The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 13 April 1992.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Jeanette Puckett, David E. Bishop, Michael A. Ford, and
John V. Duck; City Attorney Marion E. Wynne and City Clerk Evelyn
Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 23 March 1992 regular session
were duly approved.
Special guests tonight: Boy Scout Troop #47 of Fairhope
and Scout Master King. Mayor Nix asked the boys to stand and
introduce themselves, and invited them to come back soon.
The Scouts earn a merit badge by attending a City Council
meeting. They also were given a copy of the City's current
budget by the City Clerk as requested.
Councilman Duck moved for final adoption of Ordinance
No. 891, an ordinance to annex the property of Patricia Bosby
McQuitery (south of corporate limits, contiguous, on west
side of Ingleside Street), introduced in writing at the
March 23rd regular meeting. Seconded by Councilman Ford,
motion to final adopt Ordinance No. 891 passed unanimously.
Councilwoman Puckett moved for final adoption of Ordinance
No. 892, an ordinance to annex the property of Chester and
Mary Lou Hunt (south and east of corporate limits, contiguous,
at south end of Melvin Lane), introduced in writing at the
March 23rd regular meeting. Seconded by Councilman Ford,
motion to final adopt Ordinance No. 892 passed unanimously.
Councilman Duck introduced in writing an ordinance autho-
rizing the lease and sale of the St. James Episcopal Church
property to the University of South Alabama. In order to
take immediate action on this ordinance, Councilwoman Puckett
moved to suspend the rules. Seconded by Councilman Duck,
motion to suspend passed unanimously by the following vote:
AYE -White, Puckett, Nix, Bishop, Ford, and Duck. NAY -none.
Councilman Duck then moved for final adoption of the ordinance,
Ordinance No. 893. Seconded by Councilman Ford, motion to
final adopt Ordinance No. 893 passed unanimously by the following
vote: AYE -White, Puckett, Nix, Bishop, Ford, and Duck. NAY -
none.

Councilman Bishop introduced in writing, and moved for
the adoption of, the following resolution. Seconded by Council-
man Duck, motion passed unanimously:
RESOLUTION NO. 371-92
WHEREAS, Section 402(p) of the Clean Water Act (CWA) Amendments of 1987 require a phased
approach to control pollutants in storm water discharges, including permit application re-
quirements, permit issuance deadlines, and permit compliance conditions for different cate-
gories of storm water discharges; and
WHEREAS, in compliance with the requirements of Section 402(p) of the CWA, the U.S.
Environmental Protection Agency (EPA) has established and published final regulations
governing storm water discharge permit application requirements under the National
Pollutant Discharge Elimination System (NPDES) program; and
WHEREAS, said permit application requirements pertain to storm water discharges associated
with industrial activity; discharges from large municipal storm water systems; and
discharges from medium municipal separate storm water systems; and
WHEREAS, the Alabama Department of Environmental Management (ADEM) is the State agency
charged with the delineation of municipal areas that must obtain an NPDES permit for storm
water discharge, as well as with the approval of the permit applications in compliance with
the regulations and the issuance of the permit; and
WHEREAS, ADEM has delineated a metropolitan area in Mobile County that includes the Cities
of Mobile, Prichard, Chickasaw, Saraland, Satsuma and Creola and part of the unincorporated
area of Mobile County; and an area in Baldwin County that includes the Cities of Daphne
and Fairhope and part of the unincorporated area of Baldwin County; and
WHEREAS, each local entity may prepare its own application separately, thereby incurring
the full costs of the Phase I application process including $1,500.00 application fee and
the subsequent Phase II continuing sampling costs; or each may agree to participate in the
preparation of a single metropolitan application, thereby sharing the costs of the Phase
I application process including the single $1,500.00 application fee; and
WHEREAS, the local governments concerned, including the Alabama State Highway Department
which is also required to obtain a permit, have mutually agreed that it is in their best
interests to prepare a single application for the identified metropolitan area; and
WHEREAS, the City of Fairhope considers it advantageous to the City to participate in said
joint application and to share the costs of the process; now
THEREFORE, BE IT RESOLVED by the Fairhope City Council as follows:
1. The City of Fairhope hereby agrees to participate in the single metropolitan area
storm water discharge permit application process being coordinated by the South
Alabama Regional Planning Commission (SARPC) for Mobile County, Mobile City,
Prichard, Chickasaw, Saraland, Satsuma, Creola, Baldwin County, Daphne, Fairhope
and the Alabama State Highway Department.
