STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 13 February 1995.
Present were Mayor James P. Nix; Councilmembers John V.
Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett,
and Layton Overstreet; and City Clerk Evelyn P. Phillips.
City Attorney Marion E. Wynne was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 23 January 1995 regular session
were duly approved.
A plaque was presented to Paul Todd, upon his retirement
from the Volunteer Fire Department.
A public hearing was held as advertised on the rezoning
request by the Corte Family, E. D. Corte, Jr., Trustee, to
change property at 50 South Church Street from R2 Single
Family Residential to B2 General Business. No one present
was opposed to the change. There was Planning & Zoning Com-
mission approval of the change. After discussion, Councilman
Duck introduced in writing Ordinance No. 967. In order to
take immediate action, Councilman Duck moved to suspend the
rules. Seconded by Councilman Ford, motion to suspend passed
unanimously by the following vote: AYE -Duck, Ford, Bishop,
Nix, Puckett, and Overstreet. NAY- none. Councilman Duck
then moved for final adoption of Ordinance No. 967. Seconded
by Councilman Overstreet, motion to final adopt passed unani-
mously by the following vote: AYE -Duck, Ford, Bishop, Nix,
Puckett, and Overstreet. NAY -none.
A request for a right-of-way easement from Dr. Frank
Martin Lester to allow ingress and egress to his property
on Bay View Street was discussed. Councilman Bishop moved
that the easement be granted: Seconded by Councilman Duck,
motion passed unanimously.
Mr. Clay Walcott, of Walcott & Adams, presented a request
to install more balconies along the remaining side of the
McKean Building on South Section Street. A sketch was pre-
sented. After discussion, Councilman Bishop moved to grant
the request, provided the architect's plan for post positions
along the sidewalk is cleared by our Police and Utility
supervisors. Seconded by Councilwoman Puckett, motion passed
unanimously.
A public hearing was held as advertised on the request
for a Club Liquor License by Nicholas Pappas, dba SOUTHERN
LIGHTS COFFEE HOUSE & BOOK STORE, located at 52j South Section

Street. Mr. Pappas recently obtained a Restaurant Liquor
License. He was now applying for the Club license so as
to serve liquor on Sundays. No one present was opposed to
the license. There was police approval of the applicant.
After some discussion, Councilman Bishop moved to hold the
application over to the next regular meeting. Several of
the members want to actually see the location before taking
any action on this request. Seconded by Councilman Overstreet,
motion passed unanimously.
Council reviewed a Restaurant Liquor License by Andrew
N. Cothran, dba COTTAGE CAFE & BAKERY, 406 Pine Street. The
location is properly zoned and the police approve of the
applicant. Councilwoman Puckett moved to approve the license.
Seconded by Councilman Ford, motion passed unanimously.
Councilman Overstreet moved to reappoint J. Langford
Floyd as Municipal Judge to January, 1996. Seconded by Council-
woman Puckett, motion carried by the following vote: AYE -
Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none.
ABSTAIN -Duck.
Councilman Duck moved to authorize the sale by sealed
bid of:One 185 Ford Mustang, one '86 Chevrolet C10 Pickup,
one 186 Chevrolet Caprice, one '81 Ford Pickup, one 181
Ford Pickup (no engine), and one '73 Massey Ferguson Backhoe.
Seconded by Councilman Ford, motion passed unanimously.
Council took the following action on bids:

Councilman Ford moved to accept the bid by American Meter
Company, provided all specifications are met. Seconded by
Councilman Overstreet, motion passed unanimously.

Councilman Duck moved to accept the low bid by Radix Corporation,
provided all specifications are met. Seconded by Councilman
Overstreet, motion passed unanimously.
Councilman Ford moved to proclaim Wednesday, 22 February
1995, as Arbor Day in Fairhope. There will be a 10:00 o'clock
ceremony at City Hall where various plaques will be awarded
for beautification projects and free tree seedlings will
be given out to residents. There will be Redbud, Slash Pine,
and three varieties of Oak seedlings. Motion seconded by
Councilwoman Puckett and passed unanimously.
Councilman Bishop moved to approve the extension of the
U.S. Department of Energy, Southeastern Power Administration,(SEPA)
contract (Supplemental Agreement #3) as requested (to
31 January 1995) and to thereafter renew monthly until a new
contract is prepared. Seconded by Councilman Ford, motion
passed unanimously.
Mr. Morgan Henderson, and Mr. Warren Gonzales, representing
the Alabama Seafood Association, came before the council
to request support for their efforts to stop pending legislation
to ban gill net fishing in Mobile Bay. Gonzales said their
group is working on legislation to regulate the fishing instead
of banning it as Florida, Mississippi, Louisiana, and Texas
have done. Henderson asked the council to consider adopting
a resolution stating we oppose a strict gill net ban, similar
to the one recently adopted by the Alabama League of Municipalities.
The gentlemen were told their request will be considered.
Gonzales stated more information about their proposed legis-
lation will be sent in about three weeks.
Councilwoman Puckett moved to pay bills as presented.
Seconded by Councilman Overstreet, motion passed unanimously.
Street Supt. Tim Kant advised that the "Tiki" (covered
tables section) is being rebuilt at the Beach.
Mrs. Dorothy Taylor, who lives in Meadowbrook SubDivision,
addressed the Council about neighborhood concerns over future
development in their area. The new school has caused heavy

traffic problems, with Bishop Lane sometimes completely
blocked. Ms. Taylor said she had heard that a multi -family
residential development is being planned and she and her
friends want the Council to know how this is going to further
impact her neighborhood. Ms. Taylor was assured that any
planned development would have to pass before the City Planning
Commission and be approved before it can be presented for
Council action. As a property owner within 300 feet of a develop-
ment, she will be notified by mail of a public hearing at
which time she and her neighbors will be able to speak about
their concern, before the Planning & Zoning Commission.
There being no further business, meeting was duly
adjourned at 6:35 pm.
