HomeMy WebLinkAbout10-26-1992 Regular Meeting1345 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 p.m.; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama, Monday, 26 October 1992. Present were Mayor James P. Nix; Councilmembers Jeanette Puckett, Michael A. Ford, Layton Overstreet, David E. Bishop and John Duck; City Attorney Marion E. Wynne and Acting City Clerk Betty Rivenbark. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 5 October 1992 organization meeting and regular session were duly approved as written. At this time, the Honorable James H. Reid, Circuit Judge, 28th Judicial Circuit of the State of Alabama administered the Oath of Office to re-elected councilmember David E. Bishop whose signed oath is inserted at the end of these minutes. Council - member Bishop expressed his appreciation to the citizens and pledged to continue to do his best working for the City. Mayor Nix made the following nominations for appointments, for council action today, instead of being done at the usual October organizational session: For Chief of Police, Jerry Anderson. Councilman Ford moved to approve the appointment. Seconded by Councilman Duck, motion passed unanimously. For City Clerk/Treasurer, Evelyn P. Phillips. Councilman Bishop moved to approve the appointment. Seconded by Council- man Layton Overstreet, motion passed unanimously. For City Attorney & Prosecutor, Marion E. Wynne, Jr. Councilman Overstreet moved to approve the appointment. Seconded by Councilman Duck, motion passed unanimously. For Municipal Judge, Langford Floyd. Councilmember Puckett moved to approve the appointment. Seconded by Councilman Over- street, motion passed with Councilman Duck abstaining. Mrs. Willie Tate addressed the council asking for support in her Special Needs Children program which is going to be accelerated with programs December 5, 6, 1992 and also permission to have a Special Needs Children Race on Dec. 5. She said they are also going to have golf, tennis and art for sale and when we are called upon to please suppot them. Council- man Bishop moved to approve the race as requested, Councilman Duck seconded and motion carried unanimously. 26 October 1992 1346 Skip Jones and Cindy McBrearty were present to give a progress report on the beachfront pavilion committee that had been working since last September when they first submitted a letter seeking support of their idea for a beachfront pavilion. Skip said they had 16 members on their committee and they hoped to build the pavilion with private/corporate funds and then give to the city. He said they have mailed information to different architects in the area and asked if they are interested in competing by submitting designs, and he received 13 responses. He said they have picked a location just south of the rose garden w/seating capacity of 1200 facing southwest. He hoped to have something by end of year and have completed in time for centennial celebration in 1994. Councilman Bishop questioned the parking planned and he responded that they do not plan anymore than what there now and possibly shuttle people in for events. He further said that possibly have as lst part do stage and restrooms. That they just wanted to bring council up to date on what's going on. Charles Ingersoll addressed the council representing the F.S.T.C. and said that with the widening of Greeno Road that there are going to be lessees left with sub -standard lots and they(FSTC) are left in a position that they will have difficulty figuring out annual rent as their rent is figured on the use of the land. That he has been told that these will be figured on a case to case basis and probably will have to go before the adjustment board. He thinks the whole process should be easier and that we should be able to give blanket answers on these parcels. It was pointed out that if we had some idea of the use planned with the space left that Bob could tell what is allowed. After much discussion, Mr. Ingersoll said he just wanted to make the council aware of the problems and possibly get some guide- lines, not try to solve anything tonight, he asked at what point does property become too small to develop? has the council discussed this ... Mayor Nix said we are in the process, now, of rescinding 50 ft. setback requirement and that parking will be a problem on some of the businesses but the ones there will be grandfathered in. Bob said he would be glad to work with him if he will come to him with problems they have on Greeno. Sue Mason, Chairman of the Airport Board told the Council that we have been approached by the Ala. Dept of Aeronautics and F.A.A. asking us to re -apply for portion of grant that was not approved when we did our last F.A.A. project at the Fairhope Municipal Airport. That we could possibly do extension of apron and do an access road and they have indicated that these funds are available. That normally the money would be 90% Federal Funds, 5% State Funds and 5% City money. The original amount of money was $350,000 but we would have to update with 1992 figures. Sue said we had asked for 12 things when first submitted but knew that all would not be approved; we will have to have new drawings and update figures on asphalt, equipment. Councilwoman Puckett moved to approve spending the money needed to update the pre -application and submit it(airport board had requested this action) Council- man Ford seconded and motion carried unanimously. 26 October 1992 1347 There were changes needed to be made to the Fire Roster for insurance purposes and are as follows: Add: Sam Jackson Scott Holy Shane Leiser Rick Hale Delete: Mark Bass Tommy Bozeman Bill Kerin Councilman Ford moved to make the changes as requested. Seconded by Councilwoman Puckett, motion passed unanimously. Tim Kant came before the council to talk about the growth we are experiencing and how the Fire Dept. needs to expand to keep up with growth and keep our ISO rating of 4. He ex- plained process of ISO in issuing rating. He is proposing to go out on bids for a new fire station on training center site and seeking permission from council to get bids. The mayor said that there is money in the capital improvement account for projects like this. Tim said he expects it will cost $35,000- $40,000, they already had the land and plans. Further discussion led to a motion by Councilman Duck seconded by Councilman Overstreet to give permission to go out on bids for this project, motion carried unanimously. Bids had been received for 4 new police cars as follows: Bill Steber 16,194.00 ea. 120 days del. Daphne, Al. Moyer Ford Sales, Inc. Foley, Al. McConnell Automotive Mobile, Al. Foster Ford Bay Minette, Al. Chris Myers Daphne, Al. 13,442.00 ea. It was noted that Moyer Ford and Foster Ford did not meet specs. on engine size requirement for police package. Councilman Bishop moved to accept Bill Steber recommendation from Police 26 October 1992 1348 Chief, Jerry Anderson, and Purchasing Agent, Wayne Smith, provided it meets all specifications. Councilwoman Jeanette Puckett seconded and motion carried unanimously. Councilman Duck introduced and moved for the adoption of following resolution. Seconded by Councilman Overstreet, motion passed unanimously: RESOLUTION NO. 387-92 WHEREAS, the City of Fairhope operates its own Natural Gas Distribution System; and WHEREAS, the City has been purchsing its gas supply by contracting with suppliers for lengthy periods, passing such contracts before the Council in regular business sessions for the Mayor's resolutional authorization to execute as required by law; and WHEREAS, the purchasing of said gas supply has now changed so that, in order for the City to be competitive and to keep their gas rates low in the best interest of its citizens/customers, it is necessary for the Mayor to be enabled to purchase the gas on the Spot Market for varying periods; some as short as only 24 hours; THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor James P. Nix be, and hereby is, authorized to execute such contracts necessary to purchase said gas supply in a timely manner as dictated by the market as though each contract execution had been individually resolutionally authorized by thie Governing Body. Seconded by Councilman Ford, motion passed unanimously: 26 October 1992 1349 RESOLUTION NO. 388-92 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, THAT Mayor James P. Nix is authorized to execute a contract between the City and STEPHEN M. MOTHERSHED, P.E., for engineering service on the widening of U.S. HWY 98, in so far as such services are needed for the relocation of the City's Electrical Distributing Sys- tem. Said engineering services to be paid at such rates and as per contractural requirements as approved by the State of Alabama Highway Department. ADOPTED THIS DAY OF 4 &Lk , 1992. A s P.
