HomeMy WebLinkAbout12-28-1992 Regular Meeting1373 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 p.m.; Fairhope Municipal Complex Council Chamber; 161 N. Section Street; Fairhope, Alabama on Monday, 28 December, 1992. Present were James P. Nix, Mayor; Councilmembers Jeanette Puckett, David E. Bishop, Michael A. Ford, John V. Duck and Layton Overstreet; City Attorney Marion E. Wynne and Acting City Clerk Betty Rivenbark. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the December 14 regular session and Decem- ber 15 special session were duly approved as written. A petition for annexation by H/M Partners and Magnolia Trace, Inc., was reviewed. The property to be annexed consists of approximately 487 acres and will be annexed by a series of special meetings Mayor Nix said. He had given a schedule of the meetings to the councilmembers and remarked this procedure is necessary as Fairhope and Daphne have overlapping Police Jurisdictions and the owners have expressed a desire to come into Fairhope City Limits and will help simplify the process when they are ready to come before the Planning & Zoning Com- mission. The subdivision will be known as Rock Creek. After discussion, Councilman Duck introduced Ordinance No. 906 to annex the property in writing. In order to take immediate action Councilman Bishop moved to suspend the rules. Seconded by Councilwoman Puckett, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett and Overstreet. NAY -none. Councilman Duck moved for final adoption of Ordinance No. 906. Seconded by Councilman Over- street, motion for final adoption passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. A second petition for annexation, submitted by Robert H. O'Shall, for property located on the north side of Parker Road which consists of 2 parcels that are next to the property annexed at the last regular meeting was considered. Councilman Bishop introduced Ordinance No.-907 to annex the property, in writing. In order to take immediate action Councilman Duck moved to sus- pend the rules. Seconded by Councilman Mike Ford, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett and Overstreet. NAY -none. Council- man Bishop moved for final adoption of Ordinance No. 907. Seconded by Councilwoman Puckett, motion for final adoption passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. 28 December 1992 1374 Mayor Nix reported he had a request from the American Diabetes Association to use the oval at the municipal pier to start their bicycle race -Tour de Cure on May 8, 1993. This is a cycling event that will run along scenic highway 98 into Point Clear and will begin at 8:00 a.m. and conclude no later than 3:00 p.m. Permission was given for this event last year. Councilman Bishop moved that this request be granted. Councilman Duck seconded motion and it passed unani- mously. Councilman Ford introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilwoman Puckett, motion passed unanimously: RESOLUTION NO. 392-92 WHEREAS, THE CITY OF FAIRHOPE, has been awarded F.Y. 1992 Community Development Block Grant No. LR-CM-RR-92-013 for the implementation of a housing rehabilitation project design- ed to benefit low and moderate income persons, and WHEREAS, said housing rehabilitation is to be implemented in accordance with locally adopted policies, consistent with CDBG guidelines, and reviewed and concurred with by the Ala- bama Department of Economic and Community Affairs, and WHEREAS, such policies have been developed and concurred with by the Alabama Department of Economic and Community Affairs. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Fairhope, Alabama, as follows: Section 1. That the City Council hereby adopts the Policy Statement and Procedures for the implementation of the F.Y. 1992 Community Development Block Grant Housing Rehabilitation Program, said policy statement and procedures attached, marked "Exhibit All. Section 2. That said policy statement and procedures remain in effect during program implementation unless duly amended by resolution of the Fairhope City Council. We had put a minimum of $2,000 on it but no one was willing to pay that. He said it is not running and we would like to go ahead and get rid of it. He would like to recruit sealed bids for the sale of it to be at a time that Wayne and Phil can set. Councilman Overstreet moved to solicit bids for this sale, Councilman Duck seconded motion and it passed unanimously. Mayor Nix, at this time, told the council and members of the audience that Jo Ann Collins, who has been covering meetings for the last 9 years, will be leaving our area as a reporter for the Mobile Press Register. She has accepted a job in Foley closer to her home as reporter there. She was commended for her work here and told she would be missed. Chris Hinkle was introduced as replacing her. The meeting was duly recessed until December 30, 1992 at 5:00 p.m., at which time another annexation ordinance will be considered for H/M Partners, & Magnolia Trace, Inc. Jam s P.
