STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 PM; Fairhope Municipal Complex Council Chamber;
161 N. Section Street; Fairhope, Alabama 36532; on
Monday, October 9, 1995.
Present were Mayor James P. Nix; Councilmembers John V.
Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and
Layton Overstreet; City Attorney Marion E. Wynne and Acting
City Clerk Betty Rivenbark.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 25 September 1995 regular session were
duly approved.
Mayor Nix took a minute to publicly thank all the city
employees who worked so hard during Hurricane Opal and for extra
work they have had to do to clean up the debris since then.
After discussion, Councilwoman Puckett introduced in writing,
and moved for the adoption of the following resolution. Seconded
by Councilman Bishop, motion passed unanimously:
RESOLUTION NO.496-95
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that Mayor James P. Nix is hereby authorized to execute a
lease purchase agreement between the City and Municipal Leasing
Credit Corporation, Overland Park, Kansas, for the purchase of
one jet loading system @ $42,325.00 and one avgas loading system
@ $35,100.00, totaling $73,717.00; payable in 58 monthly install-
ments of $1,577.00 beginning 1 November 1995.
ADOPTED THIS 9th DAY OF OCTOBER, 1995.

And in conjunction with the above resolution another resolution
was needed to amend the rent between the City and Teledyne Continental
Motors. Councilwoman Puckett introduced in writing, and moved

for the adoption of, the following resolution. Seconded by
Councilman Duck, motion passed unanimously:
RESOLUTION NO. 497-95
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that Mayor James P. Nix is hereby
authorized to execute a "Rental Adjustment to Lease
And Airport Operation Agreement" to adjust that certain
agreement between the City and Teledyne Continental
Motors dated 28 June 1995 for the purchase of jet
loading system and an avgas loading system.

Mayor Nix announced that it is time for the council to consider
adopting the budget for the 1995-96 Fiscal Year. He went over
the figures for projected revenue and projected expenses in each
department and overall operating budget. He said this is a
working budget, everything still has to come back to the council
for approval. To take action, Councilman Duck introduced in
writing, and moved for the adoption of, the following resolution.
Seconded by Councilman Ford, motion passed unanimously:

RESOLUTION NO. 4qG?-
BE IT RESOLVED by the Mayor and Council of the City of
Fairhope, Alabama, that the proposed Budget presented
and reviewed this 9th day of October, 1995, be hereby
approved and adopted for FY 1995-1996; and
BE IT RESOLVED that the Annual Salaries of City Personnel
shall be as shown on a list entitiled "Annual Salaries of
All City Personnel - Resolution No. "; said list
in the Office of the Mayor, of the City Clerk, and of the
Personnel Director; and
BE IT FURTHER RESOLVED that the Mayor be authorized to
enter into a contract with the Eastern Shore Chamber of
Commerce to promote the City of Fairhope. The contract
shall be for one (1) year, 1 October 1995 - 30 September
1996, but may be cancelled at any time. Contract shall call
for a payment to the Eastern Shore Chamber of Commerce of
$125.00 per month from the City's General Fund and $125.00
per month from each of the City's Utility Funds; or $6,000.00
for the one-year term.

An application for a Restaurant Liquor License by Michael D.
Dorsett, DBA KK's Mesquite Grill, at 800 N. Section Street was
considered. The application had police approval. This is where
Maggie's was formerly located and Nor. Dorsett had provided a
resume' for the council's perusal.,'. There was proof of publication.
Councilwoman Puckett moved to grant- approval as sought. Seconded
by Councilman Ford motion passed unanimously.

A Restaurant Liquor License by Chakli A. Diggs, DBA Aubergine, LLC,
at 315 De La Mare Street was being applied for. The building is
now being built and he_said they will open probably in December.
Police approval was given and proof':,of publication was provided.
Councilman Overstreet moved to approve the license as applied for.
Councilwoman Puckett seconded and niotion passed unanimously.
Council took the following action on, bids:

Councilman Ford moved to pay the bills as presented, Councilman Over-
street seconded and motion carried unanimously.
Mayor Nix mentioned that even as we were meeting the city crews
were out still cleaning up debris from Hurrican Opal and that
they hoped to be on regularly scheduled routes late Friday
afternoon.
There being no further business, meeting was duly adjourned.
