HomeMy WebLinkAbout05-22-1995 Regular Meeting1671 STATE OF ALABAMA 0 COUNTY OF BALDWIN 0 The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday. 22 Mav 1995. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 8 May 1995 regular session were duly approved. Mr. G McNally, Fairhopers Community Park Committee, came before Council with several requests. Council approval was requested on the following list of rules and regulations: 1. All bikes, rollerblades, and skateboards must be left at Park entrance. 2. No pets allowed anywhere in the Park. 3. No beverages, food, or smoking allowed around playstructures within the mulched areas of Park. 4. No glass containers allowed. 5. No alcoholic beverages allowed. Picnic areas are the open, grassy fields in the Park. You are required to clean up your area before you leave. Play at the Park is at your own risk. Councilman Bishop moved to approve these rules and regulations. Seconded by Councilman Duck, motion passed unanimously. Mr. McNally requested that these rules be spelled out on big signs of "Welcome to the Fairhopers Community Park", and placed at the Park entrances. He further requested that small No Smoking, No Pets, and No Bikes signs be placed throughout the Park; and that international symbols be used on the signs. When Mr. McNally asked if the City would construct public restrooms, Mayor Nix asked if the Committee wasn't supposed to finance restrooms. Mr. McNally replied that they did not plan to do so. After some discussion, Mayor Nix advised that the requests will have to be studied before any action is taken. Council reviewed a Restaurant Liquor License application by Albert S. Moses, Jr., dba FRENCH QUARTER CAFE & DELI, 422 South Section Street. No one present was opposed to the 22 May 1995 1672 license. There was police approval of the applicant. After discussion, Councilman Duck moved to approve the application. Seconded by Councilman Ford, motion passed unanimously. Councilman Ford moved to approve a donation to the Boys & Girls Clubs, in the amount of $30,000.00, to be paid over a 12-month period. This is to start a Teen Center and to help with a Summer Day Camp. Seconded by Councilman Bishop, motion passed unanimously. Councilman Ford made a brief report on recycling efforts. He announced, starting June 5th, that plastic will now be accepted. Only milk carton and drink bottle plastic. Councilman Ford said everyone must redouble their efforts, more participation by businesses and citizens is needed. Councilman Duck introduced in writing, and moved for the adoption of, the following resolution. seconded by Councilman Ford, motion passed unanimously: RESOLUTION NO. 484-95 BE IT RESOLVEDby the City Council of the City of Fairhope, Alabama, that the City enter into an agreement with the State of Alabama Department of Transportation for: To relocate gas main along US Highway 31, at its intersection with Alabama Highway 59, (State Project No. NHF 193(14), which agree- ment is before this Council, and that the agreement be executed in the name of the City, by its Mayor, for and on its behalf and that it be attested by the City Clerk and the seal of the City affixed thereto. BE IT FURTHER RESOLVED that upon the completion of the execution of the agreement by all parties, that a copy of such agreement be kept on file by the City Clerk. NIX, Mayor Evelyn P Phillips, City Cyork 22 May 1995 1673 Councilwoman Puckett moved to delete Mark Tunstall, Ronnie Marshall, and Eric Johnson from the Police Auxiliary Roster. Seconded by Councilman Duck, motion passed unanimously. Councilman Bishop nominated May Moss Parker for reappoint- ment to the Organic School Board for a 3-year term; and Pat Quinn to the Board for a 2-year term. There being no other nominations, Councilman Duck moved to close the nomi- nations and appoint Ms. Parker & Ms. Quinn by acclamation. Seconded by Councilwoman Puckett, motion passed unanimously. Approximately 25-to-35 people were present to discuss a recent request by Mr. Jack Kendrick to close the Beach area at night. Each councilmember expressed their thoughts on the request: the consensus seemed to be that it was too unfair to close the beach every night, to all traffic, year-round and, while they sympathized with Mr. Kendrick and other persons living near the area, there were ordinances already in place and available for use; such as public disturbance and noise. After much discussion, Councilman Duck moved to leave the beach ordinances as they are (which includes closing the area on Saturday and Sunday, to vehicular traffic, from 8:30 pm to 6:00 am), and request the police to tighten up on their enforcement, and to make reports to the Council from time to time. Seconded by Councilwoman Puckett, motion passed unanimously. Councilman Ford moved to hear the following two items not on the Agenda. Seconded by Councilman Duck, motion passed unanimously: Mayor Nix reported two bids were received on the alte- rations and additions to the Club House at the Municipal Golf Course: E-J Builders, Inc. Foley $ 261,000 Booth Contracting Mobile $ 329,000. After discussion, Councilman Duck introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilman Ford, motion passed unanimously: RESOLUTION NO. 485-95 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the Mayor is hereby authorized to execute a contract between the City and E-J BUILDERS, INC., of Foley, Alabama, in the amount of $261,000.00, for alterations and additions to the Quail Creek Municipal Golf Course Clubhouse, as per the drawings and specifications pertaining thereto, as prepared by Architect William L. Seconded by Councilman Ford, motion passed unanimously. Public Works Director Tim Kant reported that the State Urban Forestry Association awarded the City the honor of being selected as the Best "Tree City" in the State this year.