2. The City of Fairhope will hire and pay its own Consultant/Engineer to take the
required samples for the number of discharge points allocated to the City of Fairhope
and prepare the maps and other data in the format required to meet the Federal and
State guidelines for the Phase I storm water application.
3. The City of Fairhope will cooperate with the SARK and other metropolitan entities
in the application process and will submit all required documentation for the City
of Fairhope in the proper format prior to the deadline date of 24 April 1992.
4. The City of Fairhope hereby appoints GEN. SUPT. PHIL RUTHERFORD as its official
contact person for all matters connected with the application process.
5. The Mayor of the City of Fairhope is hereby authorized to furnish all information
and sign all documents, contracts and other requirements necessary to insure
completion of the City of Fairhope part of the Phase I application for submission
to ADEM prior to the deadline date of 18 May 1992.
6. The City of Fairhope agrees to pay the SARPC $687.50 as its share of the coordinated
application cost which amount includes the City of Fairhope share of the single
$1,500.00 application fee for the metropolitan area Phase I permit.
7. The City of Fairhope fully understands that the single metropolitan application must
be submitted to ADEM by 18 May 1992 and that failure on the part of the City of
Fairhope to meet the deadline for submission of all required documents and maps to
the SARK will result in the City of Fairhope being dropped from the coordinated
single application and left to submit its own separate application and the City of
Fairhope will thereby incur all costs, including the full $1,500.00 application fee,
associated with the Phase I permit application process, including also the full costs
of all subsequent continuing sampling associated with Phase II of the
Federal requirements.

Councilwoman Puckett moved to declare 26 April 1992 as
"Earth Day" in the City and to approve the use of the Pier
area for demonstrations and displays. Seconded by Councilman
Duck, motion passed unanimously.
Councilman White moved to approve expenses to send six
Volunteer Firemen to the annual Fire College training program.
Seconded by Councilman Duck, motion passed unanimously.
Council discussed a requested Change Order on the Marlow
Water Line Project. This will increase Meadow Construction
Company's contract by $15,200.00 and involves changing 8,000
if of 3/4 P.V.C. line to 8,000 if of Copper line. Councilman
White moved to approve Change Order #2 authorizing this change.
Seconded by Councilwoman Puckett, motion passed unanimously.
The following action was taken on bids:
FOR 51 TRANSDUCERS - ELECTRIC DEPT
Only one bid came in on these components for the SCADA system:
Hatfield & Company of Mobile, at a total cost of $16,987.80.
After discussion, Councilman Bishop moved to accept the bid,
provided all specifications are met. Seconded by Councilman
Duck, motion passed unanimously.
FOR 84 BATTERIES FOR ELECTRIC GOLF CARTS
Only one bid came in on these special batteries: Powermaster,
Inc., of Troy, at a total cost of $3,355.80. After discussion,
Councilwoman Puckett moved to accept the bid, provided all
specifications are met. Seconded by Councilman Duck, motion
passed unanimously.
Councilman Bishop moved to hear the following business
not on the Agenda. Seconded by Councilman Ford, motion passed
unanimously:
A letter from the US Coast Guard Auxiliary was read. In
connection with 1992 Safe Boating Week, the Auxiliary requests
permission to use the Pier Area on June 6th for demonstrations,
displays, and a swim meet. Councilman Bishop moved to approve
the request. Seconded by Councilman Ford, motion passed unani-
mously.
Councilman White moved to pay bills as presented. Seconded
by Councilman Ford, motion passed unanimously.
Meeting was duly adjourned at 5:53 pm.
