HomeMy WebLinkAbout10-27-2025 City Council Meeting MinutesSTATE OF ALABAMA COUNTY OF BALDWIN )( )( The City Council, City of Fairhope, met in regular session at 6:00 p.m., Fairhope Municipal Complex Council Chamber, 16 1 North Section Street, Fairhope, Alabama 36532, on Monday, 27 October 2025. 11099 Present were Council President Jack Burrell, Councilmembers: Corey Martin, Jimmy Conyers, Jay Robinson, and Kevin Boone, Mayor Sherry Sullivan, City Attorney Marcus E. McDowell, and City Clerk Lisa A. Hanks. There being a quorum present, Council President Burrell called the meeting to order at 5: 12 p.m. Council President Burrell stated that Agenda Item No. 8 was being pulled and Agenda Item No. 19 should read "age 65 and over." The invocation was given by Assistant Pastor Pat Davey of Eastern Shore Presbyterian Church, and the Pledge of Allegiance was recited. Councilmember Boone moved to approve minutes of the October 13, 2025, regular meeting; and minutes of the October 13, 2025, work session. Seconded by Councilmember Robinson, motion passed unanimously by voice vote. Mayor Sullivan addressed the City Council regarding Councilmembers Boone and Martin. She thanked both of them for their service. She briefly went over the projects that were completed in each Councilmember's years of service on the City Council. Councilmember Boone served on the City Council for 13 years; and Councilmember Martin service on the City Council for 5 years. She said we learn a lot about each other and became a family. Mayor Sullivan said a reception will be held after the City Council meeting in the lobby, bricks will be placed outside City Hall to commemorate their years of service, and their pictures in the lobby were given to them. Councilmember Martin thanked everyone for allowing him to serve the City of Fairhope. He thanked the City employees, the Mayor, and Councilmembers for all that they do for this City. Councilmember Martin said we have done good things; and told them he knows they will continue doing good things. He told the Councilmembers he loved them; and said thank you. Councilmember Conyers thanked Councilmembers Boone and Martin for their service. He told them that the City Council and Mayor had become like a family; and they have become close. Councilmember Conyers commented they made him a better person and valued their friendship. 11100 27 October 2025 Councilmember Robinson commented that the gifts they give to the Community far outreach what they have done on the City Council. He said they both volunteer and are active in the Community. He thanked them too for their service on the City Council. He said we have made the City a better place than when we first came here. Councilmember Robinson said it has been an honor to serve with both of them. He said, "this is see you later not goodbye." Councilmember Boone said it has been an honor and privilege to serve on the City Council with all of you. He thanked the Mayor and City Council for the 13 years of hard work and friendship. Councilmember Boone thanked the City employees and the continuous workforce and leadership. He thanked his wife Karen for her love, advice, and support. Council President Burrell thanked the Mayor for sharing some of the projects that were completed during Councilmembers Martin's term and Boone's terms. He reiterated that the City is better now than when you both started. Council President Burrell also stated they had been active in the Community long before they served on the City Council. He mentioned going on trips with them and having good times. And, he thanked them both for their service. A Public Hearing was held as advertised on a proposed ordinance to amend Ordinance No. 1253. Councilmember Martin introduced in writing an ordinance to amend the City of Fairhope's Zoning Ordinance (several proposed amendments from Planning and Zoning Department. The Planning Commission gave a favorable recommendation of this ordinance. Council President Burrell read the proposed ordinance. Planning Director Hunter Simmons briefly explained the proposed ordinance; and answered any questions if necessary. Council President Burrell questioned residential in mixed-use. Building Heights were explained and questioned. Topography and height were discussed. Council President Burrell said to measure from the lowest to highest of the structure with a limit. Attorney Chris Williams said that if you make any substantial change, it will have to be readvertised. Council President Burrell opened the Public Hearing at 5:51 p.m. 1)Mac Walcott with Walcott Adams Vemeuille Architects addressed the City Council regarding the e-mail that was sent earlier today opposing some of the amendments. He commented on the following items: building heights, residential in the Central Business District, limit on mixed-use design, and maximum of impervious surface. He said landowners are getting less use of their property. The Public Hearing closed at 5:56 p.m. Due to lack of a motion for immediate consideration, this ordinance will layover until the November 10, 2025 City Council meeting. 