ORDINANCE KO. 168
Be it Ordained by the Town Council of the Toxin
of Eairhope as follows:
Section 1. That any person, male or fertile, who
ganders or strolls about in idleness, or who lives in
idleness, or who loafs, loiters or idles, or reniins
in the Tope of Pairhope, Alabama, or within its police
jurisdiction without any regular employment# havin3 no
income producing property sufficient for his s3upport,
and for the support of his dependents, is hereby de-
clared to be a vagrant, and on conviction of vagrancy
shall be punished as provided in Title 379 Section
586 of the Code of Alabam of 1940.
Section 2. The tern "regular employment" as
used in the preceding section shall be construed to
Mean regular and continuous employment to the re,son-
able physical capacity and opportunity of each person
subject to the provisions of this Ordinance.
Section 3. In the prosecution for vagrr ncy,
whenever it sia.11 be established by the proof th-.t the
defendant has been guilty of wandering or strolling
about, or remaining in idleness during any working
day in any calendar reek, the burden "of proof shall
be upon the defendant to shod that he is not a vagrant
within the caaning of this Ordinance, or of any other
valid Ordinance, of the To%in of Bairhope.
Section 4. This Ordinance shall be in force and
effect from the date hereof until a ratification of a
troaty of pence betr7een the United States of America
and the Axis countries.
