BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
FAIRHOPE, ALABAMA.
SECTION 1. That it be and hereby is determined upon,
ordered and authorized by the Town Council of the Town
of Fairhope, Alabama, design, or cause to be designed
contract for and to execute or cause to be executed the
construction of sanitary sewers and sanitary sewer systems,
including sewage treatment and disposal plant, within the
corporate limits of the Twon; that all the costs and ex-
penses thereof be assessed against the property drained,
served or benefitted by said sanitary sewers and sanitary
sewer systems; to the extent of the increased value of
such property by reason of the special benefits derived
from such improvements, but said special assessments
shall not exceed the increased value of said property
by reason of special benefits derived from the improve-
ments.
SECTION 2. That the works and improvements hereby
determined upon, ordered and authorized shall be in the
nature and to the extent of sanitary sewers and sanitary
sewer systems; so laid and constructed within the cor-
porate limits of the town as to furnish a system and systems
of sanitary drainage and waste disposal facilities to
the property in the Town of Fairhope, Alabama, lying with-
in the area, territory and district drained thereby to-
gether with a septic tank or sewage treatment plant in-
cluding sludge pit, together with necessary ditching,
grading, filling and incidentals thereto.
SECTION 3. That the territory or area within the
Town to be drained, served or benefitted by such sewer
system, is as follows, viz:
Beginning at a point on the South side of Bayou
Charbon where a line 150 teet. East of Bancroft Street
and parallel to intersects said Bayou thence South
parallel to Bancroft Street to a point 150 feet North
of Magnolia Avenue; thence East Parallel to Magnolia
Avenue to a point 250 feet East of School Street;tthonce
South parallel to School Street to Morphy Avenue; thence
West along Morphy Avenue to a point 150 feet East of
Section Street; thence South Parallel to Section Street
to a point 200 feet South of White Avenue; thence West
parallel to White Avenue to Equity Street; thence North-
erly along Equity Street to a point 150 feet South of
Morphy Avenue; thence Westwardly parallel to Morphy Ave-
nue to a point 150 feet West of Bayview Street; thence
Northeast parallel to Bayview Street; to Fairhope Avenue;
thence North parallel to Bayview Street to a point where
said line intersects Shore line of Mobile Bay; thence
northerly along said Bay Shore line to a point where it
intersects Bayou Charbon; thence Southeastwardly along
the South side of said Bayou to the point of beginning.
Said drainage area being in the Eastern part and largely
compresively that part of the town of Fairhope, Alabama
and the streets and other monuments of direction being
according to the official plat of the Town of Fairhope
as recorded in the Probate Records of Baldwin County.
SECTION 4. That the works and improvements herein
dete mined upon, ordered and authorized shall be in the
nature and to the extent of sanitary sewer mains, laterals
and drainage fields of No. 1 Terra Cotta or Concrete
pipe; manholes constructed of brick or concrete with cast
iron covers; septic tanks and sludge pit constructed of
reinforced portland cement concrete or brick with nec-
essary cast iron manhole covers, piping valves and braces.
SECTION 5. That all of the work to be done and the
improvements to be made hereunder shall be done and made
under the supervision of 0. H. Langq Town Engineer of the
Town of Fairhope,Alabama.
SECTION 6. That the said O.H. Lang, be and he is
hereby directed to prepare full details, drawing, plans,
specifications and surveys of said works and improvements
together with estemates thereon and that such details,
drawings, plans specification, and survey of said works
and improvements and estimates thereon and thereof shall
be, when completed, placed on file not later than two
weeks prior to the date of the meeting hereinafter pro-
vided for in the office of the Town Clerk of the Town
of Fairhope, Alabama, where property owners who may be
affected by such improvements may see and examine the
same.
SECTION 7. That this ordinance be published once
a week for two consecutive weeks in the Fairhope Courier
a newspaper published in the Town of Fairhope, Alabama,
and that a copy hereof be sent by registered mail, pos-
tagb prepaid, to the persons last assessing for town
taxation the property which may be assessed for improve-
ments at their last known addresses, said notices to be
so mailed not less than ten days before the meeting of
the Twwn Council provided for in the next succeeding
section.
SECTION 8. That the Town Council of the Town of
Fairhope, Alabama, meet at 7:30 o'clock P.M., in the
Town of Fairhope, Alabama, at the council chamber in
Municipal Building, on the 3rd day of January, 1930
for the purpose of hearing and at. whtbhntim6 . Jt will
hear any objections or remonstrances that may be made
to said improvements, the manner of making the same or
the character of materials to be used.
SECTION 9. That this Ordinance is hereby termed
and designated, shall be known and may be cited as the
"Sanitary Sewer System Improvement Ordinance of December
12th, 1929."
Duly adopted by the Torn of Fairhope, Alabama, at
a meeting thereof, regularly held on December 12, 1929.