11101 27 October 2025 Councilmember Martin introduced in writing, and moved for the adoption of the following resolution, a resolution that the City of Fairhope hereby accepts the use of the public forever the roadway Dovecote Lane "as built" from back of curb to back of curb and the drainage in the easement as shown/lies in exhibits attached. Furthermore, this acceptance for public maintenance includes only the roadway shoulders, drainage, landscape, yards, drives, etc. from back of curb outward shall remain private and not be under the maintenance obligation of the City of Fairhope. Seconded by Councilmember Conyers, motion passed unanimously by voice vote. RESOLUTION NO. 5610-25 WHEREAS, the Taylor Oaks Property Owners Association desire to dedicate to the use of the public forever the roadway Dovecote Lane "as built" from back of curb to back of curb and the drainage in the easement as shown/lies in exhibits attached, and; WHEREAS, the Taylor Oaks Property Owners Association do hereby waive on behalf of themselves and their successors in interest all claims for damages against the City of Fairhope and any other governmental authority which may be occasioned to the adjacent land by the established construction, drainage and maintenance of said dedicated road and/or rights-of-way easement or other areas and other ways, and do hereby grant and reserve any easement shown hereon for the uses indicated, and; WHEREAS, the Public Works Director and the City Engineer have indicated that the improvements meet City requirements, and; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, That the City of Fairhope hereby accepts the use of the public forever the roadway Dovecote Lane "as built" from back of curb to back of curb and the drainage in the easement as shown/lies in exhibits attached. Adopted and Approved this 27th day of October, 2025 Attest: .!!ltL City Clerk 11102 27 October 2025 Councilmember Martin introduced in writing, and moved for the adoption of the following resolution, a resolution that the City Council to reject all bids (Bid No. 25-057) to Procure Services for Disaster Relief Services -Tent City 2025; and authorize the re-bid of the annual contract under Code of Alabama 1975, Section 41- 16-57(d). Seconded by Councilmember Conyers, motion passed unanimously by voice vote. RESOLUTION NO. 5611-25 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1]That the City Council to reject all bids (Bid No. 25-057) to Procure Services for Disaster Relief Services -Tent City 2025; and authorize the re-bid of the annual contract under Code of Alabama 1975, Section 41-16-57(d). The cost will not-to-exceed $25,990.00. Seconded by Councilmember Martin, motion passed unanimously by voice vote. * * 11103 27 October 2025 RESOLUTION NO. 5612-25 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, That the City of Fairhope has voted to approve annual clarifier maintenance and materials for the Wastewater Treatment Plant from Parkson Corporation as sole source distributor; and authorizes procurement based on the option allowed by the Code of Alabama 1975, Section 41-16-51(13). The cost will not-to-exceed $25,990.00. ADOPTED ON THIS 27TH DA Y OF OCTOBER 2025 Attest: Councilmember Boone introduced in writing, and moved for the adoption of the following resolution, a resolution that the City of Fairhope approves the award of the Request for Quotes for concrete work at the Wastewater Treatment Plant for the Belt Press to Prime Professional Concrete Pumping & Finishing for a not-to-exceed project cost of $23,300.00. This Public Works project will be less than $100,000.00, and therefore does not need to be formally bid out. Seconded by Councilmember Robinson, motion passed unanimously by voice vote. RESOLUTION NO. 5613-25 BE IT RESOLVE D BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, That the City of Fairhope approves the award of the Request for Quotes for concrete work at the Wastewater Treatment Plant for the Belt Press to Prime Professional Concrete Pumping & Finishing for a not-to-exceed project cost of $23,300.00. Seconded by Councilmember Robinson, motion passed unanimously by voice vote. RESOLUTION NO. 5614-25 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [I]That the City Council approves the selection by Mayor Sherry Sullivan for Professional Engineering Services for (RFQ PS26-006) for concrete testing at the Wastewater Treatment Plant to GeoCon Engineering & Materials Testing, Inc.; and hereby authorize Mayor Sullivan to negotiate the not-to-exceed fee to be approved by Council. The cost is estimated at $304,679.40. Seconded by Councilmember Robinson, motion passed unanimously by voice vote. * * 11105 27 October 2025 RESOLUTION NO. 5615-25 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1]That the City of Fairhope has voted to approve replacement of the body and tank for a fire truck from Sunbelt Fire, Inc. as sole source distributor; and authorizes procurement based on the option allowed by the Code of Alabama 1975, Section 41-16-51(13). The cost is estimated at $304,679.40. ADOPTED ON THIS 27TH DAY OF OCTOBER 2025 Attest: �;t� U�s;MMC City Clerk Councilmember Martin introduced in writing, and moved for the adoption of the following resolution, a resolution that certain items are declared surplus, and the Mayor and City Treasurer are hereby authorized and directed to dispose of Polygraph Equipment owned by the City of Fairhope, Alabama, by selling it to a Licensed Polygraph Examiner in the Private Sector or to another City Municipality through direct sale. Seconded by Councilmember