The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 23 March 1992.
Present were Mayor James P. Nix; Councilmembers Roy
C. White, Jeanette Puckett, David E. Bishop, and Michael
A. Ford; City Attorney Marion E. Wynne and City Clerk Evelyn
P. Phillips. Councilman John V. Duck was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 11 March 1992 regular session
were duly approved.
The second required public hearing, on applying for
a CDBG housing rehabilitation grant, was opened as advertised.
There was no public comment. Councilman Bishop introduced
in writing, and moved for the adoption of, the following
resolution authorizing the Mayor to execute the application.
Seconded by Councilman Ford, motion passed unanimously:
RESOLUTION NO. 370-92
WHEREAS, the City of Fairhope wants to take all steps within
its power to improve the quality of life for its citizens; and
WHEREAS, the Alabama Department of Economic and Community Affairs
(ADECA) makes community development block grant funds available
to local governments under the Housing and Community Development
Act of 1974, as amended, to implement projects and improvements
that principally benefit persons of low -and -moderate income;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Fairhope, Alabama, as follows:
1. That the City make application to ADECA for a community devel-
opment block grant in the amount of $322,100.00 for the purpose
of partially financing a housing rehabilitation program in the
Gaston Avenue and Nichols Avenue areas of the City, and undertake
incidental street, sidewalk, and drainage improvements in the
same areas.
2. That the City commits inkind labor and equipment use and materials
to implement incidental street, sidewalk, and drainage improvements
in the project areas an equivalent amount to be documented of not
less than $60,130.00.
3. That the City commits inkind administrative services of not
less than $12,250.00.
4. That the City will make every effort to assist qualified rehabil-
itation applicants in obtaining their required matching funds from
participating financial institutions, or assist in obtaining other
alternate financing, and in the event such financing cannot be

arranged, the City will provide financing for no less than
$154,000.00 in other public improvements within the
project areas.
5. That James P. Nix, in his capacity as Mayor, is authorized
and directed to execute said application on behalf of the City,
and submit the same for funding consideration.

Council reviewed the Restaurant Liquor License application
by Cheri A. Field, dba �.L. INC., 216 Magnolia Street, held
over from the March llt meeting. Two citizens spoke against
approval of the application: Mr.Randy Smith said the location
is too near residential zoning, too near the University
of South Alabama campus, and does not have adequate parking;
Mr. Shep Shepard said the City does not need another bar/res-
taurant. There was police approval of the applicant. After
some discussion, Councilman White moved to deny approval
of the application. Seconded by Councilman Bishop, motion
to deny passed unanimously.
A request for a 4-way stop sign at the corner of Volanta
and Bon Secour (by Mr. William Murphree and Mrs. Barbara
Kenneday) was discussed. This is a main east -west route
and Councilman Bishop felt the stop sign would create more
problems than it would solve. Zoning Official Bob Lunsford
reported that a sign is not warranted according to his manual.
Councilman White moved to have the Mayor write Mr. Murphree
and Mrs. Kenneday setting out the reasons for denying their
stop sign request and setting forth actions to be undertaken
to relieve their problems. Seconded by Councilwoman Puckett,
motion passed unanimously.
Council reviewed a petition, signed by 53 property
owners on County Road 1 in the Mullet Point area, asking
that they be given a cost estimate to extend the City's
gas service some 5 miles down County Road 1. Council directed
Gas Supt. Steve Seay to prepare the estimate and bring it
back to the Council for consideration.

Council discussed an annexation petition by Patricia
Bosby McQuitrey. Property is located contiguous to corporate
limits, on the west side of Ingleside Street, south of city,
and contains 1/2 acre, more or less. Councilman Ford intro-
duced an ordinance, in writing, to annex as requested. This
ordinance will be given final consideration at the next
regular meeting.
Council discussed an annexation petition by Chester
and Mary Lou Hunt. Property is located contiguous to, and
south and east of, the corporate limits, at the end of
Melvin Lane; and contains 1.38 acres, more or less. Councilman
Ford introduced an ordinance, in writing, to annex as requested.
This ordinance will be given final consideration at the
next regular meeting.
Engineering consultant Ack Moore presented Change Order
No. 1, adding $17,003.26, to the Meador Contracting Company's
contract to construct the waterline extension known as the
Marlow Water line project. Mr. Moore explained this change
order covers contract adjustments to add a part of a road
to the project and to install some requested fire hydrants.
Councilwoman Puckett moved to approve Meador Contract Change
Order No. 1. Seconded by Councilman Ford, motion passed
unanimously.
Councilman Ford moved to update the Police Reserve
roster by adding Mark Tunstall. Seconded by Councilman
Bishop, motion passed unanimously.

Councilman Bishop moved to accept the low bid by Mack Electric
at $12,516 actual cost, provided all specifications are
met. Seconded by Councilman White, motion passed unanimously.

Council discussed recommendation, Mr. Rejczyk and Mr. Smith
both being present. Their reasons for recommending Alabama
Waterworks bid instead of low bidder Consolidated Pipe did
not satisfy, so Councilman White moved to authorize the
Mayor and the Attorney to place the order after they determined
what to do. Seconded by Councilman Ford, motion passed
unanimously.
(Mayor advised the City Clerk on Wednesday, March 25th,
that order was placed with Consolidated Pipe at $5,350,
alternate valve did not meet specifications.)

Councilman White moved to accept the low bid by Alabama
Waterworks at $13,150, provided all specifications are met.
Seconded by Councilwoman Puckett, motion passed unanimously.
Councilman Bishop questioned Zoning Enforcement Officer
Bob Lunsford about the 30-day limit on temporary signs --
could this be waived, or the time extended, for campaign
signs during all the elections going on this year? Lunsford
advised that the signs are limited to"not more than 30 days
before the primary, with removal after election day," and
this answer satisfied Bishop.
Meeting was duly adjourned at 6:15 pm.
