STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 N. Section Street; Fairhope, Alabama 36532; on Monday,
December 26, 1995.
Present were Mayor James P. Nix; Councilmembers John Duck,
Michael Ford, David E. Bishop, Jeanette Puckett, and Layton
Overstreet; City Attorney Marion Wynne and City Clerk Evelyn
Phillips were absent. Betty Rivenbark was Acting City Clerk.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the December 11, 1995 regular session were
duly approved as written.
Mayor Nix recognized six firemen(J. Dodson Brown, Jr.,
James C. Cluster, Lloyd Cluster, Shawn Haight, Scott Holy, Patrick
Bryan Peek, and Jim Salac) who had compeleted 160 hours of state
of Alabama certification training. He commended them for their
perserverance good work they do.
Council considered an application for a Beer/Wine On Premise
License by James D. Boothe, Jr. dba THE YARDARM RESTAURANT, Fairhope
Municipal Pier. There was police approval of the application. There
was no opposition from the floor on the application. Councilman
Overstreet made the request that signs be posted saying beer/wine
will be consumed only in the restaurant. Councilman Duck moved to
approve the issuance of the license. Councilwoman Puckett seconded
the motion and it passed with Councilman Bishop voting against the
motion.
Council adopted a long range layout plan for the Fairhope
Municipal Airport. Sue Mason, Airport Board Chairman spoke saying
this was required by the FAA following any project and we just com-
pleted a ramp expansion. Ms. Mason said the board had met and approved
the ALP done by Barge, Waggoner, engineers who were hired for the
expansion program. This is a current and future ALP. Motion was made
by Councilwoman Puckett, seconded by Councilman Duck and unanimously
carried.
An alcohol abuse prevention program mandated by the the Depart-
ment of Transportation for all gas companies was adopted on motion
by Councilman Duck, seconded by Councilman Ford and unanimously
carried. Random drug testing is already done in all departments
but this is something new all pipeline carriers are being required
to adopt.
Sue Mason spoke asking approval to use the beach area on
September 21, 1996 in order to hold a British Car Day in Fairhope
with limited access on the north end. She said this is something
that was done a couple of years ago and they would like to bring back
to Fairhope. Her reason for requesting so early is to be able to
get publicity needed. Councilman Overstreet moved to approve request,
Councilman Bishop seconded and motion carried unanimously.

Four appointments were made on City Boards as follows:
A 6 year term on the Industrial Development Board
A motion was made for re -appointment of Byron Calhoun and
Gary Moore who previously served. There were no other
nominations. Councilman Bishop made the motion, seconded
by Councilman Duck motion carried unanimously.
A 6 year term on the Industrial Development Board - Mike
Baugh was nominated to replace Dave Smith who moved out
of town. Term will run until May 2000. No other nominations
were made. Councilman Duck moved to appoint Mike Baugh.
Councilman Ford seconded and motion carried unanimously.
On the Planning & Zoning Commission, Maxwell Killoch had
resigned due to bad health. Larry Green's name was submitted
by the Mayor as a replacement. Term to run until the year 2000.
Councilman Overstreet moved to approve, Councilman Duck seconded
and motion carried unanimously.
Mayor Nix told of a need to swap a little piece of land at
the golf course on the cart path at #10 green(1.3 acres) that
was being swapped for .44 acres in order to prevent problems
down the road as land is now being developed around the course.
This swap being made with Doleen, Inc.. who made the request.
Councilman Ford moved to approve this swap to prevent problems
down the road. Councilman Bishop seconded and motion carried
unanimously.
There being no further business to come before the meeting,
it was duly adjourned.
