HomeMy WebLinkAboutO-235ORDINANCE # 235 SOLICITATION OF FUNDS Section 1. Permit required; exceptions. It shall be unlawful for any person to solicit money, donations of money, property or financial assistance of any kind, or to sell or offer to sell any article, publication, ticket or subscription, on the statement or representation that such sale or solicitation is for charitable, educational, religious or philanthropic purposes, either in person or by telephone or in any manner in the city, unless such person shall hold a valia permit as hereinafter provided for. This section shall not apply to solicitation at the regular exercises or services of any church, religious society, lodge, benevolent order or fraternity, or any branch thereof, when such solicitation is made at a regular appointed meeting, or regular place of worship, or exercises of such church, religious society, loc{ge, benevolent order or fraternity. Section 2. heligious, educational or charitable Institutiop.s. It shall be unlawful for any person representing or claiming to represent any church, school, eleemosynary, charitable, social service or public institution of any kind to solicit subscriptions from the general public or to sell tickets or to canvass for advertising space on any program, booklet, pamphlet or other printed matter for the benefit or for the alleged benefit of any such institution without first obtaining a written permit from the commissioner of public safety. Section 3. Application for Permit. Any person desiring to solicit funds for any cause what- ever as provided in Section 1 shall file v,ith the commissioner of public safety of the city, and the Mayor and the City Yanager is designated as commissioner of public safety for the purposes of this ordinance, an application, duly sworn to by sorieone Guly authorized and having knowledge of the facts, containing the following information: (a) Name of the person or the organisation applying --for permission to solicit; names of the officers of such organi- zation, if any. (b) Purpose for which a solicitation permit is requested. (c) The time for which the permit is requested, and the metrods to be used in carrying on the solicitation. (d) The amount of any wages, fees, commissions or emoluments to be expended in connection with such solicitation and the names of all individuals authorized to receive money. .(e) Full statement of the character and extend of the charitable, religious or philanthropic work being done by the applicant within the City. (f) Such other information as the commissioner of public safety may require. Section 4. Granting of permits; curation; contents; appeals. The commissioner of public safety shall have the power to grant permits if the information filed under the last preceding sections is' found to be accurate, and the purpose is found to be worthy and bond fide. No permit shall be issued for a longer period ,than thirty days including Sundays and local holidays, but any permit may be renewed by the commissioner of public safety. Whenever a permit is denied to any applicant by the commissioner of public safety, such.applicant shall have the right to appeal to the commission of the City within five days from such denial. Section 5. Yisrepresentation of facts. It shall be unlawful for any person on his ov.n behalf, or as the representative of another, to swear fasely to any facts contained in the application provided for in this chapter or to file or cause to be filed any false affidavits. Section 6. hevocation of permit. The commissioner of public safety shall have the power to revoke any permit if it appears to him that the holder of the permit has violated any provisions of this chapter or has misrepresented or made untrue statements in conrection with the solicitation. A permit shall also be revoked by the commissioner of public safety is it appears that the permit is used cirectly or indirectly as an endorsement of the solicitation. , G,henever a permit is revoked by the commissioner of public safety, the person aggrieved may appeal to the city commission from such revocation within five days thereafter. Section 7. Solicitations by telephone. It shall be unlawful for any person, so^iety or association (including religious, fraternal, patriotic or charitable) to use the telephone as a means of soliciting another to make a donation, or to subscribe to or for advertising, or to give or pay money or other things of value for, or in return for, any ticket, flag, tam, badge, flower, token or symbol, or to use the telephone as a means of arranging an engagement for such solicitation for any purpose unless a permit to do so be first obtained from the commissioner of public safety. Section 8. Any person convicted of violating any provision of this ordinance shall be fined not less than $1.00 nor more than w100 for each conviction.