Conyers, motion passed unanimously by voice vote. * * * * 11106 27 October 2025 RESOLUTION NO. 5616-25 WHEREAS, the City of Fairhope, Alabama, has certain items of personal property which are no longer needed for public or municipal purposes; and WHEREAS, Section 11-43-56 of the Code of Alabama of 1975 authorizes the municipal governing body to dispose of unneeded personal property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FAIRHOPE, ALABAMA, AS FOLLOWS: SECTION 1. That the following personal property owned by the City of Fairhope, Alabama, is not needed for public or municipal purposes, and hereby declared surplus: (1)Lafayette Instrument LX4000 Computerized Polygraph Instrument, Serial# 362701 (2)Blood pressure cuff (1)Lafayette seat sensor (2)Pneumograph tubes (1)GSR cables (1)Pentax Pocket Laser Jet Printer SECTION 2. That the Mayor and City Treasurer are hereby authorized and directed to dispose of the personal property owned by the City of Fairhope, Alabama, described in Section 1, above, by the following method: a.Sold to a Licensed Polygraph Examiner in the Private Sector or to another City Municipality through direct sell. ADOPTED AND APPROVED THIS 27TH DAY OF OCTOBER, 2025 �urrCouncil President ATTEST: ��City Clerk 11107 27 October 2025 Councilmember Conyers introduced in writing, and moved for the adoption of the following resolution, a resolution that the Mayor and City Treasurer are hereby authorized and directed to dispose of Firearms (60 Glock Model 17 Gen 5) owned by the City of Fairhope, Alabama, by the following method: Trade-in for Credit toward Purchase of new Replacement Firearms through an Authorized Law Enforcement Dealer. Seconded by Councilmember Robinson, motion passed unanimously by voice vote. Councilmember Martin asked if this was an authorized firearms dealer. Chief Hollinghead replied yes, it is. RESOLUTION NO. 5617-25 WHEREAS, the City of Fairhope, Alabama, has certain items of personal property which are no longer needed for public or municipal purposes; and WHEREAS, Section 11-43-56 of the Code of Alabama of 1975 authorizes the municipal governing body to dispose of unneeded personal property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FAIRHOPE, ALABAMA, AS FOLLOWS: SECTION 1. The motion was seconded by Councilmember Robinson. City Attorney Marcus McDowell stated there is a clause that allows termination of contract; and liability was discussed. After further discussion, motion passed unanimously by voice vote. * * * 11109 27 October 2025 RESOLUTION NO. 5619-25 BE IT RESOLVED BY TIIE GOVERNING BODY OF TIIE CITY OF FAIRHOPE, ALABAMA, That the City of Fairhope approves to purchase three (3) year subscription for NEOGOV Learning Management System from GovernmentJobs.com, Inc. d/b/a NEOGOV for a three (3) year cost not-to-exceed $55,475.64. ADOPTED ON THIS 27TH DA Y OF OCT OBER 2025 Attest: Councilmember Boone introduced in writing, and moved for the adoption of the following resolution, a resolution that the City Council hereby authorizes Mayor Sherry Sullivan to execute an extension of the contract with Long's Human Resource Services to supply temporary employees to supplement the existing workforce as shown in resolution. RESOLUTI ON NO. 5620-25 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, That the City Council hereby authorizes Mayor Sherry Sullivan to execute an extension of the contract with Long's Human Resource Services to supply temporary employees to supplement the existing workforce for the following departments: Adult Recreation/Special Events: $5,000.00, Streets Department: $18,537.47, and Landscape Department: $99,694.80; Total of $123,232.27. These services are exempt pursuant to Code of Alabama 1975, Section 41-16-51. Anyone participating must sign in at the front desk prior to using the track for each visit. Seconded by Councilmember Conyers, motion passed unanimously by voice vote. 11111 27 October 2025 RESOLUTION NO. 5622-25 BE IT RESOLVED BY THE GOVERN ING BODY OF THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA, That the City Council hereby approves that Fairhope residents age 65 and over be allowed to use the indoor track at the Fairhope Recreation Center with no fee; and all currently paid memberships will remain in place until the renewal date for same with no refunds. LLC, d/b/a 3 Arrows Meat Co. LLC, 19670 Greeno Rd., Suite 5, Fairhope, Alabama 36532. Councilmember Martin moved to approve the issuance of the license. Seconded by Councilmember Conyers, motion passed unanimously by voice vote. Councilmember Martin moved to appoint Robert Jernigan and Jared Richardson to the Recreation Board for a 5 year term which will expire October 2030. Seconded by Councilmember Boone, motion passed unanimously by voice vote. * * 11112 27 October 2025 The following individuals spoke during Public Participation for Non-Agenda Items: 1)Enrique Douaihi, 219 Orleans Drive, addressed the City Council and thankedCouncilmember Martin for his service on the City Council. He said CouncilmemberMartin was a leader and compassionate to citizens. Mr. Douaihi said he nowvolunteers because of Councilmember Martin. He thanked Councilmember Martinfor standing up for marginal people.Councilmember Boone moved to adjourn the meeting. Seconded by Councilmember Martin, motion passed unanimously by voice vote.
