COUNTY OF BALDWIN Z
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber ;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 13 January 1992.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Jeanette Puckett, David E. Bishop, Michael A. Ford, and
John V. Duck; City Attorney Marion E. Wynne and City Clerk Evelyn
Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 23 December 1992 regular session
were duly approved.
Mayor Nix introduced County Commissioner Wendy Allen who
advised she was pleased to attend the meeting and to present
a check from the County Commission to the City for some
$7,558.76. This check covers the city's share of some off -shore
drilling severance tax collected by the County from 1988 through
1991, under State Legislative Act #84-736. Ms. Allen explained
the delayed delivery of this first check was due to some mis-
understanding about how the tax was to be distributed between
the county, the various municipalities, and others. She said
this has now been worked out and the City can expect an annual
check from the County for this severance tax, which can be used
for any general purpose.
Councilman Bishop moved to authorize bid requests on culvert,
some labor, raising about 150 manholes, and street painting to
do the spring resurfacing project planned for some 75-80 city
streets. Asphalt will be purchased at the state contract price.
Seconded by Councilman Duck, motion passed unanimously.
The Alabama Department of Environmental Management (ADEM)
requires the Water Department to set up a water site sampling
plan for bacteriological monitoring and to have the written plan
officially adopted by the city's governing body. The Council
has reviewed the Fairhope Water System Sample Siting Plan, which
is explained in detail in a letter addressed to ADEM dated
26 June 1991 and which is on file in the Water Department's office
and in the Mayor's office, and Councilman Duck moved to approve
and adopt said Plan. Seconded by Councilwoman Puckett, motion
passed unanimously.
Councilwoman Puckett introduced in writing, and moved for
the adoption of, the following resolution. Seconded by Council-
man Ford, motion passed unanimously:

RESOLUTION NO.
A RESOLUTION ESTABLISHING SMALL BUSINESS DEVELOPMENT
DAM AND ACKNOWLEDGING THE EFFORTS OF THE EASTERN SHORE
CHAMBER OF COMMERCE IN DEVELOPING A PUBLIC FORUM FOR THE
DEVELOPMENT OF BUSINESSES ON THE EASTERN SHORE.
WHEREAS,the development of a sound local ecomony depends on
development and nurturing of new and existing businesses;
and
WHEREAS, the Eastern Shore Chamber of Commerce recognizes
the value of developing and improving the opportunities for
existing businesses on the Eastern Shore; and
WHEREAS, in an effort to facilitate and provide a forum for
the continued development of existing businesses on the
Eastern Shore, the City of Fairhope hereby declares
4 FEBRUARY 1992 as SMALL BUSINESS DEVELOPMENT DAY; and
WHEREAS, during this day the Chamber of Commerce will hold
a number of workshops related to the development and
improvement of existing businesses on the Eastern Shore; and
WHEREAS, the City of Fairhope recognizes the value and
efforts of the Eastern Shore Chamber of Commerce during Small
Business Development Day; NOW THEREFORE
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, That 4 February 1992 is hereby designated Small
Business Development Day; and that the efforts of the Eastern
Shore Chamber of Commerce in providing a forum and an
opportunity for the development of existing businesses on
the Eastern Shore is hereby officially acknowledged and
proclaimed.

Councilman Ford introduced in writing, and moved for the
adoption of, the following resolution. Seconded by Councilman
Bishop, motion passed unanimously:
RESOLUTION NO. 364-92
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, That Mayor James P. Nix is hereby
authorized to execute a contract with BCM ENGINEERS, INC.,
of Mobile, Alabama, to provide engineering services to
renew permit for the City Landfill and to prepare a short-
term strategic Plan as required by the Alabama Department
of Environmental Management (ADEM). Work to be done in
two phases: Task I cost not to exceed $4,000 without
authorization; Task II cost not to exceed $3,000 without
authorization.
ADOPTED THIS 13th DAY OF JANUARY, 1992.

Councilman White moved to reappoint Bill Baldwin and William
Lucey, each to a three-year term, to the Parking Authority.
There being no other nominations, Councilman Duck seconded the
motion which passed by a unanimous vote.
Councilman Duck moved to pay bills as presented. Seconded
by Councilman Ford, motion passed unanimously.
Mayor Nix reported over seven inches of rain fell during
the last twenty-four hours but no major damage has resulted.
Floyd Enfinger, a local attorney representing Fairhope Flying
Services, Inc., advised the Council of his concern over how
the search for a Fixed Base Operator for the Fairhope Municipal
Airport was being handled. Mr. Enfinger said the Board had
sent out requests for new bids even though the Council did not
reject the bids at the last meeting. Mayor Nix informed him
that the City is not required to solicit bids in this matter,
the bids idea was being used by the Airport Board in their search
for the best possible candidate; and the Council would take
no part in the matter until it is brought to them for action
by the Airport Board.
Meeting was duly adjourned at •50 pm.
