COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 PM; Fairhope Municipal Complex Council Chamber; 161
North Section Street; Fairhope, Alabama 36532; on
Monday, 8 May, 1995.
Present were Mayor Pro Tem Layton Overstreet; Council -
members John Duck, Michael A. Ford, David E. Bishop; City
Attorney Marion E. Wynne and Acting City Clerk Betty
Rivenbark. Mayor Nix and Evelyn Phillips were absent.
There being a quorum present, Mr. Overstreet called the
meeting to order. Minutes of the 24 April 1995 regular session
were duly approved.
Mr. John Kendrick, 101 N. Bayview Avenue, was present
again tonight to speak about the closing of the north end of
the bayfront park as this was carried over from last meeting.
He restated his request that it be closed from 11:00 PM to dawn
7 days a week. As this was a public hearing others spoke, Richard
Spater supported the closing, Mike Agron spoke supporting the
closing, saying the loud music and growing population contributed
to problems, could we post something saying loud music not allowed.
A Ruth Morrison spoke saying the police very cooperative, come
when called. Ot Miller said he concurs with closing. Tom Guthrie
said he had same experiences as Ms. Morrison. Steve Baker spoke
saying this is the only place he has to take his family, likes
to go down there to hunt for jubilees, hates to lose the use of
it, he grew up here. Councilman Ford said he has had the reverse
reaction from people he talked to on the street, they did not
want it closed. The question was raised, if we close this one
what about other parks in town? Willie Williams spoke saying
he shared our concern, but what we are doing now is good, he
hopes we won't stop the walkers. What we are now doing now -
closing Saturday -Sunday nights at 8:30 PM to vehicular traffic
was discussed. A Helen Blossom spoke saying the unruly conduct
is what they object to.She is talking about the noisy, loud,
drinking crowd that abuse the equipment. A Mr. Henson said he
thought we should enforce the regulations, take stronger hand.
Mike Ford said he thought it would not be good just because
of a few problems to take this away from the rest of the community.
Further discussion led to a motion by John Duck to have the City
Attorney do research before the council takes further action.
David Bishop 2nd the motion and it carried unanimously.
Council reviewed a Club Liquor License application by Henry
H. Lavallet, dba THE LAST NACHO, 19344 Scenic Highway 98(formerly
Max's Cafe) Mr. Lavallet is the new owner, he spoke saying he is
serving food, not just bar atmosphere. The Chief of Police had
approved this application. Mike Ford moved to approve the
license, Seconded by Councilman Duck,motion passed unanimously.

Council reviewed a Beer On/Off Premises License and a Wine On/Off
Premises License application made by Robert Clint Riley, dba
RILEY's GOURMET MARKET, 108 North Section Street(formerly Circle K)
John Brandon spoke saying he and his wife had bought the building
and were going to put his business there but they are not able
to do this at this time and he is going to rent it to Mr. Riley
who wishes to open a gourmet market, that this would be a nice
improvement for the city. No one present was opposed to the
license. Councilman Duck moved to approve the license. Seconded
by Councilman Bishop motion carried unanimously.
Councilman Bishop introduced in writing, and moved for the
adoption of, the following resolution. Seconded by -Councilman
Duck, motion passed unanimously:
RESOLUTION NO. U - 617-45-
A RESOLUTION ASSENTING TO THE PARTIAL VACATION OF THAT CERTAIN
EASEMENT DESCRIBED HEREIN:
WHEREAS, There exists over and across the south 30 feet
of Lot 4, Gatewood Subdivision, Lands of the Fairhope Single
Tax Corporation (Slide 1375-A, Baldwin County Probate Records)
a certain drainage and utility easement, 30 feet in width, and:
WHEREAS, the Owners of the Lands therein have petitioned
the City of Fairhope to assent to vacation of the north half of
said easement, and;
WHEREAS, there is no public need for or public purpose to
be served by the continuance of said easement proposed to be
partially vacated;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAIRHOPE, ALABAMA that the City's assent be and hereby
is granted for filing for record the said Declaration of Partial
Vacation of the said easement as provided by law.

Mrs. lbel Jackson spoke on behalf of the Eastern Shore Art
Association requesting certain streets be closed next year
for the Annual Outdoor Art Show which will be held in conjunction
with Arts & Crafts in March. Discussion brought out that there
will be new officers at the Chamber as of the 1st of June and
Mrs. Jackson will get with them on what approved. Councilman
Ford mentioned that he thought it would be better to have
Magnolia Avenue opened, Mrs. Jackson said that would be okey

but, the letter she had sent the council dide'not show Magnolia
open. Upon further discussion Councilman Dugk moved to
approve the same thing they had last year. .Councilman Bishop
seconded and motion passed unanimously.

At the last council meeting Mayor Nix had asked Councilman Overstreet
and Gen. Supt. Phil Rutherford to look into a request made by Steve
Baker of 124 Fairwood Blvd to put a 3 way stop sign up at Fairwood
& Bayou. Mr. Overstreet reported that he and Mr. Rutherford went
and looked and they moved the children --at play sign and put up a
25 mph speed sign, but, did not recommend putting up 3 way stop
sign. Mr. Baker said they are not slowing down, it is like a curvy
race track, maybe put some speed bumps. Councilman Bishop said maybe
we should concentrate on giving tickets in this area. Mr. Baker
said that he watched a school bus come around that looked like it
was on 2 wheels. Councilman Ford said he tlaught we ought to write
a letter to Supt. Newton to ask the bus drivers to observe the speed
limit and so moved to ask Mayor Nix to write the letter, John Duck
2nd and motion carried unanimously. Otherwise see if action taken works.
Councilman Duck moved to pay bills as presented, Councilman Ford
seconded and motion carried unanimously.
There being no other business, meeting was duly adjourned at 6:30 PM.
