HomeMy WebLinkAbout01-27-1992 Regular Meeting1271 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 27 January 1992. Present were Mayor James P. Nix; Councilmembers Roy C. White, Jeanette Puckett, David E. Bishop, and Michael A. Ford; City Attorney Marion E. Wynne and City Clerk Evelyn P. Phillips. Councilman John V. Duck was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 13 January regular session, the 15 January special session, and the 16 January 1992 special session were duly approved. Ms. Beverly Jennings, Baldwin County Electric Membership Corporation, was pleased to present their annual business license fee, a check in the amount of $5,503.45. The Colonial Inn, on South Mobile Street, has been declared a dangerous building as per Ordinance No. 860 and, as per same ordinance, has been scheduled for a "hearing" as follows: 13 November 1991 rescheduled to 15 January 1992, rescheduled to this date, 27 January 1992. Mr. Wes Overton, Inn owner, and Mr. Carlton Neimeyer, realtor, advised Council they should be able to advise whether or not they can make the building safe in the next seven -to -ten days. Mr. Joe Thomas Odom, representing the Volunteer Fire Department, said they do not believe the building can be made safe, they know it cannot be made secure, and they want to go on record tonight that they will not be held responsible for what might happen, to the Inn or to the surrounding area, as long as the building remains standing in its present condition. After discussion, Councilwoman Puckett moved to give final notice tonight that the Colonial Inn must (a) be repaired and made safe enough to satisfy both the Volunteer Fire Department and the Building Official; or (b) be demolished within the next thirty days. (27 February 1992). Seconded by Councilman Ford, motion passed unanimously. Councilman Bishop moved to approve Wilkins, Bankester, Biles, and Wynne's request to place four decorative iron posts in front of their offices at 221 Fairhope Avenue; posts to be 4-feet back from curb, leaving approximately four feet of sidewalk clear. Seconded by Councilman Ford, motion passed unanimously. 27 January 1992 1272 Councilman Bishop introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilwoman Puckett, motion passed unanimously: RESOLUTION NO. 366-92 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, That Mayor James P. Nix is hereby authorized to execute a Purchase Contract when needed by the Fiscal Agents on the $2,940,000 principal amount, General Obligation Warrants issue of 1 January 1992. APPROVED & ADOPTED TH S 27th DAY OF JANUARY, Nix, Mayor erk Mayor Nix introduced Dr. Phillip Norris, University of South Alabama, and asked him to go over a proposal from the University to the City. Mayor Nix explained that, due to his connection with the University, he would not participate in presenting the plan. Dr. Norris told the Council that the University has anopportunity to expand their operations in Fairhope if the City is agreeable to purchasing the St. James Episcopal Church property, and to then selling said property on a lease -purchase plan to them. At the time of purchase by the City, the University will pay the City $100,000 and then make five annual payments of $25,000 to complete the purchase. The City is to purchase the property for $200,000 and spend up to $25,000 renovating for classroom space. After discussion, Councilman White introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilman Ford, motion passed by the following vote: AYE -White, Puckett, Bishop, and Ford. NAY -none. RESOLUTION NO. 367-92 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, That Mayor James P. Nix is hereby authorized to pur- chase the St. James Episcopal Church property, as described in the attached Exhibit "A", for the sum of Two Hundred Thousand Dollars ($200,000), to be paid from the general funds of the City; said purchase to be complete prior to 15 May 1992; and BE IT FURTHER RESOLVED that said property is to be renovated by the City; said renovation cost not to exceed Twenty-five Thousand Dollars ($25,000.) APPROVED & ADOPTED THIS 27th DAY OF JANUARY, 1992. 27 January 1992 1273 Councilman Ford introduced Ordinance No. 888, an ordinance establishing the Mayor & Councilmem ers' compensation for term beginning 5 October 1992. In order to take immediate action, Councilman Ford moved to suspend the rules. Seconded by Councilwoman Puckett, motion to suspend passed unanimously by the following vote: AYE -White, Puckett, Nix, Bishop, and Ford. NAY -none. Councilwoman Puckett then moved for final adoption of Ordinance No. 888. Seconded by Councilman Bishop, motion to final adopt passed unanimously by the following vote: AYE -White, Puckett, Nix, Bishop, and Ford. NAY -none. Council considered a letter from the Baldwin County Commissioners requesting a 10-foot wide deeded right-of- way along Windmill Road from County Road No. 27 east for a distance of .50 miles. Councilman White introduced an ordinance complying with the request provided the City would not have to move any of its utility lines; or if lines had to be moved, the County will bear the expense. The ordinance will be considered at the next regular Council session. Councilman White moved to accept the Audit Report for Fiscal Year 10/1/90 - 9/30/91, prepared by Hartmann, Blackmon, $ Kilgore, P.C. Seconded by Councilman Ford, motion passed unanimously. Councilman Ford moved to approve the current 1/1/92 Fairhope Police Reserve Roster, for insurance purposes. Seconded by Councilwoman Puckett, motion passed unanimously. Councilwoman Puckett moved to approve the Eastern Shore Chamber of Commerce request to close Section Street from Magnolia north to Oak Avenue for the 1992 Arts $ Crafts festival.
