White then moved for the final adoption of Ordinance No.--762. Seconded by Councilman Bishop, motion passed unanimously by the following vote: AYE -Bishop, Shull, White, Nelson, Ford, and Nix. NAY -none. No one appeared to present a request from the Baldwin County Historical Society. Council discussed the cost -of -living increase for City retirees which had been a part of the November 2Sth regular session business. At that time, Council passed Resolution No. 172-8S which said the City would. approve the COL increase only if the Now ll`ngland plan retirees could be included with the State Employees' Retirement plan retirees. A letter from the State plan explained that they could not handle the New England plan retirees; a letter from the legal staff of the Alabama League of Municipalities advised that, should the City try to handle the Now England retirees by a direct payment plan from city funds, the City would be in violation of Section 68 of the Alabama Constitution. In view of this, Council decided to let Resolution No. 172-85 stand, which means no cost -of -living increase will be given to any City retirees. Councilwoman Nelson moved to have notice sent to local legislators advising of the unfairness of this COL Legislative Act. Seconded by Councilman Shull, motion passed unanimously. 13 January 1986 718 A report on the following bids for pipe for the CDBC drainage project was reviewed: For 360 LF of 18" BCCM pipe and 640 LF of 24" BC31 pipe: Vendor Total Price Choctaw Pipe, Inc 7,848.40 SACS Pipe Co., Inc 8,022.40 Thpire pipe & Supply $10,482.00 Councilman Bishop moved to accept the low bid, provided all spec- sifications are met. Seconded by Council -woman Nelson, motion passed unanimously. Council -man White moved to include the following areas in the sidewalk project: Bancroft Street from Magnolia Avenue to Fairhopc Avenue. Church Street from Fels Avenue to Nichols Avenue. M'obile Avenue from Pier Street to the southern City Limit. Gayfer Avenue from Section Street eastward until budgeted funds are used. Seconded by Councilwoman Nelson, notion passed unanimously. Councilwoman Nelson moved to hear the following business not on the Agenda. Seconded by Councilman Shull, motion passed unanimously: Councilman Ford moved to approve the following additions to and deletions from the Volunteer Fireman's Roster and the Police Reserve Roster as of effect.ive dates shown: VOLUNITHER FIRENEYF ADD: Bryon GI-illiand 1107/86 POLICE RESERVE, ADD: Sherman H. Sinith 1/13/86 Bill W. Fleming 1/13/86 R131AIE: Tony Wined 8/05/83 Michael A. Sandell 1/13/86 Danny York 1/13/86 Seconded by Councilman Shull, motion passed unanimously.
