COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 PM; Fairhope Municipal Complex Council Chamber;
161 N. Section Street; Fairhope, Alabama 36532; on
Monday, 25 September, 1995.
Present were Mayor James P. Nix; Councilmembers John V.
Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett,
and Layton Overstreet; City Attorney Marion E. Wynne and
Acting City Clerk Betty Rivenbark.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 11 September 1995 regular session
were duly approved.
The rezoning request by owners of eight parcels of land
on Greeno Road(US 98) from R1 Low Density Single Family
residential to B4 Business & Professional was considered.
The Planning & Zoning Commission had sent this back to
the council with a recommendation that this request be
denied. A lengthy discussion followed with at least
20 people speaking for/against the issue. After everyone
spoke who wished to speak to the issue Mayor Nix asked
for comments from the council and called for a motion.
Councilman Duck moved to introduce in writing Ordinance 983
to re -zone the eight parcels from R1 to B4. In order to
take immediate action Councilman Bishop moved to suspend
the rules. Seconded by Councilman Ford the motion to suspend
passed unanimously by the following vote: AYE - Duck, Ford,
Bishop Nix, Puckett and Overstreet. NAY -none. Councilman
Duck then moved for final adoption of Ordinance No. 983.
Mayor Nix called for a second to this motion, there was none.
Therefore motion died for lack of second and the property
will remain as it is now zoned - R.1.
A request to hold a 5K Run in Fairhope on October 21
had been presented by Deborah Sandell,the run in conjunction
with Domestic Violence Awareness month. She had written a
letter showing the course and has been in touch with the
police department on this route. Mayor Nix asked if she
wished to add anything further, she did not. Councilman
Bishop moved to approve this request. Councilwoman Puckett
seconded and motion carried unanimously.
An application for a Club Liquor License by Robin Lambert
DBA King Seafood Old Bay Steamer at 312 Fairhope Avenue was
discussed. This was a change in ownership and the former
Old Bay Steamer had the same kind of license. Police approval
had been given-. Councilwoman Puckett moved to approve, Coun-
cilman Duck.seconded the motion.and it passed unanimously.

Mayor Nix opened the floor for nominations to fill
two 6-year terms on the Medical Clinic Board North. Council-
man Duck moved to reappoint Thad Ingram and Claude Puckett.
There being no other nominations Councilman Ford moved
to appoint Mr. Ingram and Mr. Puckett by acclamation.
Seconded by Councilman Bishop, motion passed with Councilwoman
Puckett abstaining to vote.
Mayor Nix reported he had a request fora change order
for the FAA AIP Project currently going on' at the airport
this had been sent in by our engineer on the project, Barge,
Waggoner, Sumner and Cannon. Councilwoman Puckett moved to
approve Change Order #1 involving $4,395.00 to correct some
erosion problems. Councilman Duck seconded and motion passed
unanimously.

Councilman Bishop moved to accept the low bid by Consolidated
Pipe & Supply Co., provided all specifications are met.
Seconded by Councilman Duck, motion passed unanimously.
Councilman Overstreet reported he and his committee(Tim
Kant, Phil Rutherford) had studied the two intersections
where it had been requested to put up two 4-way stop signs
and their recommendation was as follows:
White Avenue and Summit Street - no sign needed
White Avenue and Church Street - erect a 4 way stop sign
he moved that the recommendations be accepted and the sign
put up, Councilman Duck seconded and motion carried unanimously.
There being no further business, meeting was duly adjourned.
