HomeMy WebLinkAbout01-23-1995 Regular Meeting1633 STATE OF ALABAMA 0 COUNTY OF BALDWIN 0 The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 23 January 1995. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 9 January 1995 regular session were duly approved. Councilman Duck introduced in writing, and moved for the adoption of, the following resolution. Seconded by Council- woman Puckett, motion passed unanimously: RESOLUTION NO. 475-95 BE IT RESOLVED by the City Council of the City of Fairhope, Alabama, that the City enter into an agreement with the State of Alabama; acting by and through the Alabama Depart- ment of Transportation for: A permit to install an 8" PVC sewer force main along US 98 from Nichols Street to Morphy Avenue (State Highway Project Number DE0019(802) which agreement is before this Council, and that the agree- ment be executed in the name of the City, by its Mayor, for and on its behalf and that it be attested by the City Clerk and the seal of the City affixed thereto. BE IT FURTHER RESOLVED that, upon the completion of the execution of the agreement by all parties, a copy of such agreement be kept on file by the City Clerk. Phillips City Jerk 23 January 1995 1634 A written request from the Alabama Department of Economic and Community Affairs and EnviroBaldwin to hold Bay Day/Earth Day at the Municipal Pier on 22 April 1995 was discussed. The event will showcase Mobile Bay; there will be several non-profit exhibitors, some food booths, -and a small stage. Councilman Ford moved to grant the re- quest. Seconded by Councilman Overstreet, motion passed unanimously. Property owners Charles D. Lake, Betty Ann Billings, Marla J. Michel, and Thomas J. Michel, all of the property owners abutting a 12-ft wide easement along the east side of North Bayview Street between Fairhope and Saint James Avenues, presented a Declaration of Vacation of Easement for the Council's consideration . After discussion, Councilman Bishop introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilman Ford, motion passed unanimously: RESOLUTION NO. 476-95 WHEREAS, Charles D. Lake, Betty Ann Billings, Marla J. Michel, and Thomas J. Michel, being all the owners of property abutting upon the hereinafter named easement and that they desire to vacate said easement, and they do hereby vacate the same; and WHEREAS, the Mayor and City Council of the City of Fairhope, Alabama, a municipal corporation, do assent to and approve the vacation thereof and the annulment of the dedication of said easement to the use of the public; NOW, THEREFORE BE IT RESOLVED by the -Mayor and City Council of the City of Fairhope, Alabama, a municipal corporation, that the act of the aforementioned parties in vacating and annulling the following described easement in the City of Fairhope, Baldwin County, Alabama, to wit: an easement described in an instrument dated January 16, 1950, and recorded in Deed Book 148, page 353, and also in an instrument dated September 27, 1975, and recorded in Deed Book 484, page 107, described as follows: A passageway twelve feet wide on the South side of the property described as: from a point in the middle of Bay View Avenue in the City of Fairhope, on a line between the lands granted Fred Heathershaw by Sara Tatum on May 25, 1899, which said line is 225 ft south of the Southeast Corner of Fairhope and Bay View Avenues, run East 30 ft to the East side of said Bay View Avenue for a POB; thence South along the East side of said Bay View Avenue, 81 ft; thence East 90 ft; thence South 1 ft; thence East 32 ft; thence North 82 ft to the said Heathershaw-Tatum division line; thence West 122 ft to the POB Be and the same hereby.is ratified, approved and confirmed and the assent of the Mayor and City Council of the City of Fairhope, Alabama, a municipal corporation, to such action is hereby given. N1X, 23 January 1995 1635 A local developer, Mr. Curtis Gordan, came before the Council to request an access way across some City property located in the curve of Bay View Avenue traveling north from Magnolia Avenue toward Oak Street. After some dis- cussion, Councilman Bishop asked Mr. Gordan to return to the next regular session with a little more information, including a better map showing where access is being requested. Councilman Ford moved to reappoint Bill Baldwin and Prissy Wilkins, and to appoint Marc Miller, each for a three year term, on the Parking Authority. Seconded by Councilman Duck, motion passed unanimously. Councilman Duck moved to approve a request to hold a fund-raiser by the Fairhopers Community Park Committee. The event will be an afternoon*of classical music at Henry George Park. Seconded by Councilman Overstreet, motion passed unanimously. *Saturday, March llth. It is recommended to accept the low bid by Consolidated Pipe Company at $12.07/assembly.--W.Smith, Purch. Agt. Councilman Bishop moved to accept the low bid by Consolidated provided all specifications are met. Seconded by Councilman Duck, motion passed unanimously. It is recommended to accept the low bid by Consolidated Pipe. --W. Smith, Purch. Agt. Councilman Ford moved to accept the low bid by Consolidated provided all specifi tions are met. Seconded by Councilman Duck, motion passed unanimously. 23 January 1995 1636 Councilman Ford moved to hear the following three items not on the Agenda. Seconded by Councilman Duck, motion passed unanimously: Councilman Duck introduced in writing Ordinance No.966, an ordinance to annex the property of Lynn & Joyce Groome in Montrose. In order to take immediate action, Council- woman Puckett moved to suspend the rules. Seconded by Council- man Overstreet, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix,_ Puckett, and Overstreet. NAY -none. Councilman Duck then moved for final adoption of Ordinance No. 966. Seconded by Councilman Bishop, motion to final adopt passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Overstreet introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilwoman Puckett, motion passed unanimously: RESOLUTION NO. 477-95 WHEREAS, America's first Mardi Gras began with a Frenchman named Nicholas Langlois who established the Societe de la Saint Louis from the celebration of the Masque de la Mobile, or the Feast of Saint Louis, at 27 Mile Bluff on Saint Louis' Day in 1704; and WHEREAS, Mardi Gras began in Fairhope many years ago with the Mari Masquers, most recently followed by the KOER, the MOJ's, and the OOMM's; and WHEREAS, Mardi Gras is a time of fun, fantasy, and beauty, a tradition that affects all of our City; and WHEREAS, there has never been a specific emblem or flag to commemorate this event in our City; NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Fairhope, Alabama, that the Mayor and Council do hereby adopt the Flag, designed by Leila J. Hollowell, a Mobile artist, for the Mobile Chapter of the YWCA, depicting the image of a dancing Jester throwing serpentine and confetti, with the words FAIRHOPE MARDI GRAS emblazoned thereon, in colors of Green, Purple, and Carnival Pink; as the official Fairhope Mardi Gras Flag of the City of Fairhope. ADOPTED THIS 23RD DAY OF JANUARY, 1995. ATTEST Jame Nix, Mayor City Clerk Mobile Chapter YWCA Director Linda Mayson advised that the proceeds from the Flag sales will benefit the YWCA's Daycare Center for Homeless Children. 23 January 1995 1637 The Art Center requested a slight change be made in the street closings approved for the Chamber of Commerce for the Arts & Crafts Weekend event next March. The Center asked that Section Street remain open to Magnolia Avenue, and that Oak Street remain open from Church to Bancroft Streets. Councilman Duck so moved. Seconded by Council- man Bishop, motion passed unanimously. There being no further business, meeting was duly adjourned at 6:00 pm. J es Nix, Mayor YG Evelyn
