HomeMy WebLinkAboutO-116ORDINANCE NO. 116 An ordinance to determine upon, order and authorize the 'mprovement of portions of certain streets, avenues, highways and other public places within the Corporate limits of the Town of Fairhope, Alabama, -by filling, gra- ding, leveling, -raveling, paving, bridging, curbing, guttering, draining and the construction of drains or lateral storm sewers in connection with such improve- ments for the purpose of properly draining the portions of streets so improved and the property abutting thereon together with all necessary appurtenances thereto; to provide ofr the paymane of all costs and expenses there- of byassessment against the property abutting on the por- tion of such streets, avenues, highways and public places so improved, drained, served, protected or benefited by the extent of the increased value thereof by reason of the special benefits derived from such improvements; to describe the nature and extent of the work, the general character of the materials to be used and the location and terminal points thereof, and the streets, avenues, or other highways or parts thereof embraced therein, and to efine the area to be drained, served or benefited by such strom water drains and lateral storm water sewers; to direct that full details, drawings, plans, specifi- cations and surveys of said work and estimates to be pre- pared by the Town engineer; to designate the officer with whom such plans shall be filed; to designate the party under whose supervision the work shall be done and the improvements made; to provide for the publication of this ordinance and the mailing of copies thereof to the per- sons last assessing for Torn taxation the property which may be assessed for said improvements; to fix and appoint a time for and to authorize the holding of a meeting of the Council to hear objections to said improvements, and to give to this ordinance an official designation. BE IT ORDAINED BY TEE TOWN COUNCIL OF THE TOWN OF FAIRHOPE, ALABAMA, AS FOLLOWS: SECTION 1. That it be and hereby is determined upon, ordered and authorized by the Town Council of the Town of Fairhope, Alabama, that the Town of Fairhope, Alabama, design or cause to be designed, contract for, execute and cause to be executed, improvements to and on the following streets, avenues, highways, and other public places with- in the corporate limits of the Town of Fairhope, Alabama viz: (a) SECTION STREET town limits on the north to White Avenue on South. (b) Fels Avenue from Section Street on the East to Mobile Avenue on the West. (c) MOBILE AVENUE from town limits on the South to Fairhope Avenue on the North, including new bridge over Stack's Gully. (d) MAGNOLIA AVENUE from Fairhope Avenue on the Wett to Section Street on the East. (e)'SUMMIT STREET from Kiefer Street on the North to Fairhope Avenue on the South. (f) FAIRHOPE AVENUE from town limits on the East to Mobile Bay on the West. -2- (g) WHITE AVENUE from Section Street on the East to Mobile Avneue on the West. (h) BAY VIEW STREET from White Avenue on the South to end of Street on the North. (i) CHURCH STREET from Magnolia Avenue on the North to Fels Avenue on the South. (j) MORPHY AVENUE from Section Street on the East to Church Street on the West. (k) DELEMAR STREET from Section Street on the East to Church Street on the West. (1) KIEFER STREET from Bay View Street to Summit Street. Including all street, avenues and alley intersections and public places; all as per plat of the Town of Fairhope as decorded in Record Miscellaneous Vol. 1, Pages 274-275 of the Probate Records of Baldwin County, Alabama; by filling, grading, leveling, graveling, paving, bridging, curbing, guttering, draining and construction of storm water drains, or lateral storm sewers in connection with such improvements for the purpose of properly draining such portions of said streets, avenues, highways, and other public places, and the property abutting thereon, together with all necessary appurtenances thereto. SECTION 2. That the area to be drained, served or venefited by each of the stoom water drains or lateral storm water severs to be constructed in connection with such improvements for the purpose of properly draining said streets and the property abutting thereon, be and the same hereby is defined to be the property fronting on each portion of the streets, avenues, and highways herein provided to be improved, actually drained, served or benefited by each of said storm water drains or lateral storm water sewers. SECTION 3. That all the costs and expenses of afore- said works and improvements be assessed upon and against the property abutting on the portion of such treets, avenues, alleys, highways and other public places so im- proved, served, drained, protected or benefited by such improvements to the extent of the increased value thereof by reason of the special benefits derived from such im- provements, provided that for the intersections of streets, avenues,alleys or other highways so improved, the cost of improving any intersection or any part thereof, shall be assessed against the lots or parcels of land abutting on each of the streets, avenues, alleys, or other high- ways so intersecting for a half block in each direction therefrom; provided that for purpose of computing assess- ments hereunder no block shall be considered as extending more than 1 000 feet from any interesection so improved, for such sidewalk improvements, including curbing and guttering all of the costs thereof for street and avenue corners, shall be assessed against the lots abutting on or nearest said improvement and the entire costs of the sidewalks improvement, including curbing and guttering at the intersection of any alley with a street or avenue or other highway, shallte assessed in fair proportion against the respective lots or parcels of land abutting on or cornering on the alley at such intersection; but in no case shall the assessment against any lots or par- cels of land be greater than the increased value of such lots or parcels of land by reason of the special bene- ifts derived from such improvement. The costs and expen- ses of such works and improvements shall include the expense of the preliminary and other surveys and the inspection and superintendence of such work, printing and publishing the notices, resolutions, and ordinances required, inclu- ding notice of assessment, the cost of construction, pre- paring bonds, interest on money borrowed during construction or on bonds when the bonds have been issued in antici- it -3- pation of the collection of the assessment, and any other expenses necessary for the completion of such ;mprovement. SECTION 4. That the work and improvements here determined upon and authorized shall be roadway or treet paving of the type recognized and known as surface treat- ment, consisting of eight inches of compacted dandclay base with asphaltic and tar top finished to uniform line and grade with stone chips. On streets without existing curb and gutters there will be included a wood curb of such depth as to conform and hold in palce the pavement; all paving to include all necessary intersections; storm water drains to the extent necessary to properly drain the portions of said streets to be improved hereunder and the property abutting thereon, together with all neces- sary appurtenances and filling, grading, leveling, draining, and graveling. SECTION 5. That the general character of the material to be used for such work and improvements shall be set out inthe preceding paragraph. SECTION 6. That all the work to be done and the improvements to be made hereunder shall be done and made unddr the supervision of J. B. Converse & Company, Inc., (an incorporated civil engineering company), as Town Engineer of the Town of Fairhope, Alabama, it being there- by appointed for such purpose by the Council. SECTION 9. That the said J. B. Converse & Company, Inc., as Town Engineer be and it hereby is directed to prepare full details, drawings, plans, specifications and surveys of said work and estimates thereon and thereof which shall be when completed, palced on file not later than two weeks pr&or to the date of the meeting of the Town Council hereinafter provided for, in the office of the Town Clerk of the Town ofFairhope, Alabama, where property owners who may be affected by such improvements may see and examine the same. SECTION 8. That this ordinance be published once a seek for two consecutivd weeks in the "Fairhope Courier", a newspaper published inthe Town of Fairhope, tilabama, and that a copy thereof be sent by registered mail, postage prepaid, to the persons last assessing for town taxation the property which may be assessed for said improvements at their last known adressesy said notices to be so mailed not less than ten days before the meeting of the Council provided for in the next succeeding section. SECTION 9. That the Town Council of the Town of Fairhope, Alabama meet at 8 o'clock P.M. at the Town Hall of the said 'own on Tuesday the 2nd dray of January, 1934, for the purpose of hearing and at which time it will hear any objections or remonstrances that may be made to said improvements, the manner of making the same, or the character of material or materials to be used. SECTION 10. That this ordinance is hereby termed and designated shall be known and may be cited as "Fair - hope Paving Venture No. 1. Ordinance." Mayor Dlerk
