The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 24 April 1995. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 10 April 1995 regular session were duly approved. Mr. John Kendrick, 101 North Bayview Avenue, came before the Council to request the closing of the north end of the Beach to all vehicular and walk-in traffic from 11:00 pm to dawn each day, year round. Mr. Kendrick stated he often calls the police during the wee hours of the morning because he and his family cannot sleep due to noise from the beach. After some discussion, Councilman Overstreet moved to hold a public hearing at the next regular meeting in order to obtain some public comments before taking action on this request. Seconded by Councilwoman Puckett, motion passed unanimously. Mr. Steve Baker 124 Fairwood Boulevard, requested a 3-way Stop Sign be placed at the intersection of Bayou Avenue and Fairwood Boulevard. He stated cars do not observe the 25-mile-per-hour posted speed limit, many trees in the area have been destroyed, and he is afraid a fatal accident is going to occur. After some discussion, Mayor Nix asked Councilman Overstreet and Supt. Rutherford to look into the situation and make a recommendation to the Council at the next regular meeting. So moved by Councilman Duck. Seconded by Councilman Ford, motion passed unanimously. Council reviwed a Restaurant Liquor License application by Holly Bowick, dba THE TEA ROOM, 302 DeLaMare Avenue. Ms. Bowick is the new owner of this existing business, which had been operating with a Restaurant Liquor License under the former owner. No one present was opposed to the license. There was police approval of the applicant. Councilman Ford moved to approve the license. Seconded by Councilman Overstreet, motion passed unanimously. 24 April 1995 1660 Councilman Bishop introduced in writing Ordinance No. No. 969, an ordinance to amend Fairhope's Code of Ordinances Chapter 5, Animals and Fowl, by adding regulations to pre- vent the soiling of other people's property. This ordinance may become known as the "pooper-scooper" ordinance. Council- man Duck moved to suspend the rules in order to take immediate action on this ordinance. Seconded by Councilman Ford, the motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilwoman Puckett then moved for final adoption of Ordinance No. 969. Seconded by Councilman Bishop, motion passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Duck introduced the following six ANNEXATION ORDINANCES in writing. In order to take immediate action, Councilman Overstreet moved to suspend the rules. Seconded by Councilman Ford, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Duck then moved for final adoption of the following six ordinances. Seconded by Councilman Overstreet, motion passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. After some discussion, Councilman Ford placed this request as a motion. Seconded by Council- woman Puckett, motion passed unanimously. Smith Purchasing Agt Councilman Bishop moved to accept the low bid by Hatfield and Company, provided all specifications are met. Smith, Purchasing Agt. Councilwoman Puckett moved to accept the low bid by Harcros Chemical Company, provided all specifications are met. Seconded by Councilman Overstreet, motion passed unanimously. 24 April 1995 1663 Mr. Marshall Carney asked to be heard at the end of the meeting. He showed what he claimed to be a "find", the fossilized horn of a rare Baldwin County Pink Rhino Fantastica, or "Rex", which Mr. Carney had found many years ago along the shore of Mobile Bay near his family home in Daphne. Mr. Carney said there was absolutely no truth to the rumor that this find is actually a piece of driftwood; nor that there is no such animal as "Rex"; and for those who might want to check out the authenticity of his claim, they only had to refer to an article, written by him, in the world-famous paleontologic magazine of July 7, 1998. When asked to repeat the magazine issue date, Mr. Carney again said July 7, 1998, and added that he was willing to sell his find to the City for only $75.00. After passing the horn of Rex around, the Council decided to refer the matter to Councilman Ford, and the Museum Committee. Mr. Carney was given a round of applause. There being no further business, meeting was duly adjourned at 6:20 pm.
