HomeMy WebLinkAboutO-122OBDINAX.& NO. jLn Ordinance to determine upon, order and authorize the improvement of portions of certain streets, ave- nues, alleys, highways and other public places within - the corporate limits of the Town of Fairhope, Alabama, by filling, grading, leveling, graveling, paving, side - walking, curbing, guttering, draining and the construc- tion of storm water sewers or drains or lateral storm sewers in connection with such improvements for the purpose of properly draining the portions of stviets so improved and the property abutting thereon, to- gether with all necessary appurtenances thereto; to proviue for the payment of all costa and expenses thereof by asoessment against the property abutting on the portion of such street$, avenues, alleys, high- ways and public places so improved, drained, served, protected or benefited to the extent of the increased value thereof by reason of the special benefits derived from such improvements; to describe the nature and ex- tent of the work, the general character of the mater- ials to be used and the location and terminal points thereof, and the streets, avenues, alleys or other highways or parts thereof embraced therein, and to define the area to be drained, served or benefited by such storm water sewer or sewers or drains and lateral storm water sowers; to direct tivit full details, draw- ings, plans, specification: and surveys of said work and estimates be prepared by the ibwn Engineer; to designate the officer with whom such plans shall be filed; to designate the party under whose supervision the grork shall be done and the improvements made; to provide for the publication of this ordinance and the roiling of copies thereof to the persons last assess- ing for city or town taxation the property which may be assessed for said improvements; to fix and appoint a time for and to authorize the holding cf a meeting of the Council to hear objections to said improvements, and to give to this ordinance an official designation, BE IT O RDA INr',D BY THE TU tr N COUNCIL OF THIS WiN OF FA IRHOF S, ALABAIVIA, As FOLLOWS: section 1, That it be and hereby is determined upon, ordered and authorized by the Torn Council of the Torn of Fa irbope , Alabaria, that the Town of Fairhope, 'ilabama, de- sign or cause to be designed, contract for, execute and cause to be executed,, improvements to and on the following streets, avenues, alleys, highways and other public plaeee,within the corporate limits of the Town of Fairhope, Alabem..a, viz.: (A) Fairhope Avenue, from Fairhope 'Aharf to Corporate Limits; (A) Jection Street, from Corporate Limits to ;hite Avenue; (C) Church Street, from Magnolia t1venue to Fels Avenue; (D) Swmnit Street, from Kiefer :street to Fairhope t'�venu e; � ckz, hite (L) Bayview street, from 4orth to .i.venus , from Fairhope Avenues to (F) Mobile ,venue. (G) White "venue, from Section :street to ii,�bb ile l,venut) (I3) Fels Avenue, from aaction :street to Mobile Avenue; (I) fv'Lagnolia Avenue, from section street to .Fairhope Jtvenus; (J) Kiefer :street, from summit ;=tr€:et to Bayviex Street; (K) Delemar otreet or ':K" street, from jection Street to C"hurch Street; Including all street, avenue and alley inter -2- and public plaoss; all as per plats filod in the office of the Judge (jC Probate of I Baldwin County, iUabamaj by filling,, gradirkr,,j leveling, graveling, paving, sidewalking,, curbing, guttering, draining and the construc- tion of storm water seivers or drains, or lateral storm sewers in connection i*,ith such improver.-ients for the purpose of properly draining such portions of oaid streets and the property abutting thereon, together with all necessary appurtenances thereto. Section 3ection 2, That the area 'to be drained,, ,,,orved or benefited by each of such stoma v*ater sewers or drains or later- al storm winter sewers to be constructed in connection with such other improvements for the purpose of properly draining said streets and the property abutting thereon,, be, and the same hereby is defined 'to be the property fronting on each portion of the streets, avenues and highways herein provided to be improved, actually drained, served or benefited by each of said storm water sewers or drains or lateral storm water sewers* I 3ection 3, That all of the costs and expenses of aforesaid works and improvements be assessed upon and against, the property abutting on the portion of such streets- avenues, alleys, highways and other public places so improved: served, drained, protected or benefited by such improvements to the extent of the increased value thereof by reason of the special benefits derived fron such improvements, provided that for the intersections of streets, avenues, alleys or other highways so Improved. - the cost of improving any intersection or any part thereof, shall bo assessed against the lots~orparcels of land abutting on each of the streets, avenues, alleys or other higlaiays so intersecting for a half block in each direc- tion therefrom; provided that for the purpose of computing assessments hereunder no block shall be considered as extend- ing more than 19000 feet from. any intersection so Improved; for such sidewalk, improvements, including curbing and gutter- ing, all of the costs thereof for street and avenue comers shall be assessed against the lots abutting on or mar said, improvement and the entire cost of the sidewalks improvement, including curbing and guttering at the intersection of any alley with a street or avenue or other highway, shall be assessed in fair proportion against the m- spective lots or parcels of land abutting or cornering on the alley at suet' intersection; but in no case shall t.lie assessment against any lots or parcels of land be greater than the increased value of such lots or Ixircels of land by reason of the special benefits derived from such improvement. The costs and ex- penses of such works and improvements shall. include the ex- pense of the preliminary and other surveys, and the inspec- tion and superintendence of such work, printing and publish- ing the noticeag resolutions and ordinances required, includ- ing notice of assessment, the cost of construction, prepar- ing bonds, interest on money borrowed during construction or on bonds when the bonds have been issued in anticipation of the collection of the assessment, und any other expenses necessary for the completion of such improvement, Sect ion 4. That the works and impro-vtjae nt s herein determined upon, ordered and authorized shall be in the na- ture and to the extent of roadway or street -,11a,ving of a bitwiii- J'_ nous surface treatraent on a prepared sand clay base, including all necessary intersections and street corners; storm water sewers or drains to the extant necessary to properly drain such portions of said streets to be improved hereunder and the prop- erty abutting theroons together Frith all necessary appurtenances and filling, grading, leveling, draining and graveling. Section 5. That the gpnernl character of the mator- ials to be used for such works and improvements shall be as follows: Pavement of streets with a bituminous surface treat- - went on a prepared sand clay base, Faction G. B: Converse ec. vo., Inc., as Town Engineer of the Town of Fairhope, hlabams, they being hereby appointed for that purpose by the Council. section 7. That the said 4'. B. Converse &S :o., Inc., as Town .engineer, be and they hereby are directed to prepare full details, drawings, plans, specifications~ and surveys of said work and estimates thereon and thereof which shall be, when completed, placed on file not later then two weeks prior to ,he date of the meeting of the Town Council hereinafter pro- vided for, in -the office of the Town Clerk of the town of Fair - hope, Alabama, where property owners who may be effected by such Improvements may see and examine the same, Section 8. That this Urdinance be published once a w,3ek for two consecutive weeks in the rairhope Courier, a news- paper published in the Town of Fairhopei Alabama, and that €a copy thereof be sent by registered mail, postage prepaid, to the persona last assessing for torn taxation the property which may be assessed for said iraproverrnants, at their last known ad- dresses, said notices to be so retailed not less than ten days before the meeting of the Council provided for in the next suc- ceeding section. Section 9, That the Town Council of the Town of Fair - hope; Alabama; meet at d o*alook P. 14. in the Torn of Fair - hope, Alabama, at Ahe off ce of the Town Clerk thereof, on the 2 .1 day of ,,S 1934, for the purpose of hearing an a which time w ear any objections or remonstrances that maybe riade to said improvements, the manner of making the same, or the character of material or materials to be used.
