HomeMy WebLinkAboutO-106ORDINANCE NO. 106 BE IT ORDAINED BY THE TOWN COUNCIL OF FAIRHOPE, ALA4- BAMA, AS FOLLOWS: THAT SECTION 65 OF THE CODE OF ORDINANCES OF FAIRHOPE ALABAMA, ENACTED DECEMBER 26,19161 BE AMENDED TO READ AS FOLLOWS: SECTION 1. The flat rate for water service where no meter is installed shall be: For houses of six rooms or less, $12900 per year. Additional rooms above six, shall be seventy-five cents each year. Tub and shower baths $3.00 per year for on and each additional bath $2.25 per year. Toilets, $3.16 per year, additional toilets $2.25 per year each. Out- sice faucets $3.00 for one, first additional $1.50, for two or more additional faucets 75 cents each. SECTION 2. Where a house is occupied six months or less the water rent shall be one-half of the regular annual charge; if occupied more than one half a year the rent shall be in proportion to the time occupied. SECTION 3. Where meters are installed a fee of Five dollars shall be paid by the consumer prior to the instal- lation of the meter, and rates shall become effective upon such installation on the following schedule: Fifty cents per thousand for the first 3,000 gallons. Thirty -cents per thousand for the next 2,000 gallons. Twenty-five cents per thousand for the next 5,000 gallons. Twenty cents per thousand for the next 10,000 gallons. Eighteen cents per thousand for the next 20,000 gallons. Fifteen cents per thousand for all in excess of 40,000 gallons. Minimum bill per month $1.50. SECTION 4. Where water has been turned off because of anydefault or neglect on the part of the consumer, a fee of one dollar shall be paid for reinstatement of ser- vice. SECTION 5. All flat rates are payable quarterly in advance between the first and fifteenth days of the months of January, April, July and October of each year. Bills for meter service Will be rendered on the 15th day of each month and must be paid by the loth of the following month. Upon failure to pay any water bill by the expiration of the time of payment, as here stated, the Town reserves the right to discontinue service, which will not be rein- stated except upon the payment of all water rent in full and of the reinstatement charge of $1.00. SECTION 6. Where application is made for water ser- vice by any one other than the owner of the property to be served, a deposit of $5.00 shall be made to be returned upon discontinuance of said service and full payment of all amounts due. SECTION 7. Meters will be repaired by the Town at the expense of the owner. A meter that does not register or does not register correctly, may be taken out by the Town at its option and the flat rate for the service charged. The Town reserves the right to put in a meter on any service, or remove same when necessary. . r r. SECTION 8. Any consumer who is of the opinion that his meter is not registering correctly may, upon appli- cation, have said meter tested upon making a deposit of $2.00 for such service. Ahould said complaint be found justified and the test shows that the meter is registering incorrectly said deposit is to be returned to tie consumer, otherwise to be applied toward the expense of making the test. SECTION 9. Except by special permission of the Mayor and Council not more than one house or service shall be permitted on one connection, whether flat rate or through meter. Where such double connections exists same shall be terminated and separate connection made for each service. SECTION 10. No one shall turn on or off a water connection at the official cut-off established by the town, without authority from the Water Department and any person violating this rule shall upon conviction be fined not less than one nor more than ten dollars. SECTION 11. Every consumer of water furnished by the Towh Water Works Department shall keep his service pipes, faucets and other fixtures in repait and properly protected to prevent waste. SECTION 12. The Water Works Department or any person delegated by it or any member of the Public Ser- vice Committee shall have free access at all reasonable hours to all parts of the -remises served for the purpose of inspecting the condition of the plumbing and the use of crater. SECTION 13. In the event of waste on account of defects of fixtures or plumbing, or carelessness on the part of the user, and same is not repaired or discontinued within three days after notice to do so has been given by the Water Works Department, water will be shut off from the premises until such repairs have been made, and the charge of $1.00 for the reinstatement of service paid. SECTION 14. No person other than a duly authorized employee of the Water Works Department shall turn on water without a permit from the water works office, and any person violating this rule shall be fined on con- viction Oot less than $1.00 nor more than $5.00. SECTION 15. All persons desiring water service must make application for same at the office of the Town Clerk, by Whom perrits may be issued, and consumer desiring to discontinue service must give written notice of same at that offices otherwise shall continue liable for the pay- ment of the water rent until such notice has been given. SECTION 16. Any consumer permitting another not a member of his family or an employee to use water from fixtures on his premises, shall be fined upon conviction not less than $5.00 nor more than $10.00. SECTION 17. A consumer taking water on a flat rate shall be charged for all fixtures on the premises, whether used or not as long as same are connected up with the service pipes. SECTION 18. No abatement of water rent v.ill be allowed by reason of removal, disuse or diminished use, unless notice of such disuse is left in writing at the Water Office when said change takes place. SECTION 19. The Town reserves the right in time of drought or emergency to forbid street, sidewalk or lawn sprinkling. SECTION 20. Any one tampering with a fireplug or drawing water therefrom for other than fire purposes, shall be fined on conviction not less than $5.00 nor more than $10.00. SECTION 21. Tapping of mains and rater pipes, and the extension of service pipes between main and sidewalks shall be done only by duly authorized employee of the water works. SECTION 22. Where service is not paid for by a tenant the owner of the property shall be held responsible for the non-payment of water rent and no reinstatement of service will be made until all arrears have been paid. SECTION 23. It shall be unlawful to permit water to run continuously from any hydrant, faucet or other fixture, whether within or without a building, whether to prevent freezing or for other purpose, and all plumbing shall be arranged with stop and waste plugs permitting pipes to be thoroughly drained in freezing weather, Violation of this section shall render the person guilty thereof liable to a fine of not less than $5.00 nor more than $10.00. for each offense. THIS ORDINANCE shall become effective upon its passage and publication. Adopted July 11, 1929. Mayor ATTEST: Clerk
